    در داوری تجاری بین المللی طرفین می توانند درمورد آیین رسیدگی داوری و قلمرو اختیارات و نقش داور در امور شکلی، ازجمله «اداره ادله» توافق کنند. در صورتی که توافقی در این زمینه وجود نداشته باشد، مرجع داوری برطبق قوانین ملی داوری یا قواعد داوری سازمانی یا موردی، معمولا اختیارات وسیعی در تعیین جزئیات آیین رسیدگی و ازجمله اتخاذ روش تفتیشی یا اتهامی دارد. اما این اختیارات وسیع بدین معنی نیست که داوران می توانند خودسرانه و بدون منطق مشخص، روش موردنظر خود، اعم از تفتیشی یا اتهامی را اعمال کنند. برخلاف آنچه در بادی امر از ملاحظه اختیارات وسیع داوران به ذهن متبادر می شود، ماهیت و ویژگی های خاص داوری با اعمال روش اتهامی از سوی داور، تناسب بیشتری دارد و اتخاذ روش تفتیشی برای رسیدگی جنبه استثنایی دارد. در جزئیات آیین رسیدگی نیز، بسیاری از مراجع داوری از تلفیقی از روش های تفتیشی و اتهامی استفاده می کنند.

    پیچیده و تخصصی شدن فعالیت های اقتصادی در دنیای امروز موجب شده برای عملیات اقتصادی واحد، قراردادهای متنوع و متعددی میان اشخاص متفاوت منعقد شود. ارتباط متقابل و وابستگی اقتصادی این قراردادها و تعهدات ناشی از آن ها با یکدیگر، منجر به شناسایی مفهوم «گروه قراردادی» در حقوق شده است. این مفهوم، نشان دهنده توجه حقوق به واقعیات اقتصادی و تجاری در کنار ساختار حقوقی روابط قراردادی است. هنگامی که در گروه قراردادی که قراردادهای آن، هدف یکسانی دارند، شروط داوری مشابهی درج شده باشد یا در برخی از آن ها شرط داوری درج شده ولی سایر قراردادهای مرتبط در گروه، فاقد هرگونه شرط حل اختلاف باشند یا در مواردی که قراردادها حاوی شروط حل اختلاف متفاوت یا مغایری باشند، این پرسش مطرح می شود که آیا دیوان داوری می تواند اطراف سایر قراردادهای مرتبط در گروه قراردادی را طرف شرط داوری مندرج در یکی از این قراردادها شناسایی نماید و قلمرو شرط داوری موصوف را به آن ها گسترش دهد؟ پذیرش چنین امری، امکان رسیدگی داوری واحد به اختلافات تمام اطراف قراردادهای مرتبط را فراهم می آورد و نه تنها موجب رسیدگی کارآمدتر و موثرتر به اختلافات می شود، بلکه مانع از رسیدگی های موازی و صدور آرای متعارض نیز می شود. در چنین مواردی، اصولی چون اصل «حاکمیت اراده» و اصل «نسبی بودن قراردادها» ایجاب می کند که دیوان داوری برای شناسایی طرف شرط داوری، اراده مشترک و متقابل تمام اطراف قراردادهای مرتبط در گروه قراردادی را جستجو و کشف کند.

