    نظام حقوقی منع گسترش سلاح های هسته ای، در قبال تعهد دولت های عضو به همکاری با آژانس بین المللی انرژی اتمی، تعهد آژانس به تضمین حفاظت کامل از اطلاعات هسته ای را مقرر می کند. اجرای تعهدات دوجانبه لازم می دارد که هریک از طرفین به تعهداتش پایبند باشد. اما اشتیاق آژانس، بیشتر به تدوین تعهدات جدید، دریافت اطلاعات بیشتر و اعمال نظارت گسترده تر بر برنامه هسته ای ایران بوده است تا توجه به حق ایران به محفوظ ماندن اطلاعات هسته ای اش. بدین سبب، در سال های اخیر، اجرای تعهد مذکور با چالش های گوناگون همراه بوده و به رغم برخی پیشرفت ها، نگرانی ایران از اجرای مقتضی تعهد آژانس رفع نشده است. کوتاهی یا نقض تعهد آژانس در حفاظت از اطلاعات محرمانه، علاوه بر آنکه به اعتبار سازوکار راستی آزمایی منع گسترش سلاح های هسته ای، خدشه وارد می کند، زمینه پیدایش مسئولیت بین المللی آن و همچنین حق ایران به اتخاذ تدابیر حمایتی را فراهم می کند.

    پس از استفاده از سلاح های حاوی اورانیوم ضیعف شده در یوگسلاوی و به خصوص عراق، گزارشهایی راجع به افزایش بیماری هایی نظیر برخی انواع سرطان و ناهنجاری های مادرزادی در این مناطق منتشر شد که نگرانی هایی را در مورد آثار سوء این نوع سلاح ها بر سلامت انسان پدید آورد. اگرچه تحقیقاتی که پس از آن در این زمینه صورت گرفته، وجود رابطه ای قطعی بین سلاح های اورانیوم ضعیف شده و بیماری های فوق را مشخص نکرده است، تردیدها در این زمینه همچنان باقی است. این مقاله در صدد است تا در پرتو اصول حقوق بشردوستانه و آرای نهادهای بین المللی به این پرسش پاسخ دهد که در صورت اثبات چنین آثاری، وضعیت حقوقی این سلاح ها از نقطه نظر حقوق بشردوستانه چیست و آیا میتوان آن ها را در درگیری های مسلحانه به کار برد یا خیر.

    مسئولیت دولت های ثالث ناشی از نقض حقوق بشردوستانه در مخاصمات داخلی در واقع، بخشی از یک قاعده کلی تر تحت عنوان مسئولیت ناشی از کمک، مساعدت یا معاونت در نقض حقوق بین الملل است که سابقه زیادی در حقوق بین الملل ندارد و تنها از جنگ جهانی دوم است که چنین قاعده ای مطرح شده است.
    اصولا دولت ها در روابط بین المللی خود آزاد هستند که در چارچوب مقررات و موازین حقوق بین الملل به مبادلات اقتصادی، نظامی، فرهنگی و غیره با یکدیگر بپردازند و به یکدیگر برای مقاصد مختلف کمک نمایند. در جریان این مبادلات و کمک ها، دولت های دریافت کننده کمک، بعضا مرتکب اقداماتی در جهت نقض تعهدات بین المللی مانند نقض حقوق بشر و حقوق بشردوستانه می شوند. دولت ها و اشخاص صدمه دیده از این اقدامات، با استناد به قاعده مسئولیت ناشی از کمک و مساعدت یا به عبارتی معاونت در نقض حقوق بین الملل، دولت های اعطا کننده کمک را، به علت تسهیل اعمال متخلفانه دولت دریافت کننده کمک، مسئول قلمداد می کنند.
    بدیهی است این مقاله، مسئولیت ناشی از کمک و مساعدت یا معاونت در نقض حقوق بین الملل بشردوستانه را با نگاهی به مخاصمه داخلی سوریه، مطالعه می کند. این مسئولیت، برای دولت های ثالث به دلیل نقش داشتن در نقض حقوق بین الملل بشردوستانه نه در قلمرو سرزمینی خود بلکه در قلمرو تحت صلاحیت دولت درگیر در یک مخاصمه داخلی رخ می دهد. بدین ترتیب ضمن نگاهی به ریشه و مبنای این قاعده در اسناد بین المللی و رویه محاکم قضایی بین المللی، به بررسی چگونگی تحقق این نوع مسئولیت در چارچوب معیارهای مطرح شده از سوی محاکم بین المللی پرداخته و نشان داده خواهد شد که قابلیت انتساب نقض حقوق بشردوستانه در مخاصمات داخلی از جمله مخاصمه سوریه به دولت های کمک کننده و حامی در پرتو تبعیت از معیار «کنترل کلی» به مراتب آسان تر و البته مناسب تر خواهد بود.

