    استقلال و بی طرفی در دادرسی عموما به عنوان یک اصل به کار می رود و این دو عبارت تا حد زیادی با یکدیگر هم پوشانی دارند. با این حال، این دو اصطلاح مفهوم یکسانی ندارند. استقلال در دادرسی های بین المللی به معنای عدم تابعیت و عدم تاثیرپذیری دادگاه و دادرسی از فشارها و عوامل خارجی از جمله دولت ها، سازمان های بین المللی و افراد قدرتمند است. این مفهوم در نظام داخلی از نظریه تفکیک قوای مونتسکیو ناشی می شود و حاکی از عدم اعمال نفوذ قوه مجریه بر قوه قضاییه است. اما بی طرفی به معنای عدم جانبداری و عدم پیش داوری به نفع یکی از طرفین دادرسی است و اصولا استقلال یکی از عوامل تامین کننده بی طرفی می باشد. در مراجع کیفری بین المللی نیز این اصل همواره به عنوان یکی از اصول مهم دادرسی شناخته می شود و تلاش این دادگاه ها، چه در اساسنامه و چه در رویه های قضایی، این بوده است که به منظور مشروعیت بخشیدن به دادرسی ها و تشکیلات مراجع، تا حد ممکن اجرای این اصول را تضمین نمایند. مطالعه رویه های دادگاه های کیفری بین المللی معیار خوبی برای شناسایی موارد نقض استقلال و بی طرفی به دست می دهد؛ که همان تشخیص نقض از دید «ناظر متعارف کاملا آگاه» و تاثیر فاحش آن بر حق متهم بر دادرسی عادلانه است. همچنین در دادرسی ها عموما اصل بر بی طرفی و استقلال است و افرادی که خلاف آن را ادعا می کنند، می بایست دلایلی قوی برای اثبات ادعای خود ارائه نمایند.

    دعاوی ناشی از جرم در دو دسته دعوای عمومی و خصوصی قرار می گیرند. یکی از مهم ترین موضوعات در این دعاوی، تعیین و شناسایی طرفین آن است. دعوای عمومی توسط دادستان اقامه می شود، اما در دعوای خصوصی، تعیین افراد ذینفع همواره ساده نیست.
    مساله اصلی این پژوهش آن است که با توجه به حاکمیت قواعد و احکام دادرسی مدنی بر دعوای خصوصی ناشی از جرم، چه کسانی غیر از مجنی علیه حق اقامه این دعوا را دارند. آیا غیر از اشخاص حقیقی، اشخاص حقوقی نیز می توانند دعوای خصوصی را نزد محاکم کیفری اقامه نمایند یا خیر؟
    بررسی ها حاکی از آن است که در نظام حقوقی بیشتر کشورها از جمله فرانسه، علاوه بر مجنی علیه، اشخاص دیگری نیز حق طرح دعوای خصوصی را دارند. این دعوا می تواند به طور ارادی یا قهری قابل انتقال باشد، به گونه ای که امکان اقامه دعوا توسط جانشینان اعم از ورثه، بیمه گر و منتقل الیه وجود داشته باشد.
    نتایج نشان داد که در مقررات ایران در این حوزه، علاوه بر پراکندگی و عدم انسجام قوانین، در برخی موارد با خلا قانونی مواجه هستیم. پیشنهاد می گردد تا با نگاهی به قوانین کشورهای دیگر، قوانین این حوزه انسجام یابند و مقرره هایی در خصوص ارتقای حمایت از مدعیان دعوای خصوصی ناشی از جرم تصویب شود، زیرا وجود قوانین متعدد در کنار رویه های قضایی متفاوت به پیچیدگی مسائل مربوط به دعوای خصوصی دامن زده است.
    این نوشتار با توجه به مطالعه قوانین ایران و فرانسه سعی در پاسخ به مسائل پیش رو در این زمینه دارد. بر این اساس، پرداختن به موضوع در قالب اثر پژوهشی مستقل ضروری بوده است.