    پر ثمرترین مبحث مسئولیت های قراردادی و غیر قراردادی، بحث خسارت، میزان و نحوه پرداخت آن است. پرداخت خسارت، گاهی به صورت درمان است و زمانی، حسب مورد، حکم داروی التیام بخش و بازدارنده را دارد. خسارت تنبیهی نیز از این قاعده مستثنا نیست.
    خسارت تنبیهی، نوعی خسارت غیرترمیمی است که به خاطر تجری و بی احتیاطی در رفتار زیان بار خوانده پدید می آید و به منظور تنبیه و بازدارندگی وی و دیگر افراد جامعه از تکرار اعمال مشابه، به حکم دادگاه، به نفع خواهان پرداخت می شود. مفهوم خسارت تنبیهی در حقوق انگلستان به صورت سنتی وجود داشته، و به صورت گسترده ای در ایالات متحده امریکا و کشورهای دارای حقوق نوشته نیز رسوخ کرده است.
    به علت صدور آرایی علیه حکومت جمهوری اسلامی ایران در محاکم خارجی تحت عنوان خسارت تنبیهی، در ایران نیز با تصویب «قانون صلاحیت دادگستری جمهوری اسلامی ایران برای رسیدگی به دعاوی مدنی علیه دولت های خارجی» در سال 1378 و قانون اصلاحیه آن در سال 1379، این نهاد به صورت ناقص و به عنوان اقدامی متقابل، وارد سیستم حقوقی ایران شد. با نسخ این قوانین، نهایتا این روند در قانونی به همان نام در 17/2/1391 تکمیل شد. با تصویب این قوانین، محاکم ایران، طی آرای زیادی، علیه دولت خارجی (تاکنون تنها علیه کشور آمریکا) حکم به خسارت تنبیهی کردند.
    قبل از تصویب قانون فوق، در حقوق داخلی ایران، با توجه به اصل اعاده وضع زیاندیده به حالت سابق یا ابقای آن، خسارت تنبیهی مبنایی نداشت. حال این سوال قابل طرح است که آیا با تصویب این قانون، نهاد خسارت تنبیهی وارد حقوق ایران شده است؟ پاسخ به این سوال و بررسی قواعد و مقررات حاکم بر نهاد فوق و محدوده و امکان ورود این نهاد به قانون داخلی ایران، موضوع این مقاله است.

    بانک جهانی و صندوق بین المللی پول، نهادهایی فراملی و با حوزه تعیینی فعالیت در عرصه بهبود توسعه اقتصادی کشورها به حساب می آیند. اگر چه حوزه صلاحیت و اختیار این دو نهاد بر اساس اساسنامه از خصوصیات منحصربه فرد آشکاری برخوردار است، مقوله عدم اهتمام و اشاره به حقوق بشر به یک میزان در اساسنامه هر دو نهاد، نادیده گرفته شده است. بر این اساس، موقعیت حقوقی منتج از محدودیت های اساسنامه ای مورد اشاره در قبال ملاحظات حقوق بشری در این نهادهای مالی بین المللی، موجب شده است که این نهادها در زمینه پیامدهای حقوق بشری اقدامات خود، پاسخگو نباشند. لذا نیاز به توسعه ابزارهای حمایت از حقوق بشر در عرصه بین المللی در قبال اقدامات این کنشگران غیر دولتی بیش از پیش احساس می شود و هر تلاشی در جهت ارتقای مبانی مسئولیت پذیری مستقل نسبت به حقوق بشر در سطوح داخلی و بین المللی، مستلزم اعمال اصلاحات و تغییراتی در قواعد بین المللی و همچنین اساسنامه هر دو نهاد است.

    از سال 1979 تاکنون دولت امریکا در حال اجرای برنامه ای به نام برنامه آزادی دریانوردی ایالات متحده است. هدف این برنامه، مقابله با ادعاهای دریایی کشورهای ساحلی است که از نظر امریکا مغایر حقوق بین الملل دریاها است. برنامه آزادی دریانوردی دارای دو بعد سیاسی حقوقی و نظامی است. بعد سیاسی حقوقی این برنامه، گذشته از دیپلماسی حقوقی در زمینه حقوق دریاها، در قالب اعتراض رسمی به ادعاهای دریایی موردنظر نمایان می شود. اما در اجرای بعد نظامی برنامه آزادی دریانوردی، نیروی دریایی امریکا علیه کشورهایی که به ادعاهای دریایی آن ها اعتراض شده، اقداماتی انجام می دهد که اصطلاحا «اقدام عملیاتی» خوانده می شود تا از این رهگذر، ادعای دریایی مورد اعتراض به طور عملی به چالش کشیده شود. یکی از اهداف اصلی برنامه، آزادی دریانوردی ایران است که تاکنون بیشترین اقدامات عملیاتی علیه آن انجام شده است. برای واکنش به اقدامات عملیاتی در مواردی، کاربرد زور مجاز بوده و اعتراض دیپلماتیک به هرنوع اقدام عملیاتی ضروری است.