    بانک ها از جمله تاثیر گذارترین تجار در عرصه اقتصادی کشورها هستند که به نحوی ابزار حکومت ها در اجرای سیاست های پولی و مالی نیز به شمار می روند. سیاست بازار آزاد، عرصه را برای حضور بانک ها در خارج از قلمرو محل تاسیس فراهم نموده است. رشد و توسعه بانک های چندملیتی در سده اخیر، مسائل نوظهوری را به همراه داشته و یکی از مهم ترین معضلات این بانک ها توقف و ورشکستگی است که مطالعه علل و چگونگی برخورد با آن، مورد توجه کشورها و محافل علمی قرار گرفته است. قوانین اکثر کشورها در این رابطه ساکت بوده و به همین دلیل هنگام بروز بحران های بانکی جهانی مسائلی پدید می آید که در صورت عدم وضع قواعد خاص در این رابطه، بحران های مالی بین المللی پیش خواهد آمد. شناخت اصل سرزمینی و جهانی، اصل وحدت و مجزا بودن شخصیت حقوقی و اصل رفتار یکسان با بستانکاران می تواند در کشف قواعد ماهوی و حل تعارض ورشکستگی بانک های چند ملیتی کارساز باشد. مطالعه اسناد و مقررات بین المللی در این زمینه، راهکارهای مطلوبی را جهت معاضدت و همکاری بین المللی کشورها ارائه می دهد که با تمسک بدان می توان از بحران های مالی بین المللی و داخلی جلوگیری کرد.

    مقررات حقوق بین الملل در زمینه تفسیر معاهدات در مواد 31 تا 33 کنوانسیون 1969 وین در خصوص حقوق معاهدات آمده است. این مقررات مستمرا توسط محاکم بین المللی اعمال شده است. اما آنچه وضعیت دیوان اروپایی حقوق بشر را از سایر محاکم بین المللی متمایز می سازد، استفاده مکرر این نهاد از چهار قاعده تفسیری خاص یعنی قاعده تفسیر پویا، قاعده معنای مستقل، قاعده تفسیر موثر و قاعده حاشیه صلاحدید دولت است. در این مقاله هریک از این چهار قاعده به تفکیک در رویه قضایی دیوان اروپایی حقوق بشر مورد مطالعه و بررسی قرار می گیرد.

    توسعه پایدار، مفهومی است که نزدیک به سه دهه پیش، کمیسیون برونتلند آن را طرح کرد و اکنون در حوزه های مختلف حقوق بین الملل رسوخ نموده است. توسعه پایدار با ابعاد سه گانه خود یعنی توسعه اقتصادی، توسعه اجتماعی و توسعه زیست محیطی، حقوق بین الملل انرژی را نیز به تدریج تحت تاثیر قرار داده است. در بستر این تحولات، مفهوم انرژی پایدار مطرح شده که عمدتا محل چالش توسعه اقتصادی و رعایت ملاحظات زیست محیطی است. جامعه بین المللی در تضمین دست یابی به توسعه پایدار در حوزه انرژی با چالش اساسی افزایش میزان دسترسی به انرژی های کارآمد و تجدید پذیر مواجه است؛ چالشی که حقوق بین الملل انرژی، علی رغم توسعه های مطلوب، تابه حال نتوانسته آن را حل نماید. شرایط پیش رو همگی موید این است که استفاده از انرژی های پاک و تجدید پذیر به جای سوخت های فسیلی می تواند در آینده، مفهوم انرژی پایدار را محقق سازد. دست یابی به این هدف، مستلزم اتخاذ برخی اصول راهبردی و ترسیم الگوی واحد توسعه در حوزه انرژی است که بعضی نهادهای بین المللی، آن را به صورت طرح جامع ارائه کرده اند.

