    دیوان کیفری بین المللی ساختار حقوقی نوینی برای تعقیب مرتکبین جرایم بین المللی و ناقضان حقوق انسان هاست. این ساختار حقوقی، علاوه بر وجود محاکم داخلی کشورها، متضمن ایجاد صلاحیت رسیدگی برای مرجع رسیدگی بین المللی است؛ به همین سبب این دیوان دارای صلاحیت تکمیلی است که مبین نوعی هماهنگی و پویایی در ساختار قضایی و تقنینی نظام های ملی است تا دولت ها بتوانند اولویت اعمال صلاحیت خود را در رسیدگی و تعقیب جرایم بین المللی محفوظ دارند. علی رغم آنکه به عمر این دیوان، اکنون اندکی زود است تا کارنامه این مرجع قضایی بین المللی را قضاوت صحیح کرد، مواضع دولت ها در روند رسیدگی های این دیوان به برخی قضایا تامل برانگیز است؛ به گونه ای که به خصوص مواضع دولت های آفریقایی و به تبع آن اتحادیه آفریقا، دربردارنده زمزمه هایی مبنی بر عدم همکاری، تهدید به خروج از اساسنامه دیوان و متعاقب آن توسعه صلاحیت دیگر مراجع قضایی یا حتی تاسیس مرجع کیفری مستقل است؛ مواضعی که به تضعیف دیوان و چه بسا صعوبت تحقق عدالت کیفری در جامعه بین المللی بینجامد.

    احزاب سیاسی در نظام های مردم سالار معاصر از نهادهای اساسی اند که کارویژه های متعددی چون انتقال مطالبات مردم به حکومت، متشکل کردن افکار پراکنده، معرفی نامزدهای انتخاباتی و تدوین برنامه حرکت آینده حکومت را بر عهده دارند. در دهه های اخیر به دلیل بی رغبتی مردم به عضویت حزبی و کمک به این نهاد، منابع مالی آن ها به شدت کاهش یافته است. تامین مالی احزاب از منابع دولتی به منزله بدیل یا جایگزین معرفی شده است، اما این امر مخالفان سرسختی دارد. مقاله حاضر ضمن معرفی برنامه های مستقیم و غیرمستقیم تامین عمومی احزاب و بیان نظرهای موافق و مخالف به شیوه توصیفی و تحلیلی ضرورت و مبانی حقوقی تامین عمومی احزاب را بررسی کرده است. یافته ها حاکی از آن است که حمایت و حراست از حقوق بشر، مشروعیت حکومت و کارآمدی آن مستلزم کمک دولتی به احزاب است.

    به نظر حقوق دانان «برجام» را هم می توان موافقت نامه ای بین المللی و تفاهم نامه ای غیرالزام آور تلقی کرد و هم برای آن ماهیتی غیر از معاهده در نظر گرفت. برای پاسخ به این پرسش که برجام معاهده بین المللی است یا صرفا یک تفاهم سیاسی بین جمهوری اسلامی ایران با گروه 1+5، از یک سو باید به متن 167 صفحه ای برجام مراجعه کرد و از سوی دیگر باید قواعد حاکم بر حقوق بین الملل و قوانین کشورهای مذاکره کننده را مورد توجه قرار داد. هرچند در متن برجام سخنی از معاهده بودن آن به میان نیامده است، اما با مراجعه به حقوق داخلی و بین الملل، می توان آن را موافقت نامه بین المللی به حساب آورد. دولت ایالات متحده امریکا قبل و بعد از رسانه ای شدن متن برجام و بعد از آنکه از مجاری قانونی دو کشور -کنگره امریکا و مجلس شورای اسلامی ایران- به سلامت عبور کرد، اصرار دارد که برجام یک معاهده بین المللی نیست و نمی توان برای آن اعتبار حقوقی مبرهنی در نظر گرفت. مقامات دستگاه دیپلماسی کشور نیز ادبیاتی مشابه دولتمردان امریکایی اتخاذ و تاکید کرده اند؛ آنچه اتفاق افتاده، یک تفاهم نامه است و نه یک موافقت نامه الزام آور که کشورهای طرف مذاکره را در چالشی به نام «ضمانت اجرا» تحدید کند. در این مقاله ضمن مداقه در ارتباط بین قطعنامه 2231 شورای امنیت و برجام، بررسی خواهد شد که چرا سند برجام را باید یک موافقت نامه بین المللی به حساب آورد. همچنین، در این مقاله ماهیت برجام بررسی و با استدلالات حقوقی بر این امر که این سند یک موافقت نامه سیاسی یا نزاکتی است تاکید خواهد شد.

