    ثبوت ضمان و مسئولیت مدنی دولت در برابر اقدامات زیانبار کارکنان را می توان بر پایه چند ادله عام و خاص نشان داد. یکی از ابعاد این بحث، بررسی ضمان از نگاه مسئولیت های کلی دولت و مصالح عمومی و نسبت شهروندان با دولت از این دیدگاه به ویژه با توجه به تحولات دولت و گسترش دامنه دخالت آن در زندگی شهروندان است. شناخت خاستگاه حکومت و دولت و تحول آن در گذر زمان و گسترش نفوذ و دخالت آن از یک سو و تحلیل دینی مسئولیت های کلی دولت و محور بودن مصالح عمومی در فقه از سوی دیگر، پژوهشگر را درراستای قواعد عام و ادله خاص فقهی دیگری قرار می دهد که بر ضمان و مسئولیت دولت در برابر اقدامات زیانبار کارکنان آن دلالت می کند. دراین مقاله افزون بر اشاره به تحولات دولت، ضمان دولت از دیدگاه مسئولیت های کلی دولت و اقتضای مصالح عمومی بررسی شده است.

    حقوق سیاسی انسان، بخش مهمی از حقوق بشر است که امروزه در اعلامیه ها و متون مربوط به حقوق بشر حقی طبیعی و غیرقابل سلب شناخته می شود و در بسیاری از کشورها و نظام های مردم سالار نیز مبنای مشروعیت نظام سیاسی قرار گرفته است. در سنت اسلامی، رویکردهای متفاوتی در مواجهه با این مقوله مدرن وجود دارد که هر یک از آن ها بر مبانی معرفتی خاص خود استوار می باشد. برخی از عالمان دینی و فقهای نواندیش در مواجهه با این مسئله صورت بندی جدیدی از مناسبات مردم و حکومت ارائه نموده و حقوق سیاسی انسان را با بهره گیری از ذخایر فقهی و با رجوع به منابع دینی توجیه نموده اند. پرسش اصلی این نوشتار آن است که «فقه نواندیش، حقوق سیاسی انسان را بر اساس کدام مبانی معرفتی اثبات می کند و در استدلال بر آن، چه قواعد و اصولی از سنت اسلامی را مورد استناد قرار می دهد» ؟ نتایج تحقیق نشان می دهد که «باور به خاستگاه الهی حقوق» ، «اعتقاد به حقوق فطری» ، «باور به کرامت ذاتی انسان» ، «مرجعیت دین در زندگی سیاسی» و «تاکید بر عقل و گزاره ها ی قطعی عقلانی» ، مهم ترین بنیادهای نظری حقوق سیاسی در سنت نواندیشی فقهی است که اندیشه فقی هان نواندیش درباره حقوق سیاسی انسان بر پایه آن ها قرار دارد.

    بازخوانی سنت در برخورد با دستاوردهای عقلی بشر مدرن، برای حل تضادهای پیش آمده بین عقلانیت سنتی و عقلانیت مدرن ضروری است. هر سنت دینی، تفسیری از چندین امکان تفسیر از متون دینی است که بر اساس عقل برسازنده دوران خویش ارائه شده است و همچنان امکان ارائه تفسیری نوین از متن، بر اساس عقلانیت حال حاضر بشر، محتمل است. از این رو، این نوشتار درپی آن است که با بازخوانی وجهی از وجوه سیره سیاسی اجتماعی نبی مکرم اسلام9 در قالب شکل گیری دولت مدینه و امت واحده بپردازد که در سیر تاریخ تحول دولت اسلامی به فراموشی سپرده شده و تبعات عمیق و جدی سیاسی حقوقی آن مغفول مانده است و گامی در جهت ایجاد وحدت معرفت شناختی در میان سنت دینی و عقلانیت جدید بردارد. این مقاله با بررسی مفاد پیمان نامه مدینه النبی که در حکم قانون اساسی دولت شهر مدینه النبی است، ماهیت سیاسی دولت مدینه و نیز اثرات حقوقی آن را بازشناسایی می کند. بر این اساس و با تاکید بر حقوق و آزادی های سیاسی مردم در پیمان نامه مدینه می توان نتیجه گرفت که دولت پیامبر اکرم9 با احترام به آزادی انسان و حق تعیین سرنوشت خویشتن شکل کرفته است.

