    انصاف ازجمله مفاهیم چندلایه و پیچیده ای است که هم در دکترین، همواره مورد بحث بوده، و هم در رویه دیوان دائمی و دیوان بین المللی دادگستری و سایر مراجع قضایی بین المللی به کرات مورد استناد قرار گرفته است. قضات دیوان نیز در نظرات جداگانه خود به مناسبت های مختلف، مفهوم انصاف را مورد بحث و استناد قرار داده اند. دیوان بین المللی، با استفاده از ظرفیت قاعده سازی اصل انصاف در حل و فصل دعاوی، نقش موثری در عینیت یافتن برخی از مصادیق انصاف در حقوق بین الملل داشته و در فرایند تفسیر، گاه از اصل کلی انصاف، استنباط های اثرگذاری انجام داده که در فهم محتوای انصاف و معیارهای حقوقی آن راهگشاست. در مقاله حاضر، با تجزیه و تحلیل بعضی از رویه های دیوان بین المللی، ظرفیت های اصل کلی انصاف به ویژه ظرفیت قاعده سازی آن در راستای توسعه حقوق بین الملل و پویایی آن مورد بحث قرار گرفته است.

    کنوانسیون بیع بین المللی کالا مطابقت کالا با قرارداد را از دو منظر انطباق مادی کالا و انطباق حقوقی کالا مورد توجه قرار داده است. مقررات راجع به انطباق مادی کالا در مواد 35 تا 37 و مقررات ناظر بر انطباق حقوقی کالا در مواد 41 تا 43 کنوانسیون پیش بینی شده است. انطباق مادی کالا با مقدار مبیع مورد توافق، کیفیت آن، وصف آن و بسته بندی و ظرف بندی آن، مورد نظر طراحان کنوانسیون قرار گرفته و احکام آن پیش بینی شده است. همچنین کنوانسیون در موارد سکوت طرفین نسبت به کیفیت کالا، ضوابط تکمیلی متنوعی را مانند تناسب کالا با استفاده عرفی موردنظر از آن یا تناسب کالا با هدف خاص خریدار در نظر گرفته است. مقاله حاضر می کوشد با مراجعه به آخرین دیدگاه های حقوق دانان و آرای محاکم خارجی، مصادیق و ضمانت اجرای عدم انطباق مادی کالا را تحلیل و بررسی کند.

    ایالات متحده آمریکا مدت هاست که به گونه ای منحصربه فرد، اقدام به لغو یا کاهش مصونیت قضایی برخی دولت ها می کند که در حقوق بین الملل، قدری نامتعارف می نمایند.
    این مقاله، با بیان مختصر نحوه عملکرد ایالات متحده، وارد مباحث حقوق مصونیت شده و نگاه حقوق بین الملل را به این قاعده دیرین عرفی بررسی می کند. آن گاه رفتار آمریکا را در چارچوب این قواعد بین المللی می سنجد و در نهایت با تدقیق در نکات مذکور در رای 2012 دیوان بین المللی دادگستری به ارزیابی عملکرد ایالات متحده در پرتو رهنمون های آن رای می پردازد.
    ضمن تطبیق عملکرد ایالات متحده با حقوق بین الملل و همچنین رای 2012 دیوان بین المللی دادگستری معلوم می شود که همان گونه که حقوق دانان متعدد بیان داشته اند، در اکثر موارد نمی توان رفتار ایالات متحده را با حقوق بین الملل، همسو دانست و همچنین با محک زدن آن در ترازوی رای دیوان بین المللی دادگستری نیز تعارضات آشکار آن با آموزه های دیوان مشاهده می شود.

    در زمینه مشروعیت جدایی یک جانبه در حقوق بین الملل، رویکرد نسبتا جدیدی از سوی برخی حقوق دانان بین المللی مطرح شده است که بر اساس آن، در شرایط و اوضاع واحوال خاصی، بخشی از مردم درون سرزمین یک دولت، از حق بر جدایی چاره ساز یا جبرانی برخوردار می شوند و حقوق بین الملل در چنین شرایطی از تمامیت ارضی دولت ها حمایت نمی کند. مبنا و شالوده این استدلال، تفسیری است که عده ای از حقوق دانان بین المللی از مفهوم مخالف «قید تحفظ» مندرج در قطعنامه 2625 مجمع عمومی ملل متحد و اعلامیه و برنامه اقدام وین1993 ارائه می دهند. جایگاه حق بر جدایی چاره ساز را می توان در عرف بین المللی به عنوان یکی از منابع مهم حقوق بین الملل، بررسی و مطالعه کرد. با توجه به حمایت های قابل توجه از حق بر جدایی چاره ساز در دکترین، این مقاله کوشیده است تا مشخص نماید که آیا در حقوق بین الملل معاصر، حق مذکور به جایگاه قاعده حقوق بین الملل عرفی نیز ارتقا یافته است یا خیر.