    به رغم تورم هنجاری در بعد حقوق بشر و حقوق بشردوستانه، جهان امروز شاهد نقض گسترده این حقوق است. شاید بتوان عامل اصلی آن را در نبود سازوکارهای کارآمد و مناسب به منظور رعایت و احترام به حقوق مذکور جستجو کرد. اتحادیه آفریقایی در اوایل قرن 21 اصل عدم بی تفاوتی را بنیان گذاری کرد تا به کمک عملی مردمان در معرض نقض فاحش حقوق بشر و بشردوستانه بشتابد. اصلی که همگام با اصل مسئولیت حمایت شکل گرفت تا پاسخگوی نیازهای اجتماعی قاره آفریقا باشد. پژوهش حاضر بر آن است تا با شیوه ای اکتشافی ضمن تبیین عناصر اصل عدم بی تفاوتی و قیاس آن با سایر اصول و دکترین های مشابه یا به ظاهر متضاد به این پرسش اساسی پاسخ دهد که آیا اصل عدم بی تفاوتی جایگزینی برای اصل عدم مداخله است؟

    بیش از 50 سال از عمر تدوین در نظام حقوقی ایران می گذرد، اما هنوز در عرصه های مختلف این برنامه، دچار آسیب های جدی هستیم. یکی از این آسیب ها، خلط میان دو مفهوم کلان (تدوین) و خرد (تنقیح) و تلاش برای همسنگ پنداشتن آن دو است. درواقع، در ادبیات حقوقی و نظام قانون گذاری کشور به تناوب گاه از تنقیح و تدوین و گاه از تدوین و تنقیح سخن گفته می شود. حال آنکه مطالعات ریشه شناختی و نگاهی به تجربه سایر کشورها و ادبیات حقوق تطبیقی نشان می دهد که بهترین ترجمه برای لفظ کدیفیکاسیون، لفظ تدوین است. تنقیح صرفا بخشی از برنامه کلی تدوین است که به شناسایی زوائد و فضولات قوانین و مقررات می پردازد. حال آنکه برنامه تدوین شامل بخش های دیگری همچون نظام مندکردن قواعد حقوقی در یک حوزه خاص و ایجاد انسجام در کل نظام حقوقی است.

    دولت اسلامی عراق و شام یا همان داعش، یک سازمان تروریستی سیاسی و نظامی است که از سال 2014 به طور چشمگیری تیتر رسانه ها شد. این گروه که حضور گسترده ای در عراق و سوریه دارد، با تشکیل خلافت اسلامی به رهبری ابوبکر البغدادی، یک دولت اسلامی را به مرکزیت شهر الرقه در 29 ژوئن 2014 ایجاد کرد. بعد از تشکیل این خلافت و آغاز اقدامات سختگیرانه و گسترده در مناطق تحت تصرف و با ادامه حملات و پیشروی به شهرهای مختلف در سوریه و عراق و به دنبال واکنش مجامع بین المللی از جمله شورای امنیت نسبت به این گروه تروریستی، طرح تشکیل ائتلافی بین المللی از سوی ایالات متحده امریکا برای مبارزه با داعش مطرح شد. با گذشت بیش از یک سال از عمر این ائتلاف، بررسی نوع مخاصمه در عراق بعد از ورود نیروهای ائتلاف و مبنای حقوقی حضور ائتلاف در عراق مفید به نظر می رسد. تحقیقات و بررسی ها نشان دهنده این است که اصل ورود ائتلاف در عراق، از لحاظ بین المللی غیرقانونی نبوده است.

    تبلیغات انتخاباتی در نظام جمهوری اسلامی ایران نتوانسته است به یک مدل شایسته و الگوی بومی دست یابد و به ویژه، وعده محوری، به یک رویه عمومی در انتخابات تبدیل شده است. هرچند در میان فقها در لزوم یا عدم لزوم وفا به وعده ها اختلاف وجود دارد، به نظر می رسد ادله طرفداران لزوم وفای به وعده در موضوع وعده های انتخاباتی پسندیده تر باشد. البته قوانین و مقررات خاص و ویژه ای نیز برای مقابله با این معضل تبلیغاتی پیش بینی نشده است، اما برخی اصول قانون اساسی یا برخی بندهای سیاست های کلی نظام در امر انتخابات نیز می توانند مبنای حقوقی مقابله با وعده های دروغین انتخاباتی و لزوم عمل به وعده های قانونی باشند. همچنین، ضمانت اجراهای موردنظر در این مورد باید در شرایطی خاص و بدون هرگونه سوء استفاده و تحت نظر اصل حاکمیت قانون و در قالب یک فرایند قضایی یا شبه قضایی و طی یک بررسی کاملا مستند و مستدل همراه اصول و قواعد دادرسی منصفانه باشد.

