    [...] جامه کهنه ست ز بزاز نو یکی از بغرنج ترین مسائل حقوق، ایجاد تعادل میان ثبات و گذر زمان است که یکی، نماد امنیت حقوقی و دیگری، نماد هماهنگی با مقتضیات روز و واقعیت های اجتماعی است. از سوی دیگر، یکی از مهم ترین مسائل حقوق بین الملل معاهدات، یعنی تفسیر تکاملی معاهدات بین المللی، با این موضوع مستقیما مرتبط است؛ تفسیری که از یک سو، قصد و اراده طرفین معاهده را مدنظر قرار می دهد و از سوی دیگر، واقع بینانه، بر آن است که این قصد و اراده را با تغییرات اجتماعی حادث شده از زمان انعقاد پیمان، هماهنگ کند. قضیه اختلاف در خصوص کشتی رانی و حقوق مربوط به آن، یکی از آخرین رویه های دیوان بین المللی دادگستری است که تفسیر تکاملی در آن، بار دیگر به بحث گذاشته شد. این امر، واکنش حقوق دانان و محاکم بین المللی را در پی داشته است. نوشتار حاضر می کوشد مفهوم و جایگاه تفسیر تکاملی را در پرتو قضیه مذکور تحلیل کند.

    موافقت نامه عمومی تجارت خدمات (گاتس) یکی از موافقت نامه های سازمان جهانی تجارت است که تجارت خدمات را میان اعضای سازمان، قاعده مند کرده است. با تصویب گاتس به عنوان اولین و تنها موافقت نامه چندجانبه ای که تجارت بین المللی خدمات را پوشش می دهد، سازمان جهانی تجارت، نقش خدمات را در اقتصاد جهانی به رسمیت شناخت. یکی از اصول بنیادین سازمان جهانی تجارت و به تبع آن، گاتس، اصل عدم تبعیض است. این اصل، در چارچوب گاتس، شامل دو مولفه است: تعهد رفتار دولت کامله الوداد و تعهد رفتار ملی. ماده 2 گاتس با تاکید بر لزوم رفتار دولت کامله الوداد نسبت به خدمات و عرضه کنندگان خدمات به طوری که از رفتار درمورد خدمات و عرضه کنندگان خدمات مشابه دیگر اعضا نامطلوبتر نباشد، تعهد به رفتار دولت کامله الوداد را محترم و الزامی می شمارد؛ این رفتار باید فورا و بدون قیدوشرط به دیگر اعضا تسری یابد. یک عضو به شرطی می تواند به اقدامی مغایر با دولت کامله الوداد ادامه دهد که چنین اقدامی در ضمیمه مربوط به معافیت های ماده 2 فهرست شده و با شرایط مقرر در این ضمیمه انطباق داشته باشد. همچنین در مواد 14 و 14 مکرر و دیگر مواد گاتس به برخی معافیت های دیگر تصریح شده است که در ضمن این پژوهش به آن اشاره خواهد شد.

    یکی از مقررات مهم کنوانسیون شیکاگو، مربوط به تصویب استانداردها و طرح های پیشنهادی در خصوص عملیات هواپیما و سیستم هوانوردی است. کنوانسیون شیکاگو به ایکائو اختیار داده است تا در مواقع لزوم، «موازین، مقررات بین المللی و طرح های پیشنهادی» را که جنبه بین المللی دارند وضع نماید. این مقررات و استانداردها، ضمائم کنوانسیون شیکاگو را تشکیل می دهد.
    کشورهای عضو کنوانسیون شیکاگو تعهد کرده اند، قوانین، مقررات و آیین نامه های خود را با استانداردهای بین المللی که ایکائو تصویب می کند هماهنگ نمایند. ایکائو باید از تصویب و اجرای این استانداردها توسط دولت های عضو، اطمینان حاصل کند. تا سال 1998 ایکائو نظارتی بر اجرای این استانداردها نداشت. مجمع عمومی ایکائو برنامه ممیزی نظارت بر ایمنی را تصویب کرد. این مقاله در نظر دارد سیر تحول نظارت ایکائو بر مقررات کشورها را بررسی کرده و درنهایت، نگاهی به عملکرد ایران در اجرای برنامه های نظارتی توسط ایکائو داشته باشد.