    کشور سوریه از ژانویه 2011 صحنه اعتراضات مردمی قرار گرفت که خواهان برخی اصلاحات سیاسی و اقتصادی در کشور بودند. اما پس از مدتی، این اعتراضات به دلیل عدم پاسخ گویی و البته دخالت عوامل خارجی به خشونت کشیده شد. هم اکنون شواهد حاکی از آن است که این بحران داخلی، بر اساس معیارهای تعریف شده در اسناد بشردوستانه، به مخاصمه مسلحانه تبدیل شده که نتیجه آن، کشته شدن بیش از یک صدهزار و آوارگی میلیون ها شهروند سوری بوده است.
    قواعد حاکم بر مخاصمات مسلحانه داخلی، حداقل تعهداتی را در خصوص حمایت از غیرنظامیان و نیز به کارگیری ابزار و روش های نبرد به طرف های مخاصمه تحمیل می کند که ممکن است نقض این تعهدات، منجر به مسئولیت آن ها شود. در این مقاله، پرسش اصلی این است که مبنای تعهد و التزام متخاصمین به قواعد حقوق بشردوستانه در مخاصمه داخلی سوریه چیست؟ به همین دلیل در این مقاله، ضمن تحلیلی مختصر از بحران سوریه، با توجه به نقض های ارتکابی ازجمله حملات شیمیایی، تعهد و التزام طرفین مخاصمه، اعم از دولت سوریه و گروه های شورشی به تامین قواعد حقوق بشردوستانه بررسی می شود.

    عنوان متروک ماندن که در برخی نظام های ملی درمورد متروک شدن قوانین نیز اعمال می شود، در حقوق بین الملل به حالتی اطلاق می شود که معاهده ای در برهه ای از زمان بلااستفاده مانده و مقارن با آن، عرفی در آن خصوص، ظهور می کند که چون نمی توان به عرف و معاهده به طور هم زمان عمل کرد، اجرای معاهده متوقف می شود. اکنون سوال این است که در چنین وضعیتی آیا می توان گفت که معاهده مزبور، خاتمه یافته است.
    با توقف اجرای معاهده می توان از اختتام آن سخن گفت. هرچند کنوانسیون حقوق معاهدات، متروک ماندن معاهده را راهی برای اختتام ندانسته است، هم دکترین و هم رویه قضایی و هم رویه عملی دولت ها آن را بر علل اختتام معاهدات افزوده اند.
    ازآنجایی که عرف به عنوان یکی از منابع حقوق بین الملل در ردیفی یکسان با معاهده قرار می گیرد، به نظر می آید که درصورتی که به درستی و با اجتماع شرایط لازم شکل گیرد، بتواند با معاهده به مبارزه برخاسته و آن را از دایره اجرا خارج کند. این واقعه را می توان با عامل رضایت ضمنی تابعان دخیل در شکل گیری آن، توجیه کرد.

