    1. از آن جا که «فلسفه فقه» را می توان علمی در آستانه ظهور دانست، تلقی ما از چیستی آن می تواند در کیفیت تکوین و جهت گیری مباحث آن موثر باشد.
    2. فلسفه فقه از سنخ فلسفه های مضاف است و یکی از اسباب عمده اختلاف در تحدید و بیان چیستی آن، اختلاف نظر در تحدید این سنخ علوم (به طور کلی) است.
    3. هشت تعریف از فلسفه فقه ارائه شده و با توجه به مبانی صاحبان تعریف، نقاط قوت و ضعف هر یک تبیین شده است.
    4. نسبت فلسفه فقه با دیگر علوم همگن همچون کلام، رجال و درایه و به ویژه اصول فقه بررسی شد. آیا با این علوم تداخل دارد و چگونه؟ و در صورت تداخل، آیا مضر و مانع از تاسیس علمی به نام فلسفه فقه است یا نه؟

    فلسفه فقه به مثابه دانشی نوپا با نگاه درجه دوم و تاریخی به مبانی نظری و تحلیلی پدیده ها پرداخته و جنبه های توصیفی و توصیه ای آن را مشخص می سازد. مسائل مهم فلسفه فقه عبارتند از چیستی فقه به لحاظ موضوع و محمول و گستره فقه، پرسش های موضوع شناسی فقه، معرفت شناسی و مبانی فقه، پیش فرض های فقه، رابطه فلسفه فقه یا فقه با علوم دیگر و ویژگی های حقوق و فقه اسلامی.
    در این نگاشته به مهم ترین چالش های فلسفه فقه از جمله ثابت و متغیر بودن فقه، جامعه ساز و طراح و برنامه ریز نبودن، دنیایی وظاهربین بودن و مصرف کننده بودن و نیز تکلیف مداری آن بحث شده است.

    مقاله درآمدی بر جایگاه مصلحت در فقه با هدف بررسی پرسش های مهم درباره رابطه فقه و مصلحت تدوین شده است. در این مقاله، پس از توضیح برخی واژگان و طرح موضوع، به پیشینه کاربرد مصلحت در فقه و اصول شیعه وسنی پرداخته شده؛ سپس مباحث اصلی در سه بخش ادامه یافته است. در بخش اول، مصلحت، پایه جعل احکام شرع که به وسیله شارع مقدس در نظر گرفته می شود، مورد بررسی است. در بخش دوم، مصلحت به صورت ابزاری که تشخیص و تعیین آن به استنباط حکم کلی شرعی بینجامد بررسی شده است. در همین بخش، به مبحث معروف مصالح مرسله در اصول فقه اهل سنت اشاره ای رفته است. در بخش سوم که حساس ترین بخش مقاله است، مصلحت به صورت پایه صدور حکم حکومتی و ابزاری در مدیریت جامعه مورد بررسی فشرده قرار گرفته و دغدغه اصلی این بخش این است که چگونه می توان از این ابزار استفاده کرد و به اصول و مبانی دینی و فقهی هم به اداره جامعه پایبند بود.

    «نهادهای راهنمای فهم قرآن» به اصول پیش انگاشته ای اطلاق می شود که بدون درک و لحاظ لوازم مترتب بر آنها، فهم صائب و جامع وحی نامه الاهی میسر نمی گردد. مولف معتقد است نهادهای فهم قرآن، از مهم ترین فصول فلسفه معرفت تفسیری و مبانی کلامی تفسیر است.
    وحیانیت، هدایت مالی، حکیمانگی، فطرت نمونی آموزه ها و عقلایی بودن زبان قرآن، امهات نهادهای فهم کتاب الهی است و اصولی چون جامعیت و شمول، انسجام درونی، سامانمندی برونی، ترابط و تعامل روشمند کلام الهی با سنت قولی و فعلی معصومان، حتی زبان قرآن، از نهادهای پنجگانه بالا قابل اصطیاد است.
    در شماره پیشین مجله، سه نهاد وحیانیت متن و محتوی، هدایت مآلی آموزه ها و عقلایی بودن ساخت عمومی زبان قرآن، مورد بررسی قرار گرفت، اکنون دو نهاد حکیمانگی و فطرت نمونی تقدیم خوانندگان فرهیخته می شود.