    بی شک، افزایش دمای کره زمین، پایه های اصلی حیات بشری را به ویژه در کشورهای درحال توسعه در معرض خطر قرار خواهد داد؛ آسیب پذیری در برابر فقر و محرومیت اجتماعی را تشدید نموده و امنیت بشری را به مخاطره می اندازد. این تغییرات، همچنین بستر وقوع مخاصمات را بیش از پیش فراهم خواهد ساخت. بالا آمدن سطح دریاها و وقوع توفان ها و سیل ها در آینده نه چندان دور، شهرها و مناطق صنعتی را که در طول سواحل چین، هند و ایالات متحده آمریکا قرار دارند تهدید خواهد کرد. ذوب یخ ها تامین آب در مناطق نزدیک به کوه های آند و هیمالیا را دشوارتر می نماید. با توجه به این چشم انداز، شورای امنیت به عنوان رکن حافظ صلح و امنیت بین المللی در 17 آوریل 2007 در نشست 5663 خود، اولین مذاکرات خود را در خصوص رابطه انرژی، امنیت و تغییرات جوی، به درخواست انگلستان آغاز نمود که در آن زمان ریاست شورا را بر عهده داشت. به نظر می رسد اقدام شورا در برگزاری این نشست، حاکی از ضرورت توجه به رابطه تغییرات جوی و امنیت بین المللی است. بنابراین، فرضیه مقاله حاضر، این است که مسئله تغییرات جوی با توجه به پیامدهایی که در سطح داخلی و بین المللی به دنبال دارد، تهدیدی علیه صلح و امنیت بین المللی تلقی می شود و علت تشتت آرا در شورای امنیت در خصوص طرح این مسئله، ناشی از انتقاداتی است که بر پیکره قدرت و سیاست در عرصه بین المللی وارد می شود.

    عفو، چشم پوشی مقامات کشور از اعمال گذشته تمامی یا گروه خاصی از افراد است که مجرم شناخته شده اند و اغلب مشروط به بازگشت آن ها به تبعیت از حاکمیت است. موافقان عفو معتقدند که اعطای عفو، نیاز جوامع در حال گذاری است که ره به سوی صلح و ثبات دارند. اما مخالفان برآنند که عفو موجب گسترش فرهنگ بی کیفری است و مغایر با قواعد حقوق بشری مندرج در کنوانسیون های مختلف است. آن ها در این راستا به آرای نهادهای داخلی و بین المللی استناد می کنند. تحولات اخیر موثر در کیفری شدن حقوق بین الملل و قوت گرفتن اصل صلاحیت جهانی باعث شده است تا مشروعیت عفو، مورد تردید قرار گیرد و تنها عفوهای مشروط از استقبال و پذیرش جامعه بین المللی برخوردار شوند. این نوشتار سعی دارد عمده ترین ابعاد حقوقی عفو را بررسی کند.

    از اوایل دهه هفتاد شمسی یکی از شیوه ها و سازوکار های حقوقی و قراردادی رایج جهت تامین مالی و جذب سرمایه گذاری به ویژه سرمایه گذاری خارجی، استفاده از قراردادهای بیع متقابل در بخش بالادستی صنعت نفت و گاز بوده است. علت این امر علاوه بر امکان جلب و جذب سرمایه گذاری، وجود الزامات و محدودیت های قانونی بوده است. بر این اساس، این مقاله ضمن بررسی جایگاه حقوقی و قراردادی قراردادهای مذکور، آن را با نوع دیگری از قراردادهای بالادستی صنعت نفت دنیا موسوم به قراردادهای مشارکت در تولید مقایسه می نماید تا ماهیت حقوقی و جایگاه این دو تاسیس قراردادی را علی رغم وجود الزامات قانونی و محدودیت های پیش گفته روشن نماید.

    پیش از تصویب معاهده تریپس به دلیل فقدان رویه ای واحد و الزام آور، کشورها در ایجاد نظام مالکیت فکری خود آزادی کامل داشتند. پس از تصویب تریپس در سال 1995 و ایجاد سازمان جهانی مالکیت فکری، کشورها ملزم شدند که حداقل استانداردهای حمایت از حقوق فکری مصرح در تریپس را رعایت کنند. یکی از مسائلی که همواره در تریپس مورد بحث واقع شده، اختراعات زیستی (گیاهی و جانوری) بوده است. بر اساس ماده 27 تریپس، کشورها درمورد حمایت یا عدم حمایت از این اختراعات و همچنین تعیین نوع نظام حمایتی برای آن ها آزادند، اما به دلیل اختلاف سطح علمی کشورها و این واقعیت که بیشتر این منابع در کشورهای درحال توسعه وجود دارد، اختلافات زیادی بین دو گروه کشورهای درحالتوسعه و توسعه یافته ایجاد شده است. مغایرت مفاد کنوانسیون تنوع زیستی با تریپس در این زمینه نیز بروز اختلافات را افزایش داده است. لذا دو گروه از کشورها برای اصلاح تریپس، پیشنهادهایی کردند. همچنین اگرچه در تریپس، نامی از دانش سنتی نیامده، اما همواره یکی از مسائل موردبحث در سازمان جهانی مالکیت فکری و خصوصا کمیته بین الدولی مالکیت فکری، منابع ژنتیکی، دانش سنتی و فولکلور بوده که حمایت از آن را افزایش داده است.