    با گسترش ارتباطات، تبادل اطلاعات از طریق ابزارهای کارآمد با حداکثر سرعت، دقت و با صرف کمترین وقت و هزینه، ضروری است. فضای مجازی این نقش را به خوبی ایفا کرده است اما به طور حتم، چنین فضای پرمخاطبی، مخاطرات پیچیده ای را نیز به دنبال دارد. سایبر ترورسیم، یکی از این مخاطرات و از اشکال تروریسم بین المللی است که به منظور دستیابی به اهداف خود، امکان آسیب رسانی جدی به سامانه های زیرساختی و حیاتی کشور مورد هدف، ایجاد تهدیدات هسته ای یا هر چیزی که قابلیت تبدیل شدن به سلاح کشتار جمعی را داشته باشد، در بردارد. از سوی دیگر، ازآنجایی که رعایت حقوق بشر به ویژه تامین حق آزادی و امنیت فردی، حتی برای متهمین و مجرمین تروریستی ازجمله وظایف ذاتی دولت ها است، در مبارزه با تروریسم، دولت ها برای مراقبت از منافع عمومی، محدودیت هایی وضع می کنند که نقض آن، تجاوز به حریم خصوصی اشخاص محسوب می شود. بااین حال، تعهد و تکلیف دولت به منظور حفظ و حمایت از حقوق عمومی، نه تنها وظیفه هر دولتی است، بلکه ملاکی برای سنجش میزان پایبندی دولت ها در تعهد به پیشگیری از وقوع نقض حقوق بشر نیز محسوب می شو د. مسلما دولت ها نیز در اعمال این حقوق و تکالیف، محدودیت هایی دارند.

    حقوق بزه دیده از مهم ترین موضوعات نظام دادرسی کیفری نوین است. در این نظام تلاش می شود که جایگاه بزه دیده تقویت شود. یکی از ابعاد این تقویت جایگاه، اجازه مشارکت بزه دیده در دادرسی های دیوان کیفری بین المللی است. در ماده 68 اساسنامه رم، اجازه این مشارکت داده شده است، ولی این مجوز مربوط به مرحله دادرسی است. برای اولین بار، شعبه مقدماتی دیوان کیفری بین المللی، شرکت بزه دیده را در مرحله تحقیقات مقدماتی، مجاز اعلام کرده است. این رویه دیوان کیفری بین المللی، نقطه عطفی در دسترسی بزه دید گان به عدالت و رفتار منصفانه بر اساس آموزه های بزه دیده شناسی حمایتی است. قضات دیوان کیفری بین المللی با تفسیر موسع از ماده (3)68 اساسنامه به حمایت از اجرای دستاوردهای بزه دیده شناسی حمایتی بر مشارکت هرچه بیشتر بزه دیده از مراحل ابتدایی تحقیقات، روی خوش نشان داده اند.

    تالاب ها ازجمله ارزشمندترین زیست بوم های زمین هستند. نیاز به حفاظت از این زیست بوم ها، جامعه بین المللی را به سمت تهیه کنوانسیون رامسر در حفاظت از تالاب های بین المللی در سال 1349 هجری شمسی رهنمون ساخت. این کنوانسیون ازجمله مهم ترین معاهدات زیست محیطی و تنها کنوانسیون ناظر بر حفاظت از تالاب هاست که همه دولت های عضو ازجمله ایران را متعهد به استفاده معقول از تالاب ها می کند. تالاب انزلی، یکی از تالاب های مهم ایران است که در فهرست کنوانسیون رامسر قرار گرفته است. باوجود تعهد مزبور، تالاب انزلی بنا به دلایل متعددی ازجمله ریختن فاضلاب های شهری، کشاورزی و صنعتی، نوسانات سطح آب دریای مازندران، واردشدن گونه گیاهی غیربومی و هرز آزولا و ساخت جاده کنارگذر بندر انزلی در خطر نابودی است که موجب شده این تالاب در فهرست مونترو (فهرست تالاب های در معرض انقراض) قرار گیرد. لذا در این پژوهش، ضمن بررسی چالش های زیست محیطی پیش روی تالاب انزلی، تلاش شده تا راهکارهای حقوقی و غیرحقوقی برای حل این گونه تهدیدات در چارچوب کنوانسیون، بررسی شود. ازجمله مهم ترین این راهکارها برای حل مشکلات تالاب انزلی، می توان به تحقق اصل توسعه پایدار، انجام ارزیابی های زیست محیطی، استفاده معقول از تالاب انزلی و اتخاذ رویکرد زیست بومی اشاره کرد. این مقاله نتیجه می گیرد که برای حفاظت پایدار از تالاب انزلی، ضرورت دارد که این راهکارها به طور کامل به اجرا گذاشته شود.