    یکی از مباحث عمده در زمینه «تعارض قوانین در ورشکستگی فرامرزی»، مسئله شناسایی و اجرای حکم خارجی است. هنگامی که در دعوای خارجی، حکم ورشکستگی و تصفیه یا بازسازی اموال ورشکسته صادر می شود، درخواست اجرای حکم توسط مدیر تصفیه در کشور های مرتبط به مراجع ذی صلاح تقدیم خواهد شد. قبول یا رد این درخواست، منوط به سیاست تقنینی کشور پذیرنده در زمینه شناسایی و اجرای حکم ورشکستگی است. با توجه به ارتباط متقابل این مسئله با نظم عمومی، رویکرد دولت ها متفاوت است. برخی از دولت ها این درخواست را مطلقا رد و برخی به صورت مشروط با آن برخورد می کنند. در این مقاله، سیاست تقنینی «مقررات اتحادیه اروپا در زمینه دعوای ورشکستگی» (2000)، «قانون نمونه آنسیترال در زمینه ورشکستگی فرامرزی» (1997) و نظام حقوقی ایران در مبحث شناسایی و اجرای حکم خارجی در دعوای ورشکستگی فرامرزی بررسی خواهد شد.

    موضوع سرمایه گذاری خارجی و جبران خسارت در آن حوزه، یکی از مهم ترین مباحث حقوق بین الملل در زمان معاصر است. وقتی رابطه سرمایه گذاری میان دولت میزبان سرمایه گذاری و سرمایه گذاران اتباع دیگر کشورها شکل می گیرد، طرفین تا خاتمه آن رابطه، خود را متعهد به رعایت تعهدات پذیرفته شده می دانند. اما در مواقعی، ازجمله هنگام سلب مالکیت اموال سرمایه گذاران خارجی، حقوق مالکانه آن ها تحت تاثیر قرار می گیرد و حتی نقض می شود و بدین ترتیب، خساراتی اعم از مادی یا معنوی به طرف مقابل وارد می شود که طرف متخلف، ناگزیر از جبران آن ها است. جنبه معنوی خسارات وارده نیز همانند جنبه مادی آن ها قابل جبران است. پژوهش حاضر بر آن است که به بررسی موضوع جبران خسارت و محاسبه میزان آن در حقوق بین الملل و برخی آرای دیوان های داوری پرداخته و معیار حاکم بر آن ها را شناسایی نماید.

    تلاش نمایندگان قربانیان جرایم ادعایی لوبانگا، شعبه بدوی دیوان کیفری بین المللی را متقاعد کرد که با اختیارات حاصل از ماده 55 آیین نامه دیوان کیفری بین المللی، عنوان قانونی اتهامات وی را برای دربرگرفتن اتهامات جدید اصلاح کند. اما شعبه تجدیدنظر دیوان، این رویه را در تعارض با مواد (2)74 و (9)61 اساسنامه رم شناسایی و قرار اصلاح اتهامات را نقض کرد. شعبه تجدیدنظر دیوان، ضمن اشاره به اصل تفکیک صلاحیت ها در اساسنامه، اصلاح اتهامات را از اختیارات دادستان و منوط به رعایت مولفه های دادرسی عادلانه شناخت. قضات شعبه تجدیدنظر دیوان، استدلال کردند ماده 55 آیین نامه، نه تنها مجوزی برای اصلاح اتهامات متهم نیست، بلکه این ماده به دلیل بی توجهی به رعایت مولفه های دادرسی عادلانه، ناقص است.