    آزادی یکی از مفاهیمی است که در اندیشه سیاسی اسلام جایگاهی بلند دارد و می توان از قرآن کریم، راهبردهایی را به دست آورد که حرکت جامعه به سوی آن را تضمین می کند. این نوشته به طور مشخص، در جستجوی راهبرد گفتگو برای دستیابی به آزادی سیاسی است. این امر با یاری روش تفسیر اجتهادی به انجام می رسد که در آن از ظرفیت های گوناگون تفسیری مانند فهم آیه با کمک آیات دیگر، مراجعه به روایات تفسیری، مراجعه به برداشت دیگر مفسران و بهره گیری از عقل، برای فهم مطلب استفاده می شود. در فرضیه بر این امر تاکید شده است که با توجه به روش یادشده و اموری چون بسترسازی قرآن کریم برای گفتگوهای سنجیده و نقش دانش های آزادی آور، راهبرد؛ گفتگو برای آزادی را می توان در ساحت هایی چون استدلال جویی و پذیرش مخالف و گفتگو با او رصد کرد؛ مسیری که راه رسیدن به آزادی سیاسی را هموار می کند.

    از میان رجال دینی و سیاسی، شهید آیت الله دکتر بهشتی بیشترین نقش را در تدوین قانون اساسی جمهوری اسلامی ایفا کرد. از آن رو که هم در مراحل مختلف تدوین پیش نویس قانون اساسی به ویژه در شورای انقلاب اسلامی، هم در تشکیل مجلس خبرگان قانون اساسی و هم در مدیریت کمیسیون ها، جلسات غیررسمی و رسمی این مجلس نقش محوری داشت. تدوین اصول متعددی در پاسداشت حقوق ملت و اختصاص یک فصل به این موضوع از ابتکارات آن شهید بزرگوار بود. در این مقاله با اشاره به مبنای فکری شهید بهشتی در موضوع حقوق ملت، دیدگاه های وی در زمینه «حق تعیین سرنوشت» ، «حق آزادی» ، «حق نظارت بر قدرت» ، و «حق خودسازی» تحلیل و بررسی شده و به میزانی که آن شهید در تثبیت و تصویب این حقوق در قانون اساسی نقش داشته، پرداخته شده است.

    محمد رشید رضا، اندیشمند مسلمان اهل تسنن، در میان متفکران معاصر جهان اسلام به عنوان چهره ای اصلاحگر شناخته می شود. او برای تطبیق خلافت اسلامی با دموکراسی و دور کردن خلیفه از استبداد با توسل به آیات شورا، حکومت شورایی را پیشنهاد می کند؛ با این حال، نگاه ایشان در ترسیم مجلس شورا کاملا نخبه گرایانه است. رشیدرضا به دلیل موانعی که در راه تشکیل خلافت اسلامی با آن مواجه می گردد، در سیر تکاملی دیدگاه های خود به سمت نظریه پردازی برای حکومت اسلامی تمایل پیدا می کند. اهمیت این پژوهش در این است که توانسته، ضمن کاوش حول زوایای مختلف شورا از دیدگاه این اندیشمند به تطبیق آن با دموکراسی پرداخته و پیامدهای سیاسی آن را بررسی نماید. مسئله اساسی پژوهش حاضر این است که محمد رشید رضا چه جایگاهی برای شورا در حکومت اسلامی قائل بوده و پیامدهای سیاسی آن کدام است. در نگارش مقاله پیش رو از روش تعاملی استیوارت هیوز استفاده شده است. در این روش بین مقتضیات و بسترهای اجتماعی و شکل گیری اندیشه خاص نقش اساسی وجود دارد و وقتی اندیشه ای پا گرفت، اندیشه جدید باعث دگرگونی جامعه و در نتیجه باعث پدیدار شدن نظم جدید در جامعه خواهد شد.