    برای تضمین عادلانه و منصفانه بودن دادرسی نسبت به انسانی که به اتهام ارتکاب جرم به چرخه قضایی وارد شده، حقوق دفاعی خاصی مورد شناسایی قرار گرفته است که می توان آنها را حقوق دادرسانه بشر نامید. از جمله این حقوق، حق بی پاسخی یا حق سکوت متهم در برابر پرسش گری مقام ذی صلاح است. در رابطه با حدود و ثغور اعمال این حق، دغدغه هایی مطرح بوده و پذیرش مطلق آن مورد انتقاد برخی قرار گرفته است که بازتاب این نگرانی ها را می توان در قوانین آیین دادرسی کیفری 1378 و 1392 نیز مشاهده نمود. در مقاله حاضر، ضمن تبیین مفاهیم، گونه ها و واکاوی کرامت مدار مبانی اعتبار بخش این حق، خط مشی پایان هوشمندانه سکوت، به منظور پایان بخشی هوشمند و مدیریت شده بی پاسخی متهم از طریق راهبردهایی برمبنای توجیه سکوت، ادله پرونده، سابقه متهم، بزه دیده و تشویق ارائه شده است.

    شیوه های جبران خسارت باید با ضرر واردشده هماهنگ و متناسب باشد تا به نحوی عادلانه، تعادلی که در نتیجه ورود زیان در رابطه طرفین بر هم خورده است، مجددا برقرار شود. این هدف با محدود کردن شیوه های جبران خسارت تامین نمی شود و مقتضی انعطاف نظام حقوقی و از جمله اعطای صلاحیت به دادرس جهت تعیین طریقه و کیفیت جبران خسارت است. یکی از این شیوه ها، حکم به التزام و اجرای مفاد قرارداد باطل است که با بررسی مبانی فقهی- حقوقی و نیز مصادیق آن، فهمیده می شود که چنانچه این شیوه به درستی و در موضع مناسب خود مورد استفاده قرار گیرد، از جمله شیوه های جبران خسارت است که هم با ضرر واردشده متناسب است و هم به بهترین صورت خسارت را جبران می کند. در این مقاله مبانی این روش جبران خسارت موشکافی، مصادیق مهم آن ارائه و النهایه، حکم به الزام به قرارداد باطل به عنوان روش جبران خسارت، قاعده سازی شده است

    در اثر پیشرفت های چشمگیر علم پزشکی، استفاده از درمان های کمکی برای غلبه بر مشکل نازایی، رو به افزایش است. یکی از روش های نوین درمان ناباروری، استفاده از رحم جایگزین می باشد. این امکان، زمانی ضرورت می یابد که زوجین همه عوامل دخیل در باروری را دارند، ولی به دلیل فقدان رحم سالم از داشتن فرزند محروم می باشند. این پدیده نوظهور، همانند دیگر دستاوردهای علمی، دارای ابعاد فقهی و حقوقی گسترده ای است که خود نیازمند توجه و تدقیق می باشد. ابهام در ماهیت قرارداد رحم جایگزین جزء چالش هایی است که همواره نظر صاحبان اندیشه را به خود جلب نموده است. از این رو با تطبیق ماهیت این قرارداد با عقود معینی که دارای ساختار مشابهی با قرارداد مذکور هستند، مشخص شد که قرارداد رحم جایگزین، از مجموعه ای تعهدات تشکیل یافته است؛ به طوری که کلیه این تعهدات را نمی توان ناشی از یک عقد دانست. لذا این قرارداد را باید با بهره گیری از اصل حاکمیت اراده و آزادی قراردادها، در زمره عقود نامعین و ماده 10 قانون مدنی به شمار آورد.