    در سازمان جهانی تجارت، موافقت نامه هایی در خصوص تجارت کالا، خدمات و مالکیت معنوی وجود دارد که حجم مبادلات اقتصادی و قاعده مند سازی تجارت بین المللی را افزایش داده است. منصرف از ماهیت و مفاد موافقت نامه ها، اساسا نظام مسئولیت قراردادی اعضای سازمان که عمدتا در تفاهم نامه حل اختلاف تبیین شده، ترکیبی از حقوق بین الملل عرفی در زمینه مسئولیت دولت ها و حقوق معاهدات است. در این گونه موارد هرگونه زوال منفعت عضو دیگر یا لطمه به آن یا عدم امکان دسترسی به اهداف موافقت نامه ها، باعث طرح مسئولیت علیه عضو خاطی می شود. به تعبیر دقیق تر، زمانی که اعضا با تخلف عضو دیگری مواجه می شوند، دوگونه جبران مطرح می شود: الف) جبران های نهایی که همان اصل تبعیت از مقررات موافقت نامه هاست که به صورت استرداد یا اصلاح اقدامات اجرایی، تقتینی و قضایی متضاد با قواعد سازمان است؛ ب) توسل به جبران های موقتی همچون پرداخت غرامت، اقدامات تلافی جویانه در قالب تعلیق تعهدات یا سایر امتیازات؛ به شرط آنکه جبران نهایی به تنهایی موفقیت آمیز نباشد. در این مجال، با توجه به ارکان مسئولیت بین المللی یعنی قابلیت انتساب و نقض تعهد، مهم ترین عواملی که همواره به هنگام طرح مسئولیت اعضا، مد نظر است و به نوعی مخرج مشترک قواعد سازمان در زمینه جبران اعم از جبران موقت، نهایی یا تجاری تلقی می شود، تجزیه و تحلیل می شود. همچنین به نظر می رسد این عوامل و زمینه ها در ارتباطات میان عضو خاطی و شاکی، در نحوه تصمیم گیری هیئت های حل اختلاف و رکن استیناف در جهت گزینش شیوه ای از جبران، مدخلیت دارد.

    بخشی از حقوق کیفری در هر نظام حقوقی، عوامل رافع مسئولیت کیفری و عوامل موجهه جرم است. در حقوق بین المللی کیفری، به عنوان یک نظام نوپا نیز به این مسئله توجه شده است؛ بهویژه در چارچوب اساسنامه دیوان بین المللی کیفری، عوامل رافع مسئولیت کیفری و عوامل توجیه کننده جرم نیز پیش بینی شده است. البته در این سند مهم، بین این دو دسته عوامل، تفکیک نشده است. بر مبنای تقسیم بندی علمی که از این عوامل صورت می گیرد می توان گفت اختلال روانی (جنون)، مستی، اشتباه و اکراه/ اضطرار از عوامل رافع مسئولیت کیفری هستند. اساسنامه در کنار این عوامل، به عوامل توجیه کننده جنایت، مثل دفاع مشروع و اوامر مافوق نیز پرداخته است. برخی از این عوامل به صورت مطلق، و برخی دیگر، تحت شرایط خاصی رافع مسئولیت کیفری هستند. در این نوشتار، با تمرکز بر اساسنامه دیوان بین المللی کیفری به عنوان مهم ترین سند مدون حقوق بین المللی کیفری به بررسی عوامل رافع مسئولیت کیفری (جنون، مستی، اشتباه و اکراه) در حقوق بین المللی کیفری پرداخته شده است. شناخت دقیق عوامل رافع مسئولیت کیفری، نیازمند توسعه دکترین و رویه قضایی است.

    در چارچوب حقوق بین الملل بشری، حق بر کار، حق بنیادین هر شخص بر دسترسی پایدار به کار شایسته ای است که پاسخ گوی نیازهای معیشتی و رفاهی وی باشد. این حق، مخصوص جوامع شهری نیست و اعضای جوامع روستایی نیز از آن برخوردارند. حق بر کار برخلاف آنکه به لحاظ نظری بسیار مورد توجه قرار گرفته، در عمل نسبت به آن غفلت شده است. این غفلت درمورد جوامع روستایی کشاورز، حتی بیشتر است. عرضه بذرهای تراریخته، اعطای حقوق انحصاری به شرکت های خصوصی تولید کننده بذرهای مزبور، فروش بذرها با قیمت گزاف به کشاورزان، عدم امکان ذخیره بذرهای خودمصرفی و عواملی از این قبیل، موجب تحمیل محدودیت های مالی گسترده بر پیکره جامعه کشاورزی فقیر و آسیب پذیر شده است. این موضوع، سبب کاهش تعداد مزارع کوچک و حذف کشاورزان ضعیف از گردونه کار و ورودشان به بازار مشاغل کاذب می شود. لذا پرسش اصلی آن است که در تقابل میان منافع ناشی از مالکیت معنوی شرکت های تحقیقاتی و حقوق بنیادین کشاورزان در بهره مندی از شغل و رفاه چه باید کرد؟ آنچه مسلم است رویه موجود، توان پاسخ گویی به مشکلات موجود را ندارد و لذا دولت ها و البته شرکت ها با توجه به لزوم پایبندی شان به اصول بنیادین حقوق بشر، مکلف به اصلاح شیوه موجود و برقراری تعادل میان منافع متضاد هستند. این امر در سطح ملی و بین المللی باید مورد توجه قرار گیرد.