    این مقاله در صدد بررسی جایگاه حقوق بین الملل در نظریه های روابط بین الملل است. این نظریه ها را می توان در چهار موج طبقه بندی کرد. موج اول، نظریه ایده ئالیسم است. طبق این نظریه، قدرت و اجبار به ندرت باعث پیشرفت و توسعه حقوق بین الملل می شوند. در اواخر دهه 1930 با تجاوزگری فاشیست و با ناکارآمدی نظریه ایده ئالیسم حقوقی، نظریه واقع گرایی از نظر معرفت شناسی، ذهنی و هنجاری، انتقادات مهمی را علیه نظریه ایده ئالیسم مطرح کرد. طبق نظریه واقع گرایی، حقوق بین الملل، انعکاس منافع دول قدرتمند است و در فهم رفتارهای مهم دول، نقش چندانی ایفا نمی کند. موج سوم، نظریه لیبرالیسم است که با تاکید بر نهادگرایی و خردگرایی معتقد است که حقوق بر رفتار دولت ها، قواعد، گروه ها و افراد موثر است. موج چهارم، نظریه تکوین گرایی است که معتقد است هویت ها و منافع، ذاتا از گروه های اجتماعی قابل تفکیک نیست و حقوق بین الملل، انعکاس و تقویت کننده منافع و هویت دولت ها و گروه ها است. در پایان، نتیجه گیری می شود که هر فعلی در روابط بین الملل، نقش اساسی در تحول و عملکرد حقوق بین الملل ایفا می کند و حقوق بین الملل و روابط بین الملل، روابطی پیچیده با هم دارند.

    In the absence of any provision by the parties regarding the active or passive role of the arbitrators in international commercial arbitration (which is often the case), the arbitral tribunal enjoys absolute discretion to how to organize the arbitration procedure including the selection between the adversarial or inquisitorial approaches. The crucial point is that the foregoing discretion is not tantamount to the arbitrary application of adversarial or inquisitorial methods in dispute settlement procedures. Despite what may be perceived at first glance from the abovementioned point concerning the absolute discretionary power of arbitrators in procedural matters, the nature and the characteristics of commercial arbitration is mostly consonant with the adversarial practice and the application of inquisitorial method in commercial arbitration should be considered as an exception. When it comes to the details and subtleties of the arbitration procedure, most of the arbitral tribunals are inclined to apply a mixed of adversarial and inquisitorial techniques.

    Complexity and specialization of economic activities at current time have resulted in the fact that the realization of a single economic operation requires the conclusion of multiple and various contracts among different parties. Reciprocal relationships and economic interdependence among these contracts and the obligations arising therefrom have led to the recognition of the concept of “Contractual Group” in law. This concept demonstrates that the law takes commercial and economic realities into consideration along with the legal structure of contractual relationships. In a contractual group whose contracts pursue a common objective, similar arbitration clauses are included, or in some of the said contracts, arbitration clauses are inserted, while, other interrelated contracts belonging to the same group lack the dispute resolution clause, and also in cases that the contracts within a contractual group contain different or inconsistent dispute resolution clauses, this question arises whether the arbitral tribunal may consider the parties to other interrelated contracts in a contractual group as the parties to an arbitration clause embedded in one of these contracts and consequently, extend the scope of the mentioned arbitration clause to them. Giving a positive answer to this question will pave the way for resolving the disputes of all parties to interrelated contracts through single arbitration proceedings and it will not only lead to a more efficient and effective settlement of disputes, but also refrain from parallel proceedings and issuance of contradictory awards. In such cases, the Theory of Autonomy and the Principle of Privity of Contracts require that in order to determine the party to an arbitration clause, the arbitral tribunal discovers the common and mutual intention of all the parties to interrelated contracts within a contractual group.