    حسن نیت به عنوان یکی از اصول بنیادین و کلی حقوق بین الملل، بیانگر لزوم وجود انصاف، صداقت و معقول بودن در روابط بین المللی است؛ اصلی که پاسداشت منافع و انتظارات مشروع و معقول طرفین این روابط است و به طور ویژه به عنوان ضرورت در حل و فصل اختلافات بین المللی مطرح است. برخی از قواعد حقوق بین الملل، ازجمله لزوم وفای به عهد، استاپل، سکوت و سوء استفاده از حقوق و انجام مذاکرات، بر پایه حسن نیت بنا شده است. این مقاله با بررسی چگونگی ارتباط میان حسن نیت و قواعد مذکور، در پایان نتیجه می گیرد که اگرچه حسن نیت به تنهایی منبع تعهدات محسوب نمی شود، می توان برای آن، نقش تحدید حدودکننده قائل بود؛ بدین معنا که رعایت این اصل از سوی دولت ها، اجرای حقوق و تعهدات آن ها در عرصه بین المللی را تنظیم می کند.

    ضعف نظام اجرایی حقوق بین الملل و فقدان ضمانت اجراهای گسترده و موثر برای تعهدات حقوق بشری، اهمیت اقدامات متقابل را دوچندان می کند. باوجود این، تبعات زیان بار استفاده از این ابزار و خطرات احتمالی به کارگیری آن، پرسش جدی نسبت به کارآمدی و مطلوبیت استفاده از اقدامات متقابل در فراروی دولت ها و حقوق دانان بین المللی قرار می دهد. بررسی وضعیت دولت هایی که تاکنون به دلیل نقض حقوق بشر در معرض اقدامات متقابل قرار گرفته اند، همچنین دقت در نظریات حقوق دانان بین-المللی، نشان گر آن است که این اقدامات در عین ضرورت و اهمیتی که برای حقوق بین الملل دارند، پیامدهای زیان باری بر مردمان این سرزمین ها تحمیل کرده و درنتیجه، به شکل کنونی، ابزار مطلوب و چندان کارآمدی برای الزام دولت ها به ایفای تعهدات حقوق بشری شان نیستند. بدون شک، مذاکره بر سر حدود و شرایط استفاده از این اقدامات و چاره اندیشی به منظور رفع نقاط ضعف آن ها، گام بزرگی در راستای تضمین رعایت تعهدات حقوق بشری دولت ها در نظام بین المللی کنونی خواهد بود.

    با ارجاع پرونده هسته ای ایران از سوی آژانس بین المللی انرژی اتمی به شورای امنیت سازمان ملل متحد و با همسویی شورای اتحادیه اروپا، تحریم های بین المللی هوشمند، اجرایی شد و صنعت نفت، به ویژه تدارکات آن را هدف قرار داد. با عنایت به عدم بررسی آثار حقوقی تحریم ها بر تدارکات، تحقیق حاضر، «آثار حقوقی تحریم های بین المللی هوشمند در چارچوب قطعنامه های شورای امنیت را با تاکید بر تدارکات در صنعت نفت ایران از ژانویه 2006 تا ژوئن 2014» تشریح و تحلیل می کند. به طور کلی، مجموعه تحریم های اعمال شده، محدودیت های شدید مالی و عدم امکان بهره گیری از خدمات موسسات مالی و اعتباری را در خصوص انعقاد و اجرای قراردادهای نفتی ایجاد کرده است. درنتیجه، محدودیت های اعمال شده به طور بالقوه، وضعیت قراردادهای تدارکات را با نظریه های هاردشیپ و فورس ماژور مواجه ساخته است.