    عاملیت تجاری (فاکتورینگ) به عنوان یکی از شیوه های تامین مالی، به طور معمول ، فرآیند تسریع دریافت وجوه حاصل از بدهی های کوتاه مدت است. طی این مکانیسم، عرضه کننده کالا و یا خدمات مطالبات صورتحساب های قابل وصول خود را با تنزیل (تخفیف) به یک موسسه عاملیت می فروشد. در حالی که در اغلب کشورها، عمل واگذاری مطالبات است که مبنای قانونی عملیات عاملی را تشکیل می دهد، لیکن شیوه هایی که این واگذاری طی آنها انجام می گیرد و همچنین قوانین و مقررات حاکم بر جنبه های مختلف آنها، به نحو قابل توجهی متنوع و متمایزند. به هدف رفع این گونه بلاتکلیفی ها و نیز برای تسهیل و ترویج معاملات بین المللی، موسسه یونیدروا (Unidroit)[1]، کنوانسیون یکسان سازی قواعد عاملیت تجاری بین المللی موسوم به «کنوانسیون اتاوا» را به تصویب رساند، نوآوری و ابداع این کنوانسیون در اعطای اختیار گزینش و انجام حداقل دو مورد از عملیات معمول فاکتورینگ به عامل، باعث شده در مواردی ماهیت حقوقی عاملیت بین المللی از قالب سنتی انتقال طلب خارج شود.

    متناظر با تاکید بر تقویت راهکارهای تامین استقلال قضات و افزایش درخواست ها برای کسب استقلال نهادی دستگاه قضایی از قوه مجریه، بر ضرورت و اهمیت پاسخگویی قضایی (اعم از قضات و نهاد قضایی) در انجام وظایف محوله و مدیریت امور قضایی تاکید شده است.
    پاسخگویی قوه قضاییه به عنوان یک نهاد، ناظر بر بدنه مدیریتی این قوه و مربوط به عملکرد مدیران قوه مزبور در اداره آن و اجرای قوانین و مقررات مربوط است. قوه قضاییه در اینجا به مثابه سازمانی نگریسته می شود که با برخورداری از بخشی از منابع مادی و انسانی کشور، همانند سایر سازمان ها، موسسات و نهادهای دولتی مسئولیت ارائه خدمات عمومی مشخصی را بر عهده داشته و بدین طریق بخشی از مسئولیت های دولت را ایفا می کند. با وجود این، حساسیت کارکردی دستگاه قضایی و به ویژه لزوم تامین استقلال قضایی، دیدگاه ها را بر سازوکارهای پاسخگویی دستگاه قضایی متمرکز نموده است تا بدین طریق، ضمن حفظ استقلال قضایی، پاسخگویی نیز حاصل شود. در این مقاله، ضمن تبیین مفهومی استقلال و پاسخگویی قضایی و سازوکارهای پاسخگویی نهاد قضایی در حقوق تطبیقی، به بررسی وضعیت استقلال و پاسخگویی قوه قضاییه در نظام حقوقی ایران خواهیم پرداخت.

    Independence and impartiality of the proceedings generally used as a principle and largely overlap together. However, this two terms don’t have the same meaning.Independence in international proceedings means lack of subordination to and freedom of influence of courts and proceedings from external pressures and factors, including States, international organizations, powerful persons and etc. This concept in internal system emerges from seperation of powers Montesquieu´s theory and implies that the executive can´t influence on judiciary. But, impartiality measns lack of bias and lack of prejudice in favour of one party of the proceedings and, independence is one of the factors that supply impartiality. This principle in the international criminal courts has always been known as one of the most important principles of justice and theses courts tried, whether in their statutes and their jurisprudence, in order to legitimacy of proceedings and structures, as much as possible ensure implementation of these principles. Studying Procedures of international criminal courts including international tribunal for Rowanda, international criminal tribunal for the former Yugoslavia, special court for Sierra leone and international criminal court gives a good criterion for identifying violations of the independence and impartiality that is the detection of violations in view of “reasonable observer, properly informed” and the gross effect on the accused´s right to a fair trial. Also in proceedings, in general, independence and impartiality are principle and those who claim contrary to it, should provide strong reasons to prove it.