    از زمانی که روند تایید و تصدیق اسناد داخلی جهت ارائه به دوایر خارجی به عنوان یک مسئله مطرح شده است ضرورت بررسی الحاق ایران به «کنوانسیون 1961 لاهه راجع به ضرورت لغو تصدیق اسناد عمومی بیگانه» نیز مورد اهتمام جدی قرار گرفته است. شایان ذکر است که ضرورت وجودی کنوانسیون 1961 لاهه، ناشی از تمایل دولت ها به مختصر نمودن فرایند تایید از طریق لغو ضرورت تصدیق اسناد عمومی بیگانه توسط نمایندگی های دیپلماتیک و کنسولی بوده است. با الحاق به این کنوانسیون، ضرورت مراجعه به نمایندگی های دیپلماتیک و کنسولی خارجی در کشورها منتفی می شود. این امر می تواند خود منبعی درآمدزا برای مرجع یا مراجع صلاحیت دار داخلی صادر کننده «تاییدیه» و مانعی برای نمایندگی های خارجی جهت کسب درآمد از اتباع ایرانی باشد. این نوشتار ضمن تشریح مطرح شدن روند تایید و تصدیق اسناد داخلی جهت ارائه به دوایر خارجی به عنوان یک مسئله، ضرورت بررسی الحاق ایران به کنوانسیون مذکور را بررسی و در پایان، راهکارهایی را به منظور بسترسازی مناسب برای اجرای موثر آن ارایه می دهد.

    Legal regime of nuclear non-proliferation imposes upon the IAEA the obligation to ensure the full protection of confidential nuclear information offered by member states. Implementation of mutual obligations requires each party to adhere to its obligations, but the IAEA seemingly is willing to receive more information and broadly monitor Iranian nuclear activities, instead of giving due consideration to the latter's right to have its sensitive information secured. Therefore, recent years have seen daunting challenges, with Iran's concerns have not been sufficiently fulfilled. Violation of the obligation to ensure the full protection of confidential information together with prejudicing the credibility of the non-proliferation verification regime raises the IAEA's responsibility towards Iran and gives it the right to take self-help measures.

    After depleted uranium (DU) weapons were used in Yugoslavia and particularly in Iraq, reports about an increase in diseases such as some types of cancer and congenital anomalies in these regions raised concerns about the harmful effects of this class of weaponry on the human health. Although the studies conducted thenceforth have not found conclusive evidence as to the existence of a definitive correlation between depleted uranium and the mentioned diseases, doubts continue to persist. In light of the humanitarian law principles and opinions of international organizations, this article seeks to find out what the legal status of these weapons would be if the aforementioned effects were established and whether it would be possible to use them in armed conflicts.

    Third party states responsibility arising from violations of international humanitarian law in internal armed conflicts is in fact part of a more general principle dubbed as "liability arising out of aid and assistance in violation of International Law”, which has a little precedent in International Law proposed only after World War II. Basically, states are free in their international relations in the framework of the rules and standards of international law to have commercial, technical, military and cultural engagements and help each other for different purposes. During the trade and aid, recipient governments sometimes act in violation of international obligations including human rights and humanitarian law. Governments and entities affected by this action, citing the principle of responsibility to aid and assistance, or assistance in violation of international law, consider states who have granted aid to facilitate the wrongful acts of the recipient as responsible. Obviously, this paper, studies the general responsibilities of the aid and assistance or assistance in violation of international humanitarian law by looking upon the internal conflict in Syria. Third state party is responsible for its role in violations of international humanitarian law in the territory under the jurisdiction of the involved state in an internal conflict and not their own territory. The capability of attribution of the violation of international humanitarian law in internal conflicts such as the conflict in Syria to the assisting and supporting governments would be far easier and more convenient course in light of adherence to the criterion of “overall control”.

    Banks are the most influential players in the economic arena of the countries in a way that they become the governments’ instrument for implementation of the financial and monetary policies. The free market policy has opened up the market for activities of the bank beyond the place of establishment. The growth and expansion of the multinational banks in the past century have created new problems. One of the most important issues is the insolvency of such internationally active banks which requires an academic investigation to be carried out to unfold the reasons behind such bank failures. Laws of many countries have not dealt with such an eventuality and for this reason, at the time of international banking crises, the effects of bank insolvency spread throughout the world. The principles of separation or unity of the legal personalities of the banks and their subsidiaries and the principle of equal treatment among all creditors as a matter of conflict of laws related to the bank insolvency help to find out the most sensible substantive law in this field. International documents and regulations have provided a proper base for international cooperation among all the countries involved. This cooperation helps to avoid international and domestic financial crises.