    به مانند قطعنامه های مجمع عمومی سازمان ملل متحد و دیگر نهادهای بین المللی که می توانند مبین رویه دولت ها و اعتقاد حقوقی آنان در خصوص موضوعات مطروح باشند، اعمال شورای امنیت نیز می تواند به همین نحو نقش آفرین باشد؛ امری که به زعم برخی، ظاهرا در گزارشهای گزارشگر ویژه کمیسیون حقوق بین الملل، پروفسور مایکل وود در رابطه با شکلگیری و شناسایی حقوق بین الملل عرفی، مغفول مانده است. باید توجه داشت در عرصه موضوع شکل گیری حقوق بین الملل عرفی، از دو جهت به عملکرد سازمان های بین المللی توجه می شود و از این حیث، تفاوتی میان ارگان های دولت محور سازمان وجود ندارد. از یک سو سازمان های بین المللی یکی از تابعان فعال حقوق بین الملل محسوب می شوند و اعمالشان در روند ساخت و پرداخت عرف در کنار رویه دولت ها مورد توجه قرار می گیرد و از سوی دیگر، برخورداری سازمان های بین المللی از شخصیت حقوقی جدا از اعضا، منافاتی با احراز رویه مستقل کشورهای عضو نخواهد داشت. بدین ترتیب از نقطه نظر ملاحظه اخیر، قطعنامه های سازمان های بین المللی، ظرفیتی مناسب به منظور ارزیابی رویکرد دولت ها در موضوعات مورد بحث دارد و مبین و منعکس کننده اعتقاد حقوقی آن هاست. در این بین، اقدامات شورای امنیت سازمان ملل متحد نیز به عنوان مهم ترین ارگان اجرایی دولت محور سازمان ملل متحد، بدون تردید، عمل سازمان محسوب می شود و می تواند در فرایند شکل گیری حقوق بین الملل عرفی نقش آفرینی کند.

    ازآنجاکه اعمال تحریم های گسترده، کل جمعیت کشور مورد تحریم را هدف قرار می دهد، برای مردم، به ویژه اقشار ضعیف جامعه، مشکلات فراوانی ایجاد می کند. یکی از راهکارهای کاهش اثرات منفی تحریم ها به ویژه تحریم های گسترده، تحدید زمان و قلمرو شمول تحریم است. به بیان دیگر، ایجاد محدودیت زمانی و نیز محدودیت در گستره تحریم از جنبه های عینی و شخصی، راه را به سوی انسانی کردن تحریم ها هموار خواهد کرد. دلیل گنجاندن چنین محدودیت هایی در تحریم، آن است که اثرات منفی آن نباید گریبان گیر کسانی شود که در رفتار یا سیاستی که علت وضع تحریم بوده است، هیچ گونه نقشی نداشته اند. این قاعده از اصل تفکیک (تمایز) در حقوق بین الملل بشردوستانه نشات گرفته است و بر اساس آن، تحریم باید در حد متعارف، متضمن حداکثر تفکیک میان افراد مسئول و مردم عادی باشد. بدیهی است رعایت این اصل در زمینه تحریم، در صورتی موفقیت آمیز خواهد بود که کارآمدی تحریم بر مبنای مشروعیت بین المللی آن و با اتکا به همکاری وسیع کشورها و سازمان های بین المللی در اجرای تحریم به همراه ارزیابی مستمر آثار آن بر مردم کشور هدف (مورد تحریم)، تضمین شود. در مقاله حاضر، مفهوم، طبقه بندی و چگونگی گنجاندن قیدهای محدودکننده و تاثیر این سازوکارها بر تقویت ابعاد انسانی تحریم ها و مصون نگاهداشتن مردم عادی از اثرات منفی آن ها، بررسی می شود.