    در این مقاله، تساهل و تسامح در مقررات فقهی و حقوقی اسلام بررسی شده است. در بخش نخست، ادله اثبات قاعده ای به نام قاعده تساهل و تسامح را بررسی خواهیم کرد. برای اثبات این امر، از کتاب، سنت، عقل و بنای عقلا استفاده شده است بعد از شمارش ادله قاعده، در بخش دوم، بخشی از قوانین اسلامی (حقوقی اجتماعی) را بررسی کرده، با تجزیه و تحلیل آن ها، جایگاه قاعده تساهل و تسامح را در وضع و اجرای این قوانین از سوی شارع مقدس می یابیم. در بخش سوم نیز به استنادهای فقی هان در استنباط احکام برای این قاعده خواهیم پرداخت که از مجموع مباحث و ادله، به نقش تاثیرگذار انعطاف پذیری قوانین فقهی حقوقی اجتماعی برای رسیدن بشر به سعادت واقعی اش پی خواهیم برد.

    بر اساس آموزه های اسلامی، شریعت به لحاظ زمان و مکان ثابت است؛ اما روابط اجتماعی متعلق آن پیوسته در حال دگرگونی است. با این وضع، چگونه می توان مدعی ثبات شریعت شد؟
    در این مقاله، ابتدا دستگاه تشریع درباره نحوه تشریع احکام به گونه قضایای حقیقی بررسی، و بیان شد که شریعت، به حسب عناوین ثابت است و احکام شرعی، روی عناوین جعل می شوند و هر جا و بر هر رابطه ای، عنوانی از عناوین شریعت منطبق شود، در پی آن، حکم آن عنوان منطبق خواهد شد؛ بنابراین، تحول روابط هیچ منافاتی با ثبات شریعت ندارد. این عناوین، اعم از عناوین احکام اولی و ثانوی است. با این تحلیل بیان شد که ما احکامی در عرض احکام اولیه به نام احکام حکومتی نداریم و ولی فقیه و حاکم اسلامی هیچ گاه در هیچ منطقه ای حکم، جعل و تشریع نمی کند؛ بلکه با شناسایی عناوین روابط احکام، حکم آن عنوان که در شریعت مشخص شده است، منطبق می شود.
    در احکام روابط اجتماعی و کلان نیز مساله به همین نحو است؛ اما در این گونه احکام، بسیاری مواقع تزاحم بین احکام روابط اجتماعی و کلان از یک طرف، و احکام فردی از طرف دیگر پیش می آید که روش برطرف کردن تزاحم، همان روش فقه سنتی است. ولی فقیه و حاکم اسلامی، عناوین روابط اجتماعی و کلان را به وسیله بازوی مشورتی خود، مجمع تشخیص مصلحت، تشخیص داده؛ آن گاه حکم آن عنوان را منطبق می کند.

    معصومان علیهم السلام دارای شوون تبیین دین، حکومت، قضا و شان شخصی هستند. اگر گفتار یا رفتار آنان صادر از شان تبیین دین باشد، حکم مستفاد از آن، حکم ثابت است، و اگر صادر از دیگر شوون باشد، حکم آن، موقتی و متغیرخواهد بود؛ گرچه می تواند با ملازمه بر احکام ثابتی از دین نیز دلالت کند. اگر شک داشتیم که گفتار یا رفتاری صادر ازشان تبیین دین یا دیگر شوون است، وظیفه چیست؟ چهار قول در این زمینه وجود دارد:1. انکار اصل اولی که مدرک آن «ابطلال مدارک دیگر اقوال» است؛2. اصل اولی تغییر که مدرک آن «اصالت برائت» و «استصحاب عدم تشریع» است؛3. اصل اولی ثبات که مدرک آن «اطلاق مقامی گفتار و رفتار در صدر از شان تبیین دین» و «ارتکاز متشرعه غیرمردوعه» است؛4. تفصیل بین موضوعات که یا وجود اصل اولی در برخی از موضوعات را انکار می کند، و یا در برخی از موضوعات، اصل اولی را اثبات و در برخی دیگر تغییر می داند، و مدرک آن «ترکیبی از مدارک اقوال دیگر» به انضمام قراین عامی در متغیر بودن برخی از موضوعات است.
    از دیدگاه نویسنده، اصل اولی ثبات صحیح است و معقول ترین تفسیر در قول تفسیر نیز به پذیرش اصل اولی ثبات بازمی گردد.

