    اگرچه هنوز نمی توان با قاطعیت از «قانون اساسی بین المللی» سخن گفت یا فهرست قواعد دستوری بین المللی را احصا کرد، دستورگرایی به عنوان یک رویکرد در خوانش و تفسیر حقوق بین الملل، جایگاه خود را یافته است. چنین فهمی از حقوق بین الملل که کارکرد اصلی ا ش، همچنان تنظیم روابط میان حاکمیت دولت های برابر است، آثاری به دنبال دارد و موجب تحول در ادراک این نظام حقوقی می شود. مطالعه تحلیلی توصیفی حاضر نشان می دهد که خوانش دستورگرایانه، انگاره های سلسله مراتبی حقوق بین الملل را تقویت می کند و ازاین رو، سبب شفافیت و انسجام حقوق برای تابعان می شود و تفسیر قواعد را نیز تحت تاثیر قرار می دهد. به علاوه، هم حاکمیت ملی و هم حکمرانی بین المللی در پرتو قواعد دستوری، با محدودیت های عملی روبه رو می شوند.

    پس از به اجرادرآمدن پیمان لیسبون و گسترش صلاحیت اتحادیه به حوزه سرمایه گذاری خارجی، به دلیل تعارض موافقت نامه های سرمایه گذاری با مقررات اتحادیه، اتحادیه اروپا با مشکلات عدیده ای در برابر دولت های ثالث و حتی میان اعضا روبه رو شد. اتحادیه تلاش کرد مشکلات خود را با دول ثالث از طریق تصویب نامه ای رفع کند و زمینه تداوم اعتبار آن را فراهم آورد. اما در مورد موافقت نامه های میان اعضا، تاکید اتحادیه عمدتا بر اختتام این موافقت نامه هاست. در مقابل، با ارجاع اختلافات به دیوان های داوری و صدور رای این دیوان ها بر مبنای حقوق بین الملل و نه مقررات اتحادیه، این امر موجب اعتراض اتحادیه شد. اوج این واکنش را می توان در قضیه میکولا مشاهده کرد، به گونه ای که کمیسیون اروپا معتقد است اجرای رای داوری به خودی خود، نقض مقررات اتحادیه در قالب کمک دولتی است. اما علی رغم مقاومت کمیسیون اروپا، این رای در چارچوب نظام ایکسید قابلیت اجرا دارد. در مجموع، در این حوزه، مقررات اتحادیه با نوعی خلا مواجه است که نوعی بلاتکلیفی را در مورد سرانجام برخی از موافقت نامه های دوجانبه سرمایه گذاری ایجاد کرده است.

    مزایای متعددی که استفاده از ربات های نظامی در مقایسه با افراد انسانی رزمنده دارند، سبب شده است تا این ربات ها به طور گسترده در مخاصمات مسلحانه مورد استفاده قرار بگیرند. گروهی از این ربات ها که می توانند بدون این که از سوی عامل انسانی هدایت شوند، عمل نمایند، ربات های نظامی خود فرمان هستند. این ربات ها هنوز چنین قابلیتی پیدا نکرده اند تا بتوانند قواعد حقوق بین الملل بشردوستانه از جمله اصل تفکیک و اصل تناسب را به طور کامل رعایت نمایند. با توجه به نقش افراد متعدد از جمله تولید کننده، طراح، برنامه نویس و فرمانده جنگی در اقدامات این ربات ها، نظریه هایی در خصوص مسووایت مطلق آنها، مسوولیت مشترک آنها با افراد مزبور و مسوولیت مطلق افراد ارایه شده است. در حال حاضر و به سبب تبعیت کامل این ربات ها از برنامه ای که برای آن ها نوشته می شود، تنها می توان مسوولیت انسان را در قبال اعمال آن ها پذیرفت. لذا، علی رغم پذیرش مسوولیت اولیه شخص به کار گیرنده این ربات ها، انتساب رفتار آنها اصولا بر اساس رابطه سببیت میان آن رفتار و عامل ایجاد آن اعم از برنامه نویسی نادرست یا ویژگی مکانیکی ربات انجام می گیرد.