    هدف اساسی از شکل گیری دکترین مسئولیت کیفری مافوق نظامی و غیرنظامی به جهت ارتکاب رفتارهای غیرانسانی نیروهای تحت امر خود در حقوق بین الملل کیفری، تضمین این موضوع مهم است که آن ها برای جلوگیری از ارتکاب جرم به وسیله نیروهای تحت امر خود، کنترل مناسبی انجام دهند و در صورت وقوع جرم، به سرکوب، مجازات و گزارش آن بپردازند. مبنای نظری مسئولیت کیفری مافوق، هر چه باشد، نتیجه آن است که آن ها به جهت موقعیتی که دارند، مسئول نظارت بر نیروهای تحت امر خود هستند. بنابراین درصورتی که بدانند یا می بایست بدانند که جنایات جنگی در حوزه تحت ماموریت و از سوی نیروهای تحت امرشان واقع شده یا در حال وقوع است یا به زودی اتفاق خواهد افتاد و مانع ارتکاب آن نشده یا آن را به مقام های ذی صلاح گزارش ندهند یا تدابیر لازم را برای محاکمه و مجازات متخلفین اتخاذ نکرده باشند، دارای مسئولیت کیفری هستند. مقاله حاضر، ضمن تبیین اجمالی شکل گیری مسئولیت کیفری مافوق در حقوق بین الملل کیفری و همچنین روند تکاملی آن در آرای دادگاه ها، به شرایط تحقق این مسئولیت نیز دقت کرده و به طور مختصر، نقض مقررات حقوق بشر و حقوق بشردوستانه به وسیله نیروهای امریکایی را در عراق تحت اشغال بررسی و ثابت می کند که بر اساس هنجار های پذیرفته شده بین المللی، فرماندهان نظامی و مافوق های غیرنظامی امریکایی درگیر تهاجم به عراق و اشغال این کشور، نسبت به جرائم ارتکابی نیروهای مادون خود، مسئولیت کیفری دارند و محاکم صالح ملی و بین المللی باید آن ها را تعقیب، محاکمه و مجازات کنند.

    تعیین قانون قابل اعمال بر تعهدات غیرقراردادی برای اولین بار بهطور رسمی در سال 2007 در قالب مقرره رم 2 به تصویب شورای وزیران و پارلمان اتحادیه اروپا رسید. این مقرره، حقوق اتحادیه اروپا را درمورد تعهدات غیر قراردادی در کشورهای عضو (به استثنای دانمارک) برابر و متحد الشکل می کند. هدف این مقرره، مساعدت به دادگاه های کشور عضو در اتخاذ تصمیم نسبت به قانون حاکم بر تعهدات غیر قراردادی در اختلاف بین المللی است. مقرره رم 2 به تعهدات غیر قراردادی ناشی از موضوعات مدنی و تجاری می پردازد. به موجب این مقرره، قاعده اولیه قابل اعمال بر تعهدات غیرقراردادی، ناشی از مسئولیت مدنی قانون کشور محل ورود خسارت است. مقرره رم 2 در کنار این قاعده، به قواعد خاصی برای حکومت بر برخی دعاوی ازجمله مسئولیت کالا، رقابت غیر منصفانه و اقدامات محدود کننده رقابت آزاد، خسارات زیست محیطی، نقض حقوق مالکیت فکری و اعتصاب صنفی (اتحادیه ای) اشاره کرده است. در چارچوب این مقاله، مهم ترین جنبه های مقرره رم 2 به عنوان مجموعه قوانین متحد الشکل قواعد حل تعارض قابل اعمال بر دعاوی غیر قراردادی در اتحادیه اروپا بررسی خواهد شد.