    The litigations resulting from a crime may be categorized in two categories of private and public suits. One of the most significant issues in such suits is the recognition of parties to them. A public suit is lodged by the public prosecutor against a defendant. The private suit is, however, made by persons whose beneficiary status may not be determined as simply as expected.
    The main issue of this paper is to recognize the persons along with the victim to have the right to lodge a case in line with the observance of civil procedure rules and regulations.
    May legal entities other than real entities, lodge a private suit before criminal courts? In addition, which damages mentioned under the 2014 Criminal Procedure Code may be claimed by such persons?
    In the legal system of the most countries like, France, in addition to victim, the others can suit a private case. This Suit can transform voluntarily or forcibly. Then, successors such as heirs, insurer and transferee and those who have been hurt directly from crime can suit this case.
    Studies show that the regulations of Iran in this area suffer from scattering, incoherence and legal vacuum. In this regard, it is suggested that in view of the other countrie's law and regulations, the regulations in this area would been consistent and some rules approved about promoting the protection of claimants in private suit resulting from crime; because various rules and laws governing such suits, along with conflicting precedents have led to some implications on the issues of the private suit resulting from a crime under the Iranian legal system, made judges confused.

    Some special defending rights have been recognized to make certain that trial process would be fair for someone who has been entered judicial cycle because of accusation of a crime. These can be called "human justice rights". Included in is not to be respondent or right to silence when asked by a judge that in practice there are some worries about the degree to which an accused can benefit from his/her right and widespread criticism of the government’s absolute acceptance of this right. Somehow, this worry has been reflected in criminal procedure and new Criminal Procedure Act. In this article, we tried to explain not only concepts, types and accreditation basis, but also attitude to this right in international documents as well as in internal laws. Also included in are "wise discontinuation of silence" mechanisms so as to terminate silence through mechanisms like attention to criminal past history, to logical reasons of silence, to evidence, to victims as well as to encouragement.

    Compensation methods should be coordinated with losses, so that the balance lost as a result of the breach of the contract can be restored. This purpose could not be reached by limiting the methods of compensation. There must be a wide range of compensation methods available to judge to choose the most appropriate one from them. One of the most effective compensation methods is to order the execution of the void contract. It can be understood from analysis of different aspects of this topic that this method, if properly used, can repair the loss in one hand and is proportionate to the harm in another hand. In this paper, this method of compensation is deeply scrutinized; important examples of it are provided and finally it is regulated as an efficient way of compensation.

    The use of adjuvant therapies for overcoming infertility has increased as the result of prominent scientific advances in medical sphere. A new method to treating infertility is surrogacy. It's necessary, when the couple has all factors that affect fertility, but due to the lack of a healthy uterus, they are deprived of having children. But this new-emerging phenomenon, like other scientific achievements, has broad religious and legal dimensions which will be required attention and clarification. Confusion in the nature of the surrogacy, are some of challenges that always have attracted thinkers. Hence, by adapting the nature of this contract to certain contracts that have a similar structure, it was clear that surrogacy contract is formed by a set of obligations, so that all the obligations cannot be raised from a contract. This contract should be included in indefinite contracts and Article 10 of the Civil Code by utilizing principles of sovereignty of the will and freedom of contracts.

    Factoring is a method of financing which typically accelerates the process of receiving funds for short-term claims. Within this mechanism the supplier of goods or services on credit terms may sell its claims to a factor at a discounted price. while in most countries it is the assignment of receivables that provides the underlying legal basis for factoring transactions, the procedures whereby such assignments are effected and the rules which govern the different aspects of them differ considerably, , to reduce such uncertainties and to promote international trade, the UNIDROIT adopted the Convention on International Factoring (“Ottawa Convention”). As a result of its innovation in giving choice to the factor in performing at least two out of the four common factoring functions, (unlike the traditional factoring), the legal nature of international factoring transactions governed by this convention, is not always limited to the institution of assignment of entitlements.

    Along with concentrating on enhancing Independence of judges and judiciary from executive power, Importance and necessity of judicial accountability (both judges and judiciary) have been concentrated in many studies.
    Accountability of judiciary as an institution is related to managerial level of this branch and performance of its authorities in administering of it and executing relevant laws. Here, Judiciary is seen as an organization has some of the state responsibilities. With attention to importance of maintaining judicial independence, mechanisms of judicial accountability have been concentrated. In this essay, we illustrate the concept of judicial independence and accountability, mechanisms of accountability of judiciary in comparative law and legal situation of judicial independence and accountability in Iran.