    سازمان های بین المللی از ابزارهای نیرومندی برای اجرای تصمیمات شورای امنیت برخوردارند. این سازمان ها به منظور مشارکت در روند اجرای تصمیمات شورای امنیت، به مبانی حقوقی خاص آن نیاز دارند. از جمله مبانی حقوق مشارکت سازمان ها ی بین المللی می توان به دو دسته کلی اشاره کرد: 1. قواعد سازمان بین المللی و 2. مقررات منشور ملل متحد. دسته نخست شامل اساس نامه سازمان های بین المللی، رویه، اختیارات ضمنی و دسته دوم شامل مقررات فصل هفتم (بند 2 ماده 48) و هشتم منشور از جمله مبانی ورود سازمان های بین المللی برای اجرای تصمیمات شورای امنیت است.

    «نظریه حقوق بین الملل» در پی بررسی خاستگاه قواعد، نهادها و رویه هایی است که حقوق بین الملل بر مبنای آن ها ایجاد می شود. به همین دلیل است که «نظریه» در حقوق می تواند دست کم به برخی از رویه ها و قواعد مشروعیت بدهد و موارد دیگر را بدون مشروعیت باقی گذارد. از این منظر، «نظریه لیبرالی حقوق بین الملل» در حقوق بین الملل جایگاهی مهم دارد. به گواهی مطالعات گوناگون، این نظریه در برآمدن رویکرد «صلح آمیز» در حقوق بین الملل و کنارزدن رهیافت های کلاسیک در این حوزه نقش به سزایی داشته است که عمدتا سخنی جز «مشروعیت جنگ» نمی شناختند. با وجود این، دقت در مولفه های ساختاری این نظریه، به خوبی این حقیقت را فاش می کند که نظریه لیبرالی حقوق بین الملل در همان حالی که به تحقق رویکرد «صلح آمیز» در حقوق بین الملل کمک کرده است، بسترهای قابل اعتنایی را به منظور توجیه به کارگیری «زور» یا به عبارت دیگر تساهل نسبت به «جنگ» فراهم می کند. این مقاله تلاش می کند تا این دوگانگی ها یا تناقض ها را در نظریه لیبرالی حقوق بین الملل بررسی کند.

    یکی از مواردی که در حوزه حقوق بشر بسیار محل بحث و مجادله است، نظریه اضطرار است. براساس این نظریه، اعمال بعضی حق های فردی در شرایط بحرانی پدید آمده در جامعه، می تواند امنیت عمومی را به مخاطره بیندازد که از این رو، دولت باید به طور موقت، حق بعضی افراد را به اجبار سلب کند . این مسئله به دو دلیل تامل برانگیز است: 1. اولویت قراردادن امنیت عمومی بر حق فردی و 2. توجیه سلب حق افراد به دلیل مخاطره امنیت عمومی در شرایط اضطرار. موارد مذکور، مسائل چالش برانگیزی است که محل بحث و مجادله اند. اساسا این نظریه می تواند موجبات سوء استفاده از قدرت و استبداد حاکمیت در جهت نقض حق های فردی را پدید آورد. در این مقاله دیدگاه های مختلف مدافعان نظریه اضطرار بررسی می شود تا مبنای قانع کننده ای برای توجیه سلب حق فردی یافته و حدود اختیار دولت در این زمینه مشخص شود.

    تعهد دولت‏ها در تضمین حق تامین اجتماعی امروزه در اسناد بین المللی و غالب نظریات حقوقی پذیرفته شده است. اما درخصوص اینکه ماهیت تعهد دولت‏ها در تضمین این حق صرفا داخلی و ملی است یا علاوه بر آن دولت ها تعهد بین المللی نیز دارند، اختلاف نظر وجود دارد. در این مقاله سعی بر آن است که ماهیت تعهد دولت‏ها (داخلی و بین المللی) در تضمین حق تامین اجتماعی در اندیشه جان رالز شناسایی شود. قراردادگرایی جان رالز به منزله یکی از مبانی توجیهی حق‏های بشری، تعهدات دولت‏ها را در تضمین این حق بررسی می‏کند. رالز در تضمین این حق به تعهدات داخلی یا بین المللی دولت‏ها رویکرد یکسانی ندارد. به این معنا که در قراردادگرایی او تعهد دولت‏ها در تضمین حق بر تامین اجتماعی در سطح داخلی پذیرفته شده، اما تعهد بین المللی آن‏ها در ماهیت و روش‏ها دارای ابهام است. با این حال به نظر می رسد در شرایط خاص، رالز مساعدت های محدود در سطح بین المللی را نه الزامی بلکه جایز می‏داند.