    The principle of equity in international law is of multi-dimensional and complex nature always being debated in the international legal doctrine. However, the International Court of Justice has played a significant role in the determination of the examples of this principle. While interpreting the relevant rules, the court has sometimes made effective inferences which are very helpful to understand the content of the principle of equity and its legal standards. The principle of equity has been reflected in the jurisprudence of ICJ and the opinion of Judges in various forms. The purpose of this article is to elaborate this variety by analyzing the decisions of ICJ containing arguments on equity. The main question is to determine the capabilities of the principle of equity in developing international law and maintaining its dynamic nature particularly its law making capacity in order to develop international law.

    United Nations Convention on Contracts for the International Sale of Goods (CISG) deals with the subject matter of conformity of the goods with the contract from two perspectives: physical and legal conformity. Rules regarding physical conformity of the goods with the contract have been set forth in articles 35-37 of the CISG. Articles 41 through 43 encompass rules pertinent to legal conformity of the goods with the contract. Physical conformity of the goods with the contract comprises delivery of goods that is of the quantity, quality, and description required by the contract and which is contained or packaged in the manner required by the contract. In addition, the convention has set out some default rules that are applicable in situations in which the parties are silent as to the quality of the goods. The present article is an attempt to scrutinize instances of physical non-conformity and remedies resulting from such noncompliance. In so doing, special attention has been devoted to the recent literature and jurisprudence.

    The United States of America has long violated or reduced the immunity of certain states in a unique manner, an action that is rather unusual in International Law. In this paper, the practice of the US is briefly described and the long-standing customary rule of Immunity will be discussed from the International Law perspective. Then, the US conduct in the context of International legal rules will be assessed. Eventually, with a glance at the ICJ judgment of 2012, the performance of the US will be evaluated in light of the guidelines referred to in that judgment. By comparing the practice of the US with the rules and principles of International Law as well as the ICJ Judgment of 2012, it is observed that this practice, in most cases, is not consistent with International Law and the findings of the ICJ Judgment of 2012.

    A relatively unprecedented approach has been proposed by some international lawyers in regard to the legitimacy of unilateral secession in International Law. According to that, in special circumstances a part of a population of an existing state has a remedial right to secession and in such circumstances; International Law does not protect the territorial integrity of a sovereign state. The basis and foundation of such argument relies on the inverted reading of the “Safeguard Clause” embodied in the United Nations General Assembly Resolution 2625 and 1993 Vienna Declaration and Programme of Action. The status of remedial right to secession in Customary International Law could be observed as one of the important sources of International Law. According to considerable supports for the remedial right to secession in doctrine, this article is to determine whether under contemporary International law, remedial right to secession is being promoted as a Rule of Customary International Law or not.

    One of the main issues in the field of ‘conflict of laws in cross-border insolvency’ is the recognition and enforcement of foreign judgment. After issuing a foreign judgment in the field of insolvency proceedings and liquidating or reorganizing the bankrupt's property, the liquidator will demand its execution at the involved states (the place of location of debtor's assets). It depends on the state's policies about recognition and enforcement of the insolvency proceedings whether to accept the demand or to reject it. The state’s policy in this regard is different due to its mutual connection with the public policy. Some states have generally rejected this request, and others are provided to deal with it. In this paper, the legislative policy of EU Regulation in Insolvency Proceedings (2000) and UNCITRAL Model Law on Cross-Border Insolvency (1997) and the Iranian law on recognition and enforcement of foreign insolvency judgment will be analyzed.

