    مهمترین ویژگی ارباب بصیرت و صاحبان خرد از نگاه وحی آن است که ایشان در عین انس با راز و نیاز، با تدبر و تفکر همسازند. هم اهل ذکرند و هم صاحب فکر؛ نه تنها قرآن باورند، که برهان محورند.
    بیان آیاتی چون «ان فی خلق السموات و الارض و اختلاف اللیل و النهار لآیات لاولی الالباب الذین یذکرون... و یتفکرون...» (آل عمران، 19) در عین تمجید این وصف، در مقام تبیین این مساله است که فاعلیت وحی در قابلیت عقلانی و به فعلیت رساندن قوای مستور بشری نقش اساسی و غیر قابل انکار دارد.
    به تعبیر قرآن، اهل اندیشه و برهان، آنگاه که به جمال خلقت با دیده عبرت می نگرند و از مرز محدودیت های عالم ماده می گذرند، از ارتباط و انسجام، همبستگی و پیوستگی، حساب و کتاب، نظام مندی و زیبایی قانونگذاری، مهرورزی میان موجودات و شهود خدمتگزاری، زنجیره به هم پیوسته مخلوقات و سیستم یک پارچه کاینات زبان عجز به وصفی شایسته و مدحی بایسته می گشایند، و از عمق جان اعتراف می نمایند که «ربنا ما خلقت هذا باطلا سبحانک فقنا عذاب النار»، و این همان مفهوم «تفکر ساعه افضل من عباده سنه» (مجلسی، 1403 ه‍، ج 71، ص 326) و نیز «التفکر حیاه قلب البصیر» (همو، ج 78، ص 115) است.

    private claim is a means of the realization of corporative criminal policy so as to involve citizens both victims and offenders – in a reaction to crime. Considering bilaterally, it grants the policy prefection as well as it establishes the ideals of the restorative justice by way of restricting the interference of the penal system and by changing the relevant factors into civil ones.In traditional criminal law a public prosecutor’s claim implies direct interference by the state in a reaction to a criminal action in cases where the public interest and common rights as well as the public order are violated as a consequence of a criminal act.In contrast to this, what the criminal policy, based on Islamic jurisprudence, takes additionally into consideration is the rights of citizens – those of both victims and offenders – that are threatened by the fact that the citizens’ rights are unequal due to their unequal positions vis – a – vis each other.In confirming the citizen’s corporative rights, the state holds the right to claim and penal reaction to crime by way of converting private claims on to public ones. This is because the citizens’ unequal positions annuls the core concept of corporation, which is the satisfaction of the mind, when it is applied as a reaction to crime, and can consequently pave the way for umcompensatable harm and increasing violation of the individual’s rights and freedoms.A claim of a juvenile homicide committed by the father is an example of such claims where the position of the child is naturally, customarily and characteristically unequal with that of the father and where the state controls the function of active corporation of citizens by putting itself into focus in treating the claim.

    aws relating to minors’ transactions emanate from contract laws. On the other hand, the issue has recently been taken up in discussions on laws in light of the common law. In consideration of this, it is necessary to examine the issue of the minor’s transactions, their validity in view of the common law along with other factors relevant to it; amendments are needed on some civil law articles regarding partly physical maturity and growth and partly the age of the former – notwithstanding the role of the two in the minor’s financial authority. This is because there exists discordance in the viewpoints based on Islamic jurisprudence and the common law - not to mention the ensuing consequences of their own. Considering, in addition, the phenomenon of street children’s transactions, the importance of applying the jurisprudential laws seems more tangible making it incumbent upon us to submit practical results. The paper aims at presenting an extensive study of the issue by examining the various jurisprudential theories and viewpoints as well as the origin of the related laws. Having carried out such a study, it is obvious that considering physical growth as a factor in the minor’s transactions, irrespective of its being simultaneous with physical maturity or not, requires further study.