    قرارداد بیمه ممکن است به واسطه دخالت یک یا چند عنصر خارجی به دو یا چند نظام حقوقی ارتباط پیدا کند. ممکن است این نظام ها حقوق ایران و اتحادیه اروپا باشند. در این خصوص باید دانست که قانون کدام یک از نظام های مذکور بر چنین قراردادی حکومت خواهد کرد. در حقوق اتحادیه اروپا، دستورالعمل های ویژه ای دیده می شود که در آن ها ضوابط چگونگی تعیین قانون حاکم بر قرارداد بیمه پیش بینی شده است. اما در حقوق بین الملل خصوصی ایران، مقررات حقوقی خاصی در این باره وجود ندارد و لذا برای تعیین قانون حاکم بر قرارداد بیمه باید به مقررات عمومی رفع تعارض قوانین رجوع کرد. قاعده عمومی در این زمینه، ماده 968 قانون مدنی است. مطابق عامل های ربط پیش بینی شده در دستورالعمل های اتحادیه اروپا، علی الاصول قرارداد بیمه غیرعمر تابع قانون محل سکونت معمولی بیمه گذار (درمورد شخص حقیقی) یا اداره مرکزی او (در خصوص شخص حقوقی) و در عقد بیمه عمر، تابع قانون محل سکونت معمولی بیمه گذار یا تابعیت اوست. عامل های ربط مزبور موجب می شود تا قانون کشور عضو اتحادیه اروپا که با آن نزدیک ترین ارتباط را دارد بر قرارداد بیمه حاکم شود. در حقوق ایران، بین قراردادهای بیمه دارای خصیصه تجارتی و مصرفی باید قائل به تفکیک شد: در خصوص قرارداد بیمه دارای خصیصه تجارتی، باید قاعده حل تعارض خاصی را پیش بینی کرد و در آن، اصل خودسامانی یا آزادی اراده را در انتخاب قانون حاکم بر آن نافذ دانست. درمورد قرارداد بیمه دارای خصیصه مصرفی باید نظام مقرر در ماده 968 قانون مدنی را اصلاح و عامل ربطی را در ماده مذکور پیش بینی کرد تا بر اساس آن، قانونی حاکم بر قرارداد بیمه شود که با آن نزدیک ترین ارتباط را داشته باشد. بنابراین در پایان مقاله، قاعده حل تعارض منطقی و قابل قبول در زمینه قانون حاکم بر قرارداد بیمه به قانونگذار ایرانی پیشنهاد خواهد شد.

    Creating a balance between the stability and the passage of time is one of the most complex legal issues, the first of which is the symbol of the legal Certainty and the latter is the symbol of harmony with the requirements of time and social realities. Furthermore, one of the most significant issues of the international law of treaties (i.e. evolutive interpretation of international treaties) is directly related to this subject matter; the interpretation that on the one hand, considers the intention and the will of the parties to the treaty and on the other, realistically tries to harmonize this intention and the will with the created social changes since the conclusion of the treaty. Dispute regarding navigational and related rights case is one of the most recent precedents of the International Court of Justice wherein it has discussed the evolutive interpretation; the matter that has brought a variety of commentaries from the lawyers and the international tribunals. This paper intends to analyze the concept and the position of the evolutive interpretation in the light of the aforementioned case.

    The General Agreement on Trade in Services (GATS) is one of the WTO agreements that regulates trade in services among members of WTO. WTO recognized the important role of services in the global economy by adopting the GATS, which is the first and the only multilateral agreement covering international trade in services. One of the basic principles of WTO and GATS is Non-Discrimination principle. Non-Discrimination under the GATS consists of two elements; Most-Favored-Nation (MFN) and National Treatment (NT) obligations. Article II of the GATS enshrines the MFN obligation which requires no less favorable treatment among different WTO Members than that is accorded to like services or service suppliers of any other country. This treatment shall accord immediately and unconditionally. A Member may maintain a measure inconsistent with MFN provided that such a measure is listed in and meets the conditions of the Annex on Article II Exemptions. MFN, also, has some exemptions which stipulate the GATS provisions. The general exceptions justifying discriminatory measures contained in Articles XIV and XIV bis of the GATS, apply to general obligations and specific commitments. Additional exemptions to the MFN obligation are scattered across the GATS and will be discussed separately in this study.