    شمول یا عدم شمول شریعت بر همه شوون و اطراف زندگی آدمیان از دیرباز مورد گفت وگو و مطمح انظار بوده و امروزه یکی از پرچالش ترین مسائل است. آن چه بر ضرورت این بحث افزون بر آن چه گذشت تاکید می کند، اظهارنظرهایی است که در این زمینه صورت گرفته و از افراط و تفریط خالی نیست؛ به ویژه که این بحث صرفا فنی و علمی، گاه صبغه سیاسی به خود گرفته و اندیشه هایی بی پایه وغیرعلمی را پدید آورده است.
    در این مقاله، کوشش بر این است که بحثی به دور از آسیب های پیشین و با توجه به قرآن، سنت و عقل سامان یابد. نویسنده، محور اصلی بحث را «تبیین حوزه شریعت و نقش عرف در این زمینه» قرارداده است و در مجموع، به چهار اندیشه اشاره می کند:اندیشه شمول، انعزال، ابهام و اعتدال اندیشه اول بر این است که هر حرکت و سکونی در شریعت جهانی وجاودان (شریعت اسلام) دارای حکم است. نقطه مقابل این نظریه، گرایش به انعزال و بی طرفی مطلق قانونگذار اسلام درباره شوون دنیایی آدمیان است.
    در اندیشه ابهام بر این که اصولی کلان و عام به وسیله شارع بیان شده، بدون این که دخالتی از وی در امور خرد و ساختارها صورت گرفته باشد، تاکید می شود.
    در این میان، اندیشه ای که راهی میانه را می پیماید و به وجود حکم در هر واقعه معتقد نیست، اما اندیشه انعزال و ابهام را نیز غیرکافی و ناموفق می بیند، «اندیشه اعتدال» است.
    در دیدگاه اعتدال، وجود منطقه ای فارغ از جعل، مورد تردید قرار گرفته و تقسیم احکام به عقلی و شرعی رد، و بر تقسیم احکام شرعی به عقلی و نقلی تاکید شده است.

    با توجه به جامعیت و کمال شریعت اسلام، پرسش هایی در زمینه فلسفه فقهی حکومت دینی از جمله مساله ثبات و تغیر احکام دین و چگونگی تحولات شریعت و انطباق آن با مقتضیات زمان مطرح شده که مقاله حاضر، به بررسی چند پرسش اساسی در این زمینه پرداخته است:1. آیا در اسلام قوانین ثابت و متغیری وجود دارد، و با فرض وجود چنین قوانینی، آیا اختیار تعیین تکلیف درخصوص قوانین متغیر در زمان غیبت امام عصر (عج)، به فقیه جامع الشرائط نیز منتقل شده است؟
    2. بر فرض انتقال این اختیارات، چه ضابطه ای برای مصلحت اندیشی ولی فقیه در محدوده قوانین ثابت و متغیراسلام و انطباق این احکام با مقتضیات زمان وجود دارد؟
    3. آیا احکام حکومتی ولی فقیه که بر مبنای مصلحت صادر می شود، بر دیگر احکام اولیه اسلام تقدم دارد؟
    مقاله حاضر با توجه به پرسش های یادشده، با محوریت موضوع مصلحت و نقش آن در تحولات شریعت،دیدگاه های گوناگون از جمله دیدگاه حضرت امام خمینی رحمه الله و نیز دیدگاه شهید صدر را در این زمینه با عنوان «منطقهالفراغ»، نقد و بررسی کرده است.

As the philosophy of fiqh seems to be a new emerging science, our perspective of the nature of philosophy of jurisprudence can be of a great help for the formation and orientation of the debate.2. The philosophy of fiqh is a second order philosophy and one of main sources of controversy in its limits and the way it should be explained. This controversy results from the limitations in these sciences in general.3. Eight definitions are presented for the philosophy of jurisprudence and taking the views of each theorist into account, the merits, and flaws of each definition is spelt out.4. The relation between the philosophy of jurisprudence and other homogeneous disciplines such as theology, rejal, derayah and particularly usul-e-fiqh is discussed and it’s examined that whether there is any overlapping between them.     The essay deals with examining the crucial questions with regard to the relation of jurisprudence and expediency. After a brief explanation of some key terms and introduction of the subject, the author presents the background and the application of expediency in Shiite fiqh and usul. The essay consists of three sections as under:In the first section, expediency is considered as the base of legislation by God and his prophet. In the second section, expediency is dealt with as an instrument for the determination and inference of general legal (Shariah) rules. In the same section the case of masa’lih – e-morsalh, a popular principle in Sunni usul has been pointed out. In the third section, expediency has been reviewed as the base of state rulings and an instrument in management of society. The main concern in this section is “how can one employ this instrument and in the same time be adherent to the religious and fiqhi principles in social administration.

    The guiding tools for understanding the Holey Quran refer to a set of axioms that without taking them and their implications into consideration, a true and authentic understanding of the holy revealed text is not feasible. The author believes that these guiding institutions are among the most important chapters of the theological foundations and the philosophy of Exegesis. The revelation, guiding-orientation, rationality, the natural characteristic of its teachings, and the maturity of the language applied in the holy Quran are among the essentials of understanding the Divine Book. Principles such as the comprehensiveness, internal coherence, external order, and the systematic interconnectedness and interactions of the Divine words with the speeches and acts of innocent imams are inferable from the above institutions.In continuation of the related issues published in the previous edition of the Journal, the essay deals with explaining two more institutions.