    مبنای حقوقی داوری در دعاوی سرمایه گذاری معمولا معاهده دوجانبه، چندجانبه یا قرارداد سرمایه گذاری است. برخی از این معاهدات، تنها اختلافاتی را دربرمی گیرند که مربوط به تعهدات ناشی از خود معاهده باشد، یعنی صرفا دعاوی ناشی از تخلفات عهدنامه ای. اما برخی دیگر از معاهدات سرمایه گذاری با ایجاد تعهد در سطح حقوق بین الملل، سعی دارند دولت میزبان را به رعایت هرگونه تعهد لازم الاجرا در رابطه با سرمایه گذاری های خارجی ملزم کنند. چنین مقرره و مقررات مشابه در اصطلاح، «شرط فراگیر» نامیده می شود، هرچند با نام های دیگری نیز به کار رفته است. شروطی از این دست به منظور حمایت مضاعف از سرمایه گذار و پوشش قراردادهای سرمایه گذاری میان کشورهای میزبان و سرمایه گذاران خارجی، در معاهدات دوجانبه سرمایه گذاری با عبارات مختلفی گنجانده می شوند. ازاین رو مراجع داوری در برخورد با این شروط، تفاسیر متفاوتی ارائه کرده و گاهی به نتایج متعارضی دست یافته اند. این مطالعه، مروری بر خاستگاه و اهمیت عبارت پردازی این شرط در معاهدات سرمایه گذاری دوجانبه خواهد داشت؛ سپس به اثر، قلمرو و شرایط اعمال آن در رویه تفسیری داوری ایکسید می پردازد و در صدد است تا بر مبنای تفسیر مضیق یا موسع از شرط فراگیر، رویه داوری ایکسید را تحلیل کند.

    حق بهره برداری از اموال خارج از حاکمیت دولت ها به اشخاص خصوصی بر اساس دیدگاه حقوق طبیعی، حقوق بشری در قالب برخورداری بشر از مواهب طبیعت، واگذار شده است. دریاهای آزاد، جو، ماورای جو و قطب جنوب از مصادیق مناطق خارج از حاکمیت دولت ها به حساب می آید که منابع ماهی، معدنی، مدار ماهواره ای، انتفاع در زمینه حمل و نقل و جانداران خشکی را در خویش جای داده و به عنوان مصادیق قابل بهره برداری توسط اشخاص خصوصی به حساب می آید. سازوکار بهره برداری اشخاص خصوصی عموما از کانال دولت ها و با حمایت و مسئولیت آن ها می گذرد و دولت ها نظارت لازم را روی اشخاص متبوع خویش دارند. بعلاوه نهادهای بین المللی معین وظیفه اعطای مجوز جهت بهره برداری اشخاص خصوصی و همچنین نظارت بر فعالیت این اشخاص و دولت های متبوع را داشته و اشخاص خصوصی مکلف به رعایت نظامات بین المللی و دولتی در راستای این بهره برداری هستند.

    نظام حقوقی ایران همانند بعضی کشورهای دیگر، در خصوص برخی جرایم مواد مخدر، مجازات اعدام را پیش بینی کرده است. از طرف دیگر، کشورهای بسیاری یا به کلی این مجازات را لغو کرده یا در مورد جرایم مواد مخدر اعمال نمی کنند. سوال اصلی مقاله این است که آیا سیاست کیفری ایران در این رابطه بر اساس موازین حقوق بین الملل بشر است یا خیر؟ در نهایت، مطالعات این نتیجه را در پی دارد که مقررات حقوق بین الملل بشر با محوریت میثاق بین المللی حقوق مدنی و سیاسی، مجازات اعدام را جز در موارد بسیار استثنایی، در خصوص «شدیدترین جرایم» و با جمع شرایطی خاص نمی پذیرد. در خصوص جرایم مواد مخدر نیز تحقیقات نشان داد که این دسته از جرایم در زمره جرایم شدید و مهم قرار نمی گیرند و در نتیجه، مجازات اعدام در مورد آن ها قابل اعمال نیست. بر این اساس، ضرورت حذف مجازات اعدام از نظام حقوقی ایران، منطبق با تعهدات بین المللی و حقوق بشری این دولت خواهد بود. همچنین این امر در انطباق بیشتر با مبانی فقهی قانونگذاری و مبانی قانون اساسی به نظر می رسد.