    The rules of international law concerning the interpretation of treaties are laid down in Articles 31-33 of the 1969 Vienna Convention on the Law of Treaties. Those rules have been constantly applied by international tribunals, but what distinguishes the European Court of Human Rights from other tribunals is its emphasis on four specific rules of interpretation, namely, Dynamic Interpretation, Autonomous Concepts, Effective Interpretation and Margin of Appreciation. The present study examines these rules and their application in the case-law of the European Court of Human Rights.

    Sustainable development is a concept that has penetrated in various areas of international law since its introduction by Brountland Commission in 1970. This concept, has gradually affected international energy law in three dimensions (economic, social and environmental development). In light of this evolution, the concept of sustainable energy has been challenging the economic development and environmental considerations. International law in ensuring the achievement of sustainable energy has been faced with the challenge to increase energy efficiency and renewable energies. Despite the considerable developments of the international energy law, it has not been able to tackle this challenge. All scenarios ahead confirm that the use of clean and renewable energy instead of fossil fuels can establish the idea of sustainable energy in the future. Achieving this goal requires adopting some guidelines and stable patterns on energy area that in a comprehensive plan has been offered by a range of international institutions.

    Following the evolution in the concept of peace and security, UN Security Council has considered climate change as a threat against international peace and security since 2007 in its 5663 meetings. The consequences of the climate change will vary around the world. Some countries may encounter severe storms and floods resulted from melting of polar ice caps while others may face droughts. Increasing earth temperature which is one of the most important consequences of climate change endangers human security and life especially in the developing countries. It also exacerbates social and economic poverty and finally results in international and non-international conflicts. Also, there are some hot places in the world which are likely to be the main victims of these changes but the effects would threaten all nations. This article, explaining national and international consequences of climate change, tends to consider the relationship between these changes and international peace and security in light of different state observations in Security Council’s meetings.

    A sovereign act of forgiveness for past crimes is granted by a government to all persons (or certain groups of persons) who have been guilty of crime or delict and often conditioned upon their return to obedience. The goal of this paper is to examine main aspects of amnesty. From one side, advocates of amnesty believe that granting amnesty is a need of transitional societies going toward peace and stability while the opponents are on the idea that amnesty cases would expand the culture of impunity and violate the human rights norms in international instruments. To this end, they refer to the decisions adopted by the national and international bodies. Moreover, recent developments in criminalization of international law along with strengthening the universal jurisdiction principle have questioned the legality of amnesty so that the international community only tends to accept the conditioned amnesties.

    For almost twenty years, Buy-Back Contracts have been regarded as one of the most legal and contractual mechanisms in dealing with the upstream oil and gas projects in Iran. These contracts have enabled the country not only to attract foreign investments but to address the legal impediments envisaged in the Constitution of Iran, and to restrict the upstream contracts to only contracts that observe the sovereignty of the government and also to maintain the title of the oil and gas to the nation of Iran. This Article while dealing with the various types of Buy-Back Contracts in Iran’s upstream oil and gas projects, will endeavor to compare those contracts with other types of upstream contracts, namely, Production Sharing Contracts, which are exercised by other nations in oil and gas industry.

    Before TRIPS coming into force in 1995, countries had authority to construct their own IP systems. Establishing World Intellectual Property Organization (WIPO), countries had to observe IP rules. One of the most important issues in WIPO is genetic resources and traditional knowledge. In relation to article 27 of TRIPS, countries have authority about protection and designation of protecting system but because of knowledge level difference between countries and locating many of these sources in developing countries, there are many problems between two groups of countries which makes the developing and developed countries to suggest amendments for TRIPS.

    Since the process of legalizing domestic documents before producing them to the foreign departments has become an issue, serious efforts have been made concerning the necessity of the examination of the Islamic Republic of Iran’s accession to the title Convention. The reason behind the importance of this convention is the willingness of states to shorten the legalizing process through abolishing the requirement of the foreign public documents to be certified by the diplomatic and consular agencies. Accession to this convention makes reference to the foreign consular and diplomatic agencies unnecessary and brings incomes for the competent domestic authorities while barring incomes for foreign agencies. This paper while explaining the certification and legalization of the domestic documents for reference to the foreign departments as an issue seeks to explore the necessity of Iran’s accession to this convention. Finally, it puts forward some solutions to set the scene for its effective implementation.