    This article examines the role tolerance in jurisprudential and legal codes. In the first section, we will discuss the evidences proving the law of tolerance. To this end, the evidences have been extracted from the holy text, the tradition, the reason, and the manner adopted by wise people. In the second section, reviewing and analyzing a number of Islamic (legal-social) codes the author explores the place of tolerance in introduction and application of these codes by almighty God and his prophet.In the third section, she points out the documents attributed to jurists with regard to inference of religious rules concluding that the social-legal-jurisprudential rules are all set out to lead human being towards a real prosperity.

    According to Islamic teachings, Shariah is constant for everywhere and every time, but the related social relations are always subject to changes. Thus, in such a situation, how one can claim that Shariah is constant. This article, first, examines the legislative mechanism of Shariah rules in real terms and states that they are constant in terms of their titles. The rules are legislated on the base of these titles and wherever and whenever there is relevance the rule stands true for that title. Hence, there is no contraindication between the development of relations and the constancy of Shariah. These titles include both the primary and secondary rules. By this analysis, it is clarified that there is nothing as the ‘state ruling’ in Islam. The jurisprudent guardian (the Islamic ruler) does not make a new rule. His job is to identify the relations between the title and the relevant rule.Same is the case with the social and macro relations. However, sometimes, there are conflicts between the rules of the macro and social relations on the one hand, and the rules of the individual on the other. The solution to this problem is the method of the traditional jurisprudence. The jurisprudent guardian or the Islamic ruler identifies the titles of social and macro relations with the help of his advisory wing, the expediency council.

    The innocent leaders (peace be upon them) posses the merit to explain religion, to govern and to judge. If their speeches or their acts are representing their personal authority to explain religion then the rule inferred from this is a constant rule. If it is representing other authorities then the inferred rule is positional and variable. However, it may suggest a constant rule too. The question that arises is that when one is not sure about any of the above two cases then what is the job here. There are four views in this regard:1. The denial of primary principle when all other views are rejected;2. The primary principle of change, the supporting evidences is “isalatulbraah” and “istishab”;3. The primary principle of constancy;4. Discriminating between the cases and the subjects, in such a way that in certain cases it denies the primary principle and in some other cases it proves that.The author believes that the primary principle is correct and the most rational interpretation returns to the acceptance of the primary principle of constancy.

    Since long time, the inclusion of all issues and aspects of human life has been the focus of concerns and controversies among theoreticians. In addition to this, what has doubled the urgency of need for discussing this are – though not so moderate-, views expressed in this regard; particularly, when this mere technical and scientific debate gets a political form and style resulting in a baseless non-academic ideas.The author, in this article, has attempted to carry out a neutral discussion taking the Holy Quran, Islamic traditions, and human wisdom into consideration. He concentrates on “the explanation of the scope of Shariah and the role of common tradition” in this regard and points out the following four perspectives:Inclusion, isolation, ambiguity, and moderation. According to the first perspective, there is a rule for any movement or quiescence in the Islamic universal and eternal Shariah. Contrary to this, the isolation perspective emphasizes on the neutrality of Islam’s legislator with regard to the worldly affairs of human being. The third perspective emphasizes that the macro principles are specified by The Supreme legislator without interfering in the micro level of structure and affairs. The fourth perspective has chosen a moderate way emphasizing on the classification of Shariah law into rational and traditional categories and rejecting any area free of revealed rule as well as the classification of religious rules into legal (sharei) and rational categories.

    Given the comprehensiveness and the perfection of the Islamic Shariah, some questions are raised with regard to the fiqhi philosophy of a religious state including the question about the constancy and variability of the religious issues, the Shariah developments, and its consistency with the demands of the time.The essay deals with a number of critical questions including the followings:Are there constant and variable rules in Islam? If the answer is positive, then the question that arises is that when people do not have access to the innocent imam, are the jurists authorized to determine the constant and the variable rules? Assuming that such authority has been transferred to the jurists then what are the criteria at the disposal of the guardian jurisprudent to make decisions in this relation while taking the circumstances into consideration?Should the official rulings of the jurisprudent guardian -based on expediency- be given priority over the primary Islamic rules?Taking the above questions and the central role of expediency in Islam and in Shariah developments into account, this essay attempts to review different views including imam Khomeini’s and also ayatollah Sadr’s view, which is known as the discretionary area (mantaqat ulfaragh) of the Islamic jurisprudence.