    حفظ شان و منزلت انسانی ابنای بشر، مستلزم تضمین آزادی ها، امتیازها و حقوقی برابر برای افراد و همچنین ایجاد تعهداتی سلبی و ایجابی برای تابعان حقوق بین الملل و تاسیس نهادهایی است که ناظر اجرای این حقوق باشند. اما شرط تحقق بسیاری از این حقوق و آزادی ها، برخورداری و بهره مندی از حق بر حداقل رفاه اجتماعی است. پرسش این است که در حقوق بین الملل، چه چیزی به عنوان حق بر حداقل رفاه، شناسایی شده و محتوا و عناصر آن چیست و چه نسبتی با سایر حق های بشری دارد و ارزش هنجاری قواعد ناظر بر آن ها در میان سایر قواعد حقوق بین الملل تا چه حد است. گرچه در متون و اسناد حقوقی بین المللی به صراحت از عبارت حق بر حداقل رفاه اجتماعی سخن به میان نیامده، با مطالعه اسناد حقوق بشری و توجه به دکترین به نظر می رسد عناصر این حق، ازجمله حق بر غذا، مسکن، پوشاک، بهداشت و تامین اجتماعی پیش از این در حقوق بین الملل شناسایی شده اند. به نظر می رسد برخی از عناصر سازنده آن، تا حد قواعد آمره بین المللی اعتلا پیدا کرده اند.

    یکی از مشکلات اساسی دیوان کیفری بین المللی در مواجهه با مسئله داعش، قدرت اعمال صلاحیت آن است. دیوان، صلاحیت رسیدگی به جرایمی را داراست که: 1 دولت عضو، بر اساس ماده 14 وضعیتی را به آن ارجاع دهد. 2 شورای امنیت طبق فصل هفتم منشور، وضعیتی را به دیوان ارجاع دهد. 3 دادستان بر اساس ماده 15 به ابتکار خود، پس از حصول اطلاع از وقوع جرایم موضوع صلاحیت دیوان، تحقیقاتی را آغاز کند. به علاوه، عراق و سوریه اساسنامه دیوان را تا کنون امضا ننموده و عضو دیوان نشده اند. عدم همکاری دولت های عضو می تواند سد محکمی در مقابل تعقیب اعضای داعش در دیوان کیفری بین المللی باشد. لذا تنها گزینه در پیگیری و تعقیب داعش، سازوکار شورای امنیت سازمان ملل متحد خواهد بود. بنابراین، قابلیت یا عدم قابلیت تعقیب سران گروه تروریستی داعش در دیوان کیفری بین المللی و چالش های موجود در خصوص تعقیب آن ها در این دیوان بررسی می شود.

    در اساسنامه دیوان کیفری بین المللی، معیارهایی مقرر شده که بررسی هر وضعیت اتهامی، مستلزم احراز آن هاست. این معیارها، هم برای دادستان و هم برای شعب مقدماتی محدودیت هایی ایجاد می کند تا آرمان تاسیس دیوان که رسیدگی به شدیدترین جنایات بین المللی است، برآورده شود. این معیارها بر مدار معقولیت بنیان نهاده شده است؛ به این معنا که باید مبنا یا قرائن معقولی باشد تا بتوان مظنونی را به دادستانی معرفی یا به شعب مقدماتی احضار کرد. انتظار به جا و صحیح از معقولیت رویه دیوان، مستلزم روشن بودن مفهوم این معیارها و وضوح معیار معقول بودن است. موضوع این پژوهش تفسیری تحلیلی، بررسی این معیارها از نظر مفهوم معقول بودن، از ابتدای شروع بررسی مقدماتی تا تایید اتهام شخص مظنون نزد شعب مقدماتی است. نتیجه اینکه مضامین حقوقی مندرج در اساسنامه که واضح نباشد، موجب بروز تفاسیر مختلف و احیانا منتهی به صدور آرای متهافت می شود و مقبولیت دیوان را با چالش مواجه می کند.