    پیشرفت فناوری در قرن 21 در حال رونمایی از شکل دیگری از سلاح های پرنده نظامی است که هواپیماهای بدون سرنشین مصداق بارز آن ها به شمار می روند. نظر به اینکه کاربرد این نوع از سیستم های هوابرد چالش های جدی را از منظر حقوق بین الملل بشردوستانه موجب شده است، ارزیابی مستقل حقوقی در این خصوص ضروری است. پیش از بررسی دقیق این مسئله شناخت این سیستم ها و بررسی چالش های ناشی از به کارگیری آن ها در مخاصمات مسلحانه ضروری است. مقاله حاضر با طرح چالش ها و ابهامات ناشی از به کارگیری این سیستم های نوظهور در مخاصمات مسلحانه تلاش دارد عملکرد هواپیماهای بدون سرنشین در مخاصمات مسلحانه را براساس قواعد پایه ای حقوق بین الملل بشردوستانه نظیر اصل تفکیک، تناسب و اقدامات احتیاطی ارزیابی حقوقی کند. در این ارزیابی نشان داده می شود که کاربرد این سیستم ها در موارد متعددی ناقض قواعد بنیادین حقوق بین الملل بشردوستانه بوده است.

    The International Criminal Court (ICC), is a new legal structure which has competence to prosecute perpetrators of international crimes and violators of human rights. In addition to national courts, The International Criminal Court has complementary jurisdiction. Therefore, the ICC has a complementary competence which complies with national legal system and national Legislative bodies and means that states have the jurisdiction and the primary obligation to investigate and punish international crimes. Considering the fact that the ICC is a young court, it’s not fair to judge the efficiency of this court, nevertheless, several governments’ position on the ICC could be subject of contemplation. The position of several African government and the African Union, is threatening to withdraw from the Statute of the Court and establishing new alternative independent authority which can undermine the ICC competence, all of which may lead to difficulty in the path of achieving criminal justice in the international community.

    Political parties in current democracies are considered as the fundamental institutions which have various functions such as expressing the will of citizens, forming awareness, introducing the election candidates and providing the government’s future plans. In recent decades, due to the reluctance among people for joining political parties, their financial resources have decreased. Therefore financing parties from state resources has been put forward as an alternative but such idea has faced oppositions. This article introduces the direct and indirect general financing programs of political parties and also examines opponents and adherents views in descriptive and analytical manner as well as the necessity of parties’ financing. The finding of this contribution indicates that protection and safeguarding of human rights, legitimacy and effectiveness of the government, depends on state aids to the parties.

    The Joint Comprehensive Plan of Action (JCPOA) can be considered both as an international agreement or non- binding agreements. To answer this question whether should we refer to text of the JCPOA or provisions of international law and parties’ national rules and law. Although the text of the JCPOA lacks any reference to it as a treaty, it can be viewed as an international agreement in international and national context. The United States, both before and after the disclosure of the JCPOA’s text and its confirmation by the Congress and by the Iranian parliament, ceaselessly argued that JCPOA is not an international treaty. The Iranian authorities have taken the same position. In this article the relation between JCPOA and Security Council Resolution no. 2231 will be studied in order to clarify the reason that confirm the JCPOA should be considered as a gentlemen agreement.

    In spite of inflation in norms regarding human rights and humanitarian law, today’ world is witnesses the violation of these laws in a great deal. The main reason can be found in the lack of effective and appropriate procedures for complying with these laws. In the beginning of 21st century, principle of non-indifference was formed by African Union, for helping people facing gross violation of human law and humanitarian law. The principle formed at the same time that the principle of responsibility to protect was established, as a respond to the social needs of Africa continent. This research, with an exploratory method, clarifies the boundary between the principle of non-indifference and the other same principles and doctrines or seemingly contradictory ones, and through this path, answers this fundamental question that whether the principle of non-indifference was regarded as a substitution for the non-intervention’s principle?