    A fundamental regulation of the Chicago Convention is related to the adoption of uniform rules or standards with regard to all aspects of the operation of aircraft and of the system required to support international air navigation. This is done by ICAO Council which is authorized by the Chicago Convention, when required, to regulate the ‘international standards and recommended practices’. These standards and regulations constitute the Annexes to the Convention. All States under the Chicago Convention are required to adopt regulations uniformed with those established under the Convention and the standards adopted by ICAO as embodied in the Annexes to the Convention. By 1998, there was no audit program to find out whether States incorporate international standards into their national laws. To ensure the States’ compliance with international standards, ICAO General Assembly passed Resolution A32-11, which established ‘ICAO’s Safety Oversight Program’ to assess member States’ compliance with these Standards. This article intends to assess the development of ICAO audit program to verify the member States’ compliance with ICAO’s ‘standards and recommended practices’ and finally to have a glance at Iran’s practice in this regard.

    Good faith is one of the general and fundamental principles of International Law which indicates the need for voice of fairness, honesty and reasonableness in international relations. This principle protects legitimate and reasonable interests and expectations of parties to international relations and is particularly raised as a requirement for the settlement of international disputes. Some of the rules of International Law, including pacta sunt servanda, estoppel, acquiescence, abuse of rights and negotiations are basically established on good faith. This article examines the relationship between good faith and the mentioned rules and ultimately argues that although good faith is not merely considered as a source of obligations, it acts as a limitation, i. e. the fulfillment of this principle by States regulates the performance of their rights and obligations in the international community.

    Counter Measures as means of persuading states to comply with their human rights commitments towards their own nationals have not been elaborated in the ILC articles on international responsibility of States. However, these measures are of great importance in the view of scholars and member States of international community. The lack of effective enforcement system for human rights commitments intensifies this importance. Notwithstanding this significance, the negative effects of applying countermeasures on human rights and humanitarian rights of the people of the target States and also the grave risks allowing such actions inflict on international affairs lead scholars to serious questions concerning the effectiveness of counter measures as means of persuading states to comply with their human rights commitments. As a matter of fact, there seems to be an unsettled conflict between the legal necessity of counter measures as enforcement means of human rights and the very negative political, economic and humanitarian effects of using such means.

    Implementing international smart sanctions against Iran started afterreferring Iranian nuclear program to the Security Council by international Atomic Energy Agency (IAEA) and subsequent corroboration of EuropeanUnion Council, upon which procurement of petroleum industry was sanctioned. Since legal analysis of sanctions on procurement is lacking, this article describes and analyzes the legal effects of the international targeted sanctions in the framework of Security Council resolutions on Iranian oil industry with emphasis on procurement during January 2006 throughout June 2014. Overall, comprehensive sanctions meaningfully restricted access to financial institutions and credit bureaus for signing and implementing oil contracts. In addition, implemented restrictions have potentially exposed procurement contracts with the principles of hardship and force majeure.

    Similar to the UN General Assembly and other international bodies that identify practice and opinio juris of States, acts of Security Council can also play a role. In the view of some writers, this matter prima facie has been oversighted in the first report of Special Rapporteur of International Law Commission, Professor Michael Wood on formation and evidence of Customary International Law. In the scope of the formation of customary international law, in general, international organizations’ acts should be observed in two respects which in this framework, there is no difference between State-oriented organs of the organization. On the one hand, international organizations are one of the active subjects of international law and their acts have contributed with States’ practice to the process of theformation of customary rule and on the other hand, in every organization, States act and practice independently. Therefore, in the viewpoint of the latter observation, international organizations’ resolutions are appropriate potentials for evolution of States’ approach toward matters involved reflecting opinio juris of States. In this context, the practice of the Security Council as the most important UN State-oriented organ, undoubtedly is considered as the act of the organization and may contribute to the process of formation of Customary International Law.