    شورای امنیت که به استناد منشور ملل متحد، مسئول اولیه حفظ صلح و امنیت بین المللی است، برای مجازات جانیان بزرگ بین المللی به منظور حفظ یا تثبیت صلح، محاکم کیفری بین المللی نظیر دیوان های کیفری بین المللی یوگسلاوی سابق و رواندا را تشکیل داده است. دیوان کیفری بین المللی نیز به منظور مبارزه با بی کیفری جانیان بزرگ تشکیل شده است. وظایف متداخل این دو نهاد و غفلت شورای امنیت از مسئولیت اولیه خود در منشور، زمینه مداخله شورا در دیوان مذکور و عدم تحقق عدالت کیفری بین المللی را فراهم نموده و رویه عدالت مبتنی بر تبعیض را در حوزه حقوق بین الملل کیفری استمرار بخشیده است. این مقاله، ضمن مطالعه و بررسی روابط بین دو نهاد بین المللی مذکور، به این نتیجه رسیده است که روابط شورا و دیوان کیفری بین المللی به جای مداقه در عدالت کیفری بین المللی، سیاست و صلح و امنیت بین المللی را مدنظر دارد.

    تئوری بازی در حقوق بین الملل، یکی از دیدگاه های نو و بدیع در زمینه فلسفه حقوق بین الملل است. تفاوت این دیدگاه در آن است که به جای نظریه پردازی صرف، به دنبال شرح منطقی و عملی قواعد و ساختارهای حقوقی بین المللی است. در این دیدگاه برای استدلال علمی و بیان چارچوب های نظری از قواعد تئوری بازی استفاده می شود. تئوری بازی اولین بار در سال 1944 از طرف ریاضی دان جان ون نیومن و با همراهی اقتصاددانی به نام اسکار مورگن اشترن در زمینه مسائل اقتصادی مطرح شد. ولی از آن زمان تا کنون به تدریج وارد عرصه های علمی دیگر، ازجمله روابط بین الملل، جامعه شناسی و سایر رشته های علمی نیز شده است. در سال های اخیر و برای اولین بار در حقوق بین الملل، دو اندیشمند بزرگ، جک گلد اسمیت و اریک پاسنر با استفاده از این تئوری، چگونگی تشکیل و علت رعایت عرف های بین المللی را توضیح داده اند. این امر به عنوان رهیافت جدید، توجه محققین حقوق بین الملل را کاملا به خود جلب کرده است. این مقاله به دنبال توضیح ساختار حقوقی سازمان جهانی تجارت از منظر این تئوری است. نویسندگان بر این باورند که یافته هایشان به درک بهتر ساختار حقوقی این سازمان خواهد انجامید. به این منظور، ابتدا قواعد مورد نیاز تئوری بازی معرفی و مختصرا توضیح داده می شود و بعد از آن از منظر مطالب اشاره شده، موارد و موافقت نامه هایی از مجموعه کل سازمان جهانی تجارت، بررسی و به طور منطقی اثبات می شود که در حالت کلی قابل تسری به تمام ساختار حقوقی این سازمان است.

    به موازات پیشرفت علم، شیوه های جدید حمل و نقل ابداع شد. یکی از رایج ترین شیوه ها، حمل و نقل چندوجهی است که به ویژه در حمل و نقل کالا به کار می رود. سوال مهم در مورد این شیوه این است که قانون حاکم بر حمل و نقل چندوجهی کالا کدام است؟ فقدان قانون یکنواخت بین المللی در خصوص حمل و نقل چندوجهی و همچنین فقدان مقررات ملی مرتبط در بسیاری از نظام های حقوقی، چالش اساسی در پاسخ به این سوال ایجاد کرده است.
    مقاله حاضر، اعمال سیستم شبکه ای و استفاده از مقررات کنوانسیون های یک وجهی را به عنوان راه حل پیشنهاد می کند. البته در مواردی هم پوشانی ها و تعارض هایی میان قواعد این کنوانسیون ها مشاهده می شود که اعمال قواعد حل تعارض مندرج در کنوانسیون های یک وجهی و قواعد مقرر در ماده 30 کنوانسیون وین راجع به حقوق معاهدات، راه گشاست. همچنین، استفاده از قراردادهای استاندارد در حمل و نقل چندوجهی در چارچوب قانون حاکم، مانع بروز برخی تعارض ها می شود.