    The punitive damages awards are pragmatic forms of redress and intermediate sanctions against anti-social misconduct of the defendants. These kinds of awards do not have compensatory character, but extracompensatory ones. They will be given, in addition to the punishment and tort compensation, to the claimant in order to deter the members of the society from creating further damages towards the others, especially when the case of wealthy and powerful individuals and entities who undertake such misconduct is in issue. The present article explains that the Iranian Legal System did not deploy punitive damages against the defendants (people, entities, and foreign states) before 1999, to punish their misconduct. It only used to confine itself to the application of criminal, civil and tort laws. In the first part, after introducing backgrounds of punitive damages in foreign countries, and how it might work in international scale, the article describes the reasons by which this theory came to the attention of Iranian government. In other parts, the article explains the structure of punitive damages and clarifies the comparative advantages or disadvantages of punitive damages vis-à-vis other remedies and mechanisms available in Iranian Legal System. Finally, not only the article analyses the verdicts of U.S. courts against Iranian government and vice versa, but also considers whether the awards of punitive damages make sense to be issued by one state against the other or not.

    The World Bank and International Monetary Fund (IMF) are supranational organizations whose functions revolve around the economic development of states. While the mandate of each of these institutions as defined by its charter is unique, one common thread is the non-specific mention of human rights in their Articles of Agreement. Consequently, anomalies in the legal position of these International Financial Institutions (IFIs) regarding human rights have appeared to enable them to operate without being subjected to any effective legal control. Therefore there is a need to expand international human rights protection against these non-state actors. This article while examining the existing capacity of independent and quasi-independent institutional accountability toward human rights for the World Bank and the IMF, investigates those international legal principles they comply with and how they should be implemented.

    Since 1979, the United States has conducted a program named the U.S. Freedom of Navigation (FON) Program that seeks to counter the supposedly excessive maritime claims of coastal states around the world. These are maritime claims that the United States considers inconsistent with the law of the sea as reflected in The United Nations Convention on the Law of the Seas (UNCLOS). The FON Program combines diplomatic protest and socalled operational assertions by U.S. naval air forces to challenge excessive maritime claims. Among the coastal States that have been challenged by FON operational assertions, Iran has been targeted most frequently. FON operational assertions can, in some cases, make permissible the defensive use of force. It is also necessary that Iran lodges a diplomatic protest against the United States each and every time such assertions are carried out against her.

    Syrian protests for political and economic reforms in the country started in January 2011. However, after a while of course and due to external interventions, and international humanitarian criteria, the crisis has been transformed into internal armed conflict, which resulted in the death of more than thousands of people and displaced millions of Syrian citizens. According to the rules governing on internal armed conflicts, parties to the conflicts must observe some minimum obligations regarding the protection of civilians as well as applying tools and methods of the battle. The violation of these obligations will lead to responsibility of the violating party. The main issue is the basis of obligations of parties to the crisis and the application and enforcement of rules of international humanitarian law. In this paper, Syrian crisis and crimes which occurred therein such as chemical attacks are analyzed and parties’obligation to apply humanitarian rules are considered.

    Desuetude of treaties in International Law means that a treaty is useless in specific periods of time and there appears a contrary custom against the treaty. Since the said treaty and the contrary custom cannot be performed simultaneously, the treaty will no longer be in use and the treaty will such be terminated. Although the Vienna Convention on the law of treaties, 1969 has not considered the desuetude of treaties as a way of termination, legal doctrines, case law and the state practice have added this to the causes of termination. Since the custom as one of the sources of international law bears the same position as treaty, it seems that, if the custom is formed correctly and in conformity with the required conditions, the treaty can be challenged and incapacitated encountering with such a customary rule. This may be justified with the implicit consent of the relevant subjects of international law.