    After more than 50 years of codification in Iran, we still have problems in this field. One of these problems is the confusion between two concepts: macro (Tadwin/codification) and micro (Tanqih/Depuration). Generally they are regarded to have same importance or even same meaning erroneously. In our legal literature and even in the legislative system these two concepts are alternatively misused. Etymological and comparative studies, however, reveal that the best translation for “Codification” is Tadwin. Tanqih is one of the components of Codification framework, the task of which is to depurate and expurgate obsolete or contradictories from an official legislative text. Codification own other aspects like systematizing the legal system and filling the gaps which are not necessarily concerned with depuration.

    Islamic state of Iraq and Syria or ISIS, is a political and military terrorist organization which has been hitting the headlines since 2014. This group which has a large domination over Iraq and Syria, announced a caliphate of an Islamic state in 29th of June 2014, led by Abou Bakr Albaghdadi, chosen Raqqa as its capital. Since then, and after it began imposing its strict and widespread measures in occupied areas and also with its constant attacks and progress toward different cities in Iraq and Syria and following international community's response against this terrorist group, including the security council, a coalition led by US was formed in order to fight against ISIS. Today, in the second year of its activities, analyzing the nature of the conflict in Iraq after arrival of the coalition forces and the legal basis of their presence is mandatory. The result of this study indicates that formation of the coalition is not against international law.

    Election campaigns in Iran fail to create a worthy national model, and candidates tend to make rash and empty promises. In spite of the fact that in religious teachings, fulfilling promises is controversial, adherents of necessity of election promises fulfillment present more irrefutable proofs than the opponents. There is lack of legal basis for this issue in Iran but we can interpret several constitution article and provisions of “the general policies on election act” as a legal basis for this issue. Enforcements should base on rule of law and be supplemented by fair legal process and trial and justification as well.

    International organizations have strong instruments to implement the decisions of the UN Security Council. In order to participate in implementing such decisions, they will require relevant legal basis. The legal basis for participation of international organization in implementing the UN Security Council decisions falls into two general categories: 1- The regulations of international organizations 2- The provisions of the Charter of the United Nations. Statute of international organizations, practices and implied powers are placed in the first category. The provisions of the Chapter VII (Article 48(2)) and Chapter VIII of The Charter go with the second category.

    International law reviews the origins of the rules, institutions and practices that international law based on. That’s why "Theory" in law is able to give legitimacy to certain procedures and rule. From this standpoint, the "Liberal Theory of International Law" has an important place in international law. Confirmed by various studies, this theory plays an important role in forming "Peaceful" approach to international law and set aside classical approaches that recognized nothing butt "Legitimacy of War". Nevertheless, the core elements of this theory, reveals the fact that not only the liberal theory of international law helps to achieve the peaceful approach in international law, but also helps to justify use of force. This article studies the dualities and contradictions in the context of liberal theory of international law.

    One of the controversial issues in the area of Human Rights is “Emergency Theory”. According to the emergency theory, exercising certain rights in crisis situations may harm public order and security; so the government will have no choice but temporary derogation from certain citizens’ rights. Such act draws attention: First public order and security take priority over individual rights, and second, the way of justification of derogation from human rights based on the threats to public order and security in emergency situations. Basically, such theory may lead to abuse of power and tyranny which results in individuals rights violation. This paper examines the approaches of emergency theory adherents in order to establish a convincing basis to justify derogation from individual rights in emergency situations; it also determines frameworks and limits of state’s authority in this area.

    Commitments of states to ensure the right to social security are accepted in international instruments and most of the valid theories. But there is no consensus on nature and volume of states’ international commitments. This article will probe the nature of states’ commitments (domestic and international) to ensure the right to social security based on the thought of John Rawls. Contractualism of John Rawls justify state’s domestic commitments to ensure such right, but leaves the international commitments ambiguous. Results show that Rawls accepted limited international assistance in certain circumstances.

    Technology progress in 21st century has led to invention of flying war crafts that Unmanned Aerial Vehicles (hereinafter UAVs or drones) are a clear example. Regarding the fact that such War crafts have created challenges in the context of international Humanitarian Law (hereinafter IHL), independent legal assessment on the issue seems necessary. It is necessary to study and get familiar with challenges in deploying such war crafts in armed conflicts. This paper, studies existing ambiguities and challenges in deploying such technologies in armed conflicts, and assesses the function of UAVs in armed conflict under IHL's fundamental principles like principle of Distinction, Proportionality and precautionary principle in conducting attacks.