    ith the drawing up of a contract, the attorney and client acquire rights and duties toward each other and accordingly the legal relationship between the two parties is established. Obviously, the legal limitation of these obligations is efficient in the prevention of the probable disputes of the parties.The attorney’s commitment towards the client directly or indirectly results from the contract. It is also possible that it originates from the agreement of the attorney and the client in the form of conditions and agreements at the time of making the contract, or by way of an autonomously agreed term. The fulfillment of the commitments is necessary in each case. The commitments that are directly brought about by the contract result from the nature of the contract itself. Then, only the fulfillment of the contract without any need of clarification is liable on the attorney.In the present paper, this group of obligations is called the ‘principal’ commitment of the attorney towards the client in comparison with the ‘secondary’ or ‘subordinate’ ones. The general application of the terms ‘secondary’ or ‘subordinate’ for these obligations is for the reason that they have come into existence when the primary, i.e. principal commitments are not performed, such as the commitment of the attorney to compensate for the losses of the client, in supposition of the lack of observance to the latter’s interest, which is one of the main obligations of the attorney. The attorney’s responsibility, in the case of non-fulfillment of the above-mentioned obligations, will be discussed in a separate paper.Owing to the importance of illustrating the main obligations of the attorney vis-à-vis the client, this paper aims at carrying out a correlational study of the subject from different points of view in the Iranian law as well as the laws of countries such as Egypt and England.

    he lack of physical, intellectual and psychological growth of children substantially increases his/her vulnerability to injury. Thus, special methods of support have been foreseen for their protection in religious teachings, educational institutions, legal systems, international rights as well as the rules and regulations of countries. The protection of children’s corporeal and incorporeal rights foremost requires the recognition of their applicability. Children’s incorporeal rights are rights that in a way concern their identity and the development of their psychological and mental personality. The right to nationality, genealogical rights and the right to education and training are some of a child’s incorporeal rights. Recognizing these rights in the realm of Islam’s teachings on training and law, the writer considers the encroachment and infringement of children’s incorporeal rights as the source of worldly and heavenly as well as moral, civil and penal responsibilities. Drawing upon the principle of there shall be no loss or injury in Islam, the writer eventually gives the theory of indemnity for non-physical detriment upon children.

    rticle 319 of the Islamic criminal code of Iran, which has been based upon Islamic divine law, says: “Whenever a physician, although skillful and proficient in his treatments which are personally done or orders them to be done even with the permission of the patient or his parents, causes the death or disability or financial damages, will be liable.”But in paragraph 2 of Article 59 of the above-mentioned law it has been required that: “In any type of surgery or medical treatment, the permission of which has been given by the patient or his parents or guardians or any of their legal representatives, is not considered to be a criminal act, and in urgent circumstances obtaining consent is not necessary.”And in Article 60 it immediately adds the principle of exemption: “If a physician acquires permission before beginning treatment or surgery from the patient or his parent or guardian or the owner of the animal, he will not be legally liable for physical disabilities or financial damages and in emergency cases where obtaining permission is not possible nor will he be responsible for damages incurred. In this research all aspects of a physician’s responsibilities in relation to the patient are discussed drawing on great jurisprudents’ opinions as well as references in jurisprudence and law.

    ommitting acts discordant to the criminal law, children and juveniles are detained and put in close contact with the disciplinary and judiciary authorities. For this reason, special criminal proceedings have great importance on achieving the eminent aim of reform and prevention of committing such criminal acts.The procedure of trial for children and juveniles is different from an adult’s tribunal in many aspects. For instance, those policemen and judges who exclusively and mostly conduct children’s trials should be completely acquainted, through educational courses specially established for them, with different sciences such as child psychology, social aid and criminology. The trial must be held behind closed doors, and the child must be respected as a person. It is necessary to provide a personality dossier containing statements from various specialists in the fields of medical sciences, psychology, social aid and criminology, beside a criminal dossier in order to give an appropriate image of the child or juvenile’s character and behavior for the courts.In the present article, the fundamental principles of special criminal proceedings for children are examined both in the common and international laws, comparing them with the established Iranian penal code. The recently proposed motion for a law on special courts for children and juveniles is also discussed. On the condition of a final ratification this motion will be a significant step toward the promotion of special proceedings for children. Apparently, the notion of special criminal proceedings for children presented in the common law is not inconsistent with the Islamic law. There is neither prohibition nor prevention in the authentic Islamic jurisprudence for applying this way of trial.