    By the development of communication, the exchange of information through efficient tools with maximum speed, accuracy, minimum time and cost allocation is inevitable. Cyberspace plays this role well but complex risks such as cyber-terrorism may arise in such a popular environment. In order to achieve its goals, cyber-terrorism as a form of international terrorism may impose serious harm on the vital infrastructures of the targeted state including nuclear threats or anything which bears the potential to become weapons of mass destruction. On the other hand, the observance of human rights, particularly providing the right to freedom and security, even for the terrorist suspects and offenders are among the inherent duties of states. To protect the public interest in combating terrorism, states have attempted to impose restrictions which are considered as violation of their obligations regarding the privacy policy. Nevertheless, the obligation to preserve and protect the public rights are not only the duty of states, but also the criteria to measure their compliance with the obligation to prevent the violation of human rights. States have also been restricted in the exercise of these rights and obligations.

    The rights of victims are considered as significant issues in the new system of criminal proceedings. This organization tries to promote victim's standing. One of the reflections of such promotions is the victim’s participation in the International Criminal Court hearing. Although this participation is permitted under article 68(3) of the Rome Statute, but it only belongs to the hearing phase. Preliminary examination chamber of International Criminal Court for the first time allows victims to participate in preliminary examination stage. This procedure of International Criminal Court is a turning point in victim’s access to justice and fair treatment based on assistance-oriented victimology. Judges of International Criminal Court with maximal interpretation of article 68(3) of the Rome Statute accept achievements of assistance-oriented victimology for the more participation of victims in preliminary examination stages.

    Wetlands are among the most valuable ecosystems on the Earth. The need for protection of these ecosystems has made the international society to conclude the Ramsar Convention for the Conservation of International Wetlands in 1971. This convention as one of the most important environmental treaties and the only existing particular treaty concerning the protection of wetlands, urges all member states including Iran, to use wetlands wisely. Anzali Lagoon is one of Iran’s wetlands of international importance included in the Ramsar List. Despite this commitment, Anzali Lagoon is exposed to eradication and degrading due to various reasons such as the discharge of urban, agricultural and industrial wastes, fluctuations of water levels in Caspian Sea, introduction of alien invasive plant species of Azula, and construction of bypass road in the Anzali Port which resulted in the inclusion of this wetland in the Montreux Record (list of endangered wetlands). While this paper pays close attention to the environmental challenges facing the Anzali Lagoon, it examines and analyzes legal and non-legal mechanisms to resolve such issues in the framework of the Ramsar Convention. These mechanisms include, but not limited to, realization of sustainable development, environmental impact assessment, wise use of Anzali Lagoon wetlands, and ecosystem-based approaches. This paper concludes that for sustainable conservation of the Anzali Lagoon, it is necessary to implement these mechanisms completely.

    Keeping in mind that International Law and international relations are intertwined in a relationship, this essay elaborates and analyzes the status of International Law in international relations theories. These theories can be grouped into four intellectual movements as follows: Part I constitutes "classical legal thought" which generally believed that power and coercion could become far less prominent in world affairs through the development of International Law. Part II analyzes Realists’ reaction to Classicism. With Fascist aggression in the late 1930s, realism emerged to launch an epistemological, heuristic, and normative attack on classical approach. While realism generally views International Law as a reflection of the interests of the powerful states, and structural realism- at its core- denies that International Law is consequential, realists display a range of views from those who find International Law meaningless to those who find it crucial to understanding state behavior. Part III includes the elements of this reaction; early efforts to use sociology or the social science more broadly, rationalist institutionalism's demonstration that of the liberal theory, usually in conjunction with institutionalism, to show how law affects the behavior state, rulers, groups, and individuals. In Part IV, Constructivism sees interest and identities as intrinsically inseparable from social group and the International Law both reflects and reinforces identities and interests. Finally we understand that any function in international relations is essential for] International Law to evolve and function.