    در هر دعوای بین المللی، تعیین قانون حاکم، از مسائل اولیه حل دعواست. تعیین قانون حاکم در هر دعوا روش های خاصی دارد. این روش ها در حقوق بین الملل خصوصی مهم تر و پیچیده تر است. دعاوی مربوط به حقوق مالکیت فکری نیز از این قاعده مستثنا نیست. در این حقوق نمی توان به صرف جنبه مالی دعوا، از قواعد سنتی حل تعارض مربوط به اموال بهره برد. این مال از اقسام اموال غیرمادی بوده و همین ویژگی، پیچیدگی بیشتری را ایجاد می کند. ایجاد حق، انتقال حق، نقض حق و حمایت از حق در این حقوق، روش ها و قواعد خاصی را برای تعیین قانون حاکم اقتضا دارد. در این تحقیق نشان داده خواهد شد که در کنار قاعده کلی و سنتی حکومت قانون محل وقوع مال، قواعد دیگری همچون قانون محل حمایت، قانون محل نقض، قانون کشور متبوع پدیدآورنده و غیر آن نیز در دعاوی مربوط به این حقوق، کاربرد دارند و نشان می دهند که ورود و حل دعاوی این حوزه، به مهارت و توانایی های بیشتری نیاز دارد.

    Although it is not possible now to have a claim on the existence of an “international (codified) constitution” or a decisive list of international constitutional rules, constitutionalism as an approach for reading and interpretation of the international law has developed its foundation. Such understanding of the international law – that its main function is the regulation of relations between equal sovereign States - leads to the evolution of perception of this legal system. This analytical–descriptive study shows that constitutional reading promotes hierarchical tenets of international law and so, causes transparency and integrity for its subjects and affects the interpretation of the rules. Furthermore, both national sovereignty and international governance face practical constraints in the light of constitutional rules.

    After entry into force of the Lisbon Treaty and extension of Jurisdiction European Union to foreign investment, certain conflict between investment agreements and EU rules come to light, which caused difficulties to third states and even to EU member States. The European Union tried to resolve the problem with third countries through a specific Regulation. However, with respect to the investment treaties concluded between the members States, the European union made its mission to terminate these treaties. On the other hand, reference of investment disputes to arbitration involving EU member States, has led to decision by the respective arbitral tribunals on the basis of international law rather than EU Law. This has Caused, Opposition by the EU institutions. The strongest of these reaction was made in the Micula Case. The European Commission Expressed the view that the enforcement of the arbitration award was unlawful as it constituted state aid, which is prohibited under the EU law. However, despite the European Commission’s Opposition, the award remains enforceable under the ICSID system. In summary, the EU law in this area contains ambiguities and is capable of generating uncertainty as to the fate and enforceability of bilateral investment treaties.

    The multiple benefits of military robots compared with human combatants have caused these robots to be widely used in armed conflicts. Some of these robots that can act without remote control are Autonomous Military Robots. These robots have yet to find such a feature to totally observe rules of International Humanitarian Law such as the principle of discrimination and the principle of proportionality. According to the roles of multiple persons including producer, designer, programmer and warlords with respect to the actions of the robots, theories about their absolute responsibility, shared responsibility and absolute responsibility of persons have emerged. Due to the robot's full compliance with the program for which they are written, only human responsibility could be accepted for their actions. Therefore, despite the acceptance of primary responsibility of the person that uses robots, attribution of their conduct is generally based on the causal relationship between behavior and its cause of creation including incorrect programming or mechanical features of the robot.