    The imposition of comprehensive sanctions by targeting the whole population in a sanctioned State causes a wide range of problems for the people and particularly the weak groups of society. To limit the time and the scope of sanctions is a method to reduce negative consequences of sanctions, specifically comprehensive ones. In other words, determining time limits as well as objective and subjective limitations for sanctions will pave the way to the humanization of sanctions. The reason for the inclusion of the abovementioned limitations is that the people who have no role in the conduct or the policy triggering sanctions, should not bear the negative consequences thereof. This rule stems from the international humanitarian law principle of distinction according to which sanctions should reasonably involve the maximum distinction between the responsible elites and ordinary people. Evidently, the compliance of this principle will only be successful when the efficiency of sanctions program is guaranteed on the basis of its international legitimacy and relying on widespread cooperation among States and international organizations during the implementation of sanctions along with continuous evaluation of their effects on the people of the targeted State. In the present essay, the notion, classification, the inclusion of limitation clauses and the effects of those mechanisms strengthening the humanitarian aspects of sanction will be studied.

    The main purpose of the doctrine of superior criminal responsibility for inhuman treatment by the military and civilian-led forces in international criminal law is to ensure that they have adequate controls to prevent crimes committed by troops under their command and in committal of crimes, they make suppression, punishment and prepare a report thereof. The theoretical basis of superior criminal responsibility, after all, is that they are in a position which makes them responsible for supervising the troops under their command. Hence, if the superiors are aware of the war crimes occuring in the area of their mission and commited by the troops under their control, and they fail to prevent or report it to the competent authorities or hesitate to take the necessary measures to prosecute and punish the offenders, they will have penal responsibility. This article contains a brief explanation of the formation of superior criminal responsibility under international law as well as its evolutive process in criminal courts. It also focuses on the fulfillment of this responsibility and briefly examines the violation of human rights and humanitarian law by US forces in occupied Iraq. It also confirms that on the basis of internationally accepted standards, military commanders and the US civilian superiors involved in the invasion of Iraq are held criminally responsible in relation to the crimes committed by their subordinate forces and the competent national and international courts should prosecute and punish them.

    Determination of applicable law on non-contractual obligations for the first time has officially been approved in the framework of Rome II Regulation by the Council of Ministers and European Union Parliament. The Regulation unifies and equalizes the law of the European Union on the issue of noncontractual obligations among the member States (with the exception of Denmark). The purpose of this regulation is to assist the member States’ courts in making decision regarding the applicable law to non-contractual obligations in an international dispute. Rome II Regulation is applied to noncontractual obligations resulting from civil and commercial matters. Under this Regulation, the first applicable rule to non-contractual obligations arising out of civil liability is the law of the country where the damage occurred. Besides this rule, Rome II regulation has referred to special rules for application to some claims including product liability, unfair competition and restricting measures of free trade, environmental damages, breach of intellectual property and industrial disputes. In the framework of this article the most important features of Rome II Regulation will be reviewed as a set of unified law of conflict of legal rules applicable to non-contractual disputes within the European Union.

    An insurance contract may connect two or more legal systems by virtue of interefering with one or several foreign elements. These systems can involve Iranian or European Union Law. European Union Law indicates Special Direction that contains criteria which determine the Applicable Law on Insurance Contracts. However, Iranian Private International Law has no specific Laws in this regard and consequently, making the general rules of the conflict of laws as the Applicable Law on Insurance Contract. The main rule in this field is Article 968 of the Civil Code. According to the connecting factors of the EU Insurance Directive, the non-life insurance follows the law of the home country of the policy-holder, or in case of the policy-holder being a legal entity, the law of the home country of that particular establishment of legal entity to which the contract relates is applicabale. Life insurance contract follows the law of the Member State of the habitual residence or nationality of the policy holder. The mentioned connecting factors make the law of the country to govern the contract which is most closely connected to the contract. In Iranian legal system, insurance contract of commercial and consumer characteristics shall be distinguished; freedom to choose the applicable law is granted to insurance contract of commercial characteristics. Contract of consumer characteristics must be amended in the regime of Article 968 of the Civil Code and the connecting factors to govern the insurance contract shall be predicted in the mentioned article to which the contract is most closely related. Finally, a logical and acceptable conflict rule in the field of the Applicable Law on Insurance Contract will be proposed to Iranian legislative body.