    Foreign investment issue and compensation in that field constitutes one of the most important matters in contemporary International Law. When an investment relation between a host State and foreign investors is formed, the parties to terminate the relations are committed to comply with the obligations they accepted. However at times, when there is an expropriation of assets of foreign investors, their proprietary rights are affected and even violated and thus incur material or moral damages to the other party where the defaulting party is obliged to compensate them. Damages of the moral as well as material aspects are reparable. The aim of the present study is to examine the issue of calculating the amount of compensation in International Law and some arbitral awards and to identify the criteria governing them.

    The Trial Chamber of the Court was convinced by the representatives of victims of Lubanga’s alleged crimes to change the existing charges against him under the permission of Regulation 55 of the Regulations of the Court in order to accord with new charges. However, the Appeals Chamber of the Court declared this practice as in conflict with articles 74 (2) and 61 (9) of the Rome Statute and overturned the verdict seeking to change the charges. Reaffirming the principle of separation of authorities, the Appeals Chamber defined the amendment of charges as within Prosecutor’s authorities and necessitated the observance of fair trial requirements. The judges of the Appeals Chamber argued that Regulation 55 is not considered as a permission to change the existing charges of the accused. They also declared the said Regulation incomplete in the content thereof for neglecting the requirements of a fair trial.

    There are many agreements under the World Trade Organization regarding trade in goods, services and intellectual property. These agreements have led to increased economic exchanges and have established regulations for international trade. Regardless of the nature and content of these agreements, legal responsibility of WTO members has emerged in dispute settlement understanding. This represents a combination of state responsibility in international customary and conventional law. Combined with relevant trade principles such as proportionality, reciprocity, and effectiveness, these agreements create effective enforcement of WTO law. In this view, any nullification or impairment of members’ benefits or impediment to the attainment of any objects of the agreement would be considered as a violation of the agreement and the member in breach would be held responsible. In other words, when WTO members are faced with derogation of an agreement by other members, they will have some options as potential reparations. At the first instance, the “Principle of Compliance” allows them to have recourse to restitution, withdrawal, or reform in executive, legislative or judiciary measures which are in conflict with WTO provisions. If this final remedy proves to be ineffective, at the second instance WTO members have a right to obtain temporary remedies (including compensation, retaliation, suspension, withdrawal from obligation, or concessions). In certain circumstances, however, there also exists the possibility for members to invoke unilateral trade remedies. Such a hierarchy for remedies is to be followed by all WTO members. The international responsibility of states consists of two elements: the wrongful act (the violation of an international obligation) and the attribution. In this article I analyze the main factors playing a role in WTO members’ responsibility. These factors are considered as common denominators for declaring WTO members’ responsibility when they are faced with ultimate or temporary reparations or trade remedies. These factors include principle of reciprocity, proportionality, effectiveness, and use of interpretation and the role of time which all strongly affect the relations between plaintiff and the defendant as WTO members. This is not an exhaustive list, and there are possibly many other factors in WTO cases that are not discussed in this article.

    A part of criminal law, in every legal system, consists of grounds for excluding criminal responsibility. Although the legislature has recognized some conducts as criminal, in some special cases and under special grounds, the perpetrator is not regarded criminally responsible. International criminal law, as a recent legal system, has addressed the issue of grounds for excluding criminal responsibility. This article deals with the grounds for excluding criminal responsibility including mental incapacity, intoxication, mistake (of law and of fact) and duress or necessity within the framework of the Statute of the International Criminal Court (ICC).

    Within the framework of the International human rights law, the right to work is the fundamental right of everyone to have permanent access to work, able to meet his/her welfare requirements. Rural communities are entitled to this right akin to urban communities. As a matter of fact, not enough attention has been paid to the members of rural communities’ right to work. The supply of transgenic crops to traditional farms within the control of biotechnological companies and their exclusive rights in this area and also the high price of transgenic crops have imposed extensive financial constraints on the poor and vulnerable farmers which may have some adverse effects on farmers’ conditions in the developing countries. Therefore, the main question is the contrast between the interests of the intellectual property rights of biotechnological companies and the farmer's right to work, security and welfare. Considering that the existing procedures could not tackle the problems at hand, the governments and companies must amend their existing practices alongside with their commitment to the fundamental principles of human rights and establish a balance between conflicting interests in national and international levels.