    Investment arbitration usually has its legal basis in the bilateral investment treaty (BIT), regional or multilateral treaties or in an investment contract. Some treaties cover only disputes relating to obligations under these kinds of agreements, i.e. only for claims of treaty violations. Some others create an international law obligation, according to which the host state shall observe any binding obligation with respect to investments. These and other similar provisions are commonly called “umbrella clause”. Although other formulations have also been used,Clauses of this kind have been put into treaties to provide additional protection to investor and are directed for covering investment agreements that host countries frequently conclude with foreign investors. In most of the investment treaties, the umbrella clauses are not always with the same wording, so arbitral tribunals have given different interpretations and reached conflicting conclusions. This study gives an overview of the origin and significance of the wording of this Clause in BITs, then looks at the effect, scope, and conditions of application of the Clause as interpreted by ICSID arbitral tribunals and tries to analyze ICSID arbitral jurisprudence on the basis of restrictive or extensive interpretation of the Clause.

    The right of exploitation of objects outside of States’ sovereignty is granted to private persons based on natural right and human right in form of enjoyment of the blessings of nature. High Seas, Atmosphere, Outer Space, and Antarctica are the examples of areas situated outside of States’ sovereignty. Fish stocks, mineral resources, satellite orbits, transit benefits,and land animals are the resources and benefits of these areas. The exploitation mechanism of private persons including natural and legal persons is generally directed through States’ channel and States shall supervise their nationals. In addition, specific international entities such as the International Seabed Authority (ISBA) have the authorization to issue the licenses of exploitation to and supervision on the States and its natural and legal persons. Such persons shall meet the international and national regulations related to such exploitation.

    Iran legal system like some other legal systems recognizes and applies the death penalty for drug-related offenses. On the other hand, many States have abolished the death penalty in their laws or practice or at least do not apply it in cases relating to drug-related offenses. So, the main question of this article is whether or not Iran’s criminal policy in this regard is compatible with international human rights norms. Present studies show that under international human rights law, especially under the International Covenant on Civil and Political Rights, the application of capital punishment, while not prohibited, is restricted in exceptional ways. The death penalty may be imposed only for the most serious crimes under some requirements. The studies show that drug-related offenses do not have exceptional feature and they are not an instance of “most serious crimes”, and so could not be subject to capital punishments. Thus, Iran has to abolish the death penalty for drug-related offenses in the light of its international and human rights obligations which would be more compatible with constitutional and Islamic foundations of its own legislation.

    Protection of human dignity requires guaranteeing freedoms, privileges and equal rights for individuals and the imposition of positive and negative obligations on members of international community and the establishment of human rights bodies for monitoring implementation of those rights. However, enjoinment of a minimum level of social welfare is the precondition to realizing the guaranteed rights. This article seeks to answer the questions as to the recognition, content, and elements of the right to the minimum level of social welfare, as well as its normative place among rules of international law. An overview of international human right law instruments and scholarly thoughts reveals that certain elements of the right have already been recognized in international law i.e. the right to food, housing, health, clothing, and social security, although the expression of "right to social welfare" is not referred to in human rights instruments. It seems that the rules governing certain elements of such a right have found their way to become jus cogens.

    One of the main impediments of the International Criminal Court in dealing with the issue of the so-called Islamic State of Iraq and al-Sham/Greater Syria ("ISIS" aka "ISIL", "Daesh" or "IS") is its power to exercise jurisdiction. The Court has jurisdiction to deal with crimes as follows: 1- A State Party refers the situation to the Court pursuant to Article 14. 2- If under Chapter VII of the UN Charter, the Security Council refers a situation. 3- If, according to Article 15, the prosecutor, on his own initiative, opens an investigation upon notification of the crime subject to the jurisdiction of the Court. Furthermore, since Iraq and Syria are not Parties to the Rome Statute, the lack of co-operation could hinder the pursuit of ISIS members before the International Criminal Court. Thus, the only possible option in the prosecution of ISIS could be the United Nations Security Council. This paper aims to study the question of possibility or predictability of investigating this terrorist group leaders before the International Criminal Court and challenges facing such an investigation.

    In the Statute of ICC, several criteria have been stipulated that the process of examination of any case requires their verification. These criteria establish limitations on the prosecutor and pre-trial chambers in order to fulfill ideals and purposes of establishment of ICC that is addressing the most serious international crimes. These criteria have been established based on reasonableness; there should exist a reasonable basis or ground so that suspected person be introduced before the prosecutor or be summoned to the pre-trial chamber. A legitimate expectation of ICC procedure reasonableness requires clarification of the challenging concept of the reasonableness. The objective of this study is to investigate these criteria in view of the concept of reasonableness, from initiation of the preliminary examination to confirmation of charges of the suspected person before the pre-trial chamber. This article concluded that if legal concepts contained in the Statute of the ICC are not clear, it probably leads to different interpretations and the issuance of contradictory verdicts which in turn challenges the credibility of ICC.

    Under the UN Charter, the Security Council is the primarily responsible organ for keeping international peace and security. For this end, it has taken a variety of actions, one of which is the establishment of international criminal courts such as the International Criminal Tribunal for the Former Yugoslavia and International Criminal Tribunal for Rwanda. The purpose of these courts is to punish international criminals to maintain or stabilize peace. In addition, International Criminal Court has been established to combat impunity of great criminals. Overlapping functions of these two, on the one hand, and the dependency of International Criminal Courts on States and the Security Council together with the negligence on the part of the Security Council in its primary responsibility given by the Charter, on the other, underlie the interference of the Security Council in jurisdiction of the mentioned courts and lead to the non-realization of international criminal justice and the perpetuate continuation of justice practice based on discrimination in international criminal law. This article aims to study the relationship between these two important international institutions and has come to this conclusion that in their interrelationship, the priority is given to the promotion of international peace and security over universal criminal justice.

    Game theory in international law is one of the innovative perspectives in the field of philosophy of international law. The disinctive nature of this perspective is that instead of merely theorizing, it has a goal to explain international rules and structure in a logical and practical manner. In 1944, in the field of economy, this theory was proposed for the first time by von Neumann, a mathematician, in partnership with Morgenstern, an economist. But since then, it has gradually entered into other academic fields such as international relations, sociology, etc. In recent years, for the first time in international law, two great researchers namely Jack L. Goldsmith and Eric A. Posner, applying this theory, have explained the manner of formation and due respect of international customs. In international law, this issue has been considered as a new approach and has successfully drawn attention to its own. In this article, it has been tried to analyze the legal framework of the World Trade Organization (WTO) from the perspective of this theory. It is believedthat our findings in terms of game theory help researchers to understand the framework of that organization more easily.The research methodology used in this article is analytical. For this purpose, the required rules from game theory are introduced and briefly explained and then from the perspective of what was said, we will survey a number of items and agreements from the total collection of WTO and will prove a logical stand that will be applicable to the whole legal framework of WTO.

    With the advent of science, new transport modes have been developed. One of the most common of these modes is international multimodal transport which is used especially in the transport of goods. The important issue regarding this mode is the applicable law governing multimodal transport. The non-existence of an international uniform law and the non-existence of internal laws in many legal systems concerning multimodal transport have resulted in a fundamental challenge in international transport law. This essay suggests an application of the network system and the use of existing unimodal conventions’ regulations as a solution. Although in some cases, there are some overlaps and conflicts among these conventions’ rules, the application of conflict of laws’ rules in some unimodal conventions and regulations in Article 30 of 1969 Vienna Convention on the Law of Treaties can be useful. In addition, using the standard contracts within the framework of applicable law in multimodal transport may prevent some conflict of laws.

    In every international claim, the governing law needs to be determined. To determine the governing law, special methods are usually used which become more important and complicated in the private international law. Intellectual property claims are not exempt from this procedure. However, in these claims, it is impossible to merely use conventional conflict of laws rules on properties to determine the governing law. Intellectual Property (IP) rights are considered as intangible property and for having such characteristics, it becomes more difficult to determine the governing laws in these claims. Creation of rights, transfer of rights, breach of rights and protection of rights in the IP law needs special rules for determining the governing law. In this research, it will be shown that along with the conventional rules of determining the governing laws in property claims,thereare other specific rules such as the lex originis, lex delictis, the national law of the creator and other laws that can be used in these cases, and it needs more expertise and knowledge of these rules to settle these cases.