    پس از انقلاب اسلامی در ایران از سویی و روی کار آمدن انور سادات در 1971 در مصر از سوی دیگر، سیاست خارجی این دو کشور در قبال اسرائیل دچار دگرگونی اساسی شد. این تغییر جهت‏گیری در حالی رخ داد که به نظر می‏رسد، هویت دولت‏های ایران پس از انقلاب اسلامی و دولت مصر پس از جمال عبدالناصر نیز تغییر کرد. این پژوهش تلاش دارد تا بررسی کند، چگونه سیاست خارجی ایران و مصر در قبال اسرائیل در دوره های زمانی مختلف، تحت تاثیر تغییر هویت دولت‏های آنان، دستخوش تغییر شده است؟ در پاسخ به این سوال، این مقاله براساس رویکرد سازه‏انگاری سطح واحد بیان می‏دارد که تغییر هنجارهای داخلی موثر در تکوین هویت دولت‏های مختلف ایران و مصر توضیح دهنده چگونگی تغییر سیاست خارجی این دو کشور در قبال اسرائیل در دوره های زمانی متفاوت است. به شکلی که تغییر در هنجارهای داخلی شکل‏دهنده به هویت دولت‏های ایران پس از انقلاب اسلامی و مصر پس از جمال عبدالناصر، زمینه‏ساز تغییر قابل توجه سیاست خارجی این دو کشور در قبال اسرائیل شد. بدین منظور در بخش اول این مقاله به بررسی رویکرد سازه‏انگاری در روابط بین‏الملل، در بخش دوم به بررسی نقش این رویکرد در تحلیل سیاست خارجی، در بخش سوم به بررسی تغییر سیاست خارجی ایران پس از انقلاب اسلامی و در بخش چهارم به تغییر سیاست خارجی مصر در قبال اسرائیل پس از جمال عبدالناصر از منظر رویکرد سازه‏انگاری سطح واحد پرداخته‏ می‏شود.

    The State's Ascertainment of Liability and the civil liability of the government against the harmful actions of employees can be shown on the basis of general and specific evidence. One of the aspects of this discussion is the examination of Liability the from the perspective of the general liabilities of the government and the public interests and relations of citizens with the government in this regard, especially in light of developments in the state and expanding the scope of its involvement in the lives of citizens. On the one hand, Understanding the origin of government and state and its evolution over time and the spread of its influence and interference, and on the other hand, the religious analysis of the general responsibilities (liabilities) of the state and the centrality of the public interests in jurisprudence, place the researcher in line with general rules and other special jurisprudential evidence that imply the government's responsibilities and liabilities against the harmful actions of the employees. In this paper in addition to referring the developments of state, the state's liability will be scrutinized from the perspective of the general responsibilities of the state and the public-interest requirements.

    The Human being's political rights are an important part of human rights that is now recognized as a natural, inalienable and inviolable right in declarations and texts related to human rights and in many countries and democracies, it is considered as the basis of the legitimacy of the political system. In Islamic tradition, there are various approaches to this modern category which lie in their own specific epistemic foundations. Facing this phenomenon, some reformist jurists and religious scholars have presented a new formulation of relations between the people and the government and justified the political rights of the human being by using the jurisprudential texts and referring to religious sources. The main question of this paper is "based on which epistemic foundations does the reformist jurisprudence prove the political rights of human being, and what are the rules and principles of the Islamic tradition in its arguments?"The results of the research show that "belief in the divine origin of law," "belief in natural rights," "belief in human dignity," "the authority of religion in political life," and "emphasis on reason and definite rational propositions," are the most important theoretical foundations of political rights in the modern jurisprudential tradition in which the ideas of reformist jurisprudents on human rights lie.

    In order to resolve the contradictions between the traditional rationality and modern rationality, it is necessary to reflect and review the tradition in dealing with the intellectual achievements of modern human being. Each religious tradition is an interpretation of several possible interpretations of religious texts which have been offered based on the constitutive wisdom of their era. And it is also possible to present a new interpretation of the text based on the current rationality of mankind. Hence, this paper seeks to reconsider the aspects of the political and social behavior of the prophet of Islam (PBUH) in the form of the establishing town-state of Medina and Ummah.- which have been forgotten in the course of the Islamic State developments and its deep political and legal consequences have been neglected- and to take a step towards the creation of epistemological unity among the religious tradition and the new rationality. This paper examines the provisions of Treaty of Medina which could be considered as the Constitution of Medina and scrutinizes the political nature of town-state of Medina and its legal consequences. With emphasis on political freedom and rights of the people in Treaty of Medina it could be concluded that the town-state of Medina was established by respecting the human being's freedom and the right to self-determination.

    Freedom is one of the concepts which has a central place in the political thought of Islam and it is possible to obtain some strategies from Holy Quran which secures the movement of society towards it. This research seeks to find a strategy of dialogue to achieve political freedom. This is done with the help of the method of interpreting Ijtihad in which different methods like understanding a verse with the help of other verses, referring to Iijtihad narrations, referring to the use of other commentators, and the use of wisdom is applied to understand the subject. In the hypothesis, it has been emphasized that considering the mentioned method and the issues such as the possibilities in the Holy Quran for deliberate discussions and the role of libertarian knowledge, the strategy of dialogue for freedom can be found in areas such as reasoning and acceptance of the opponents and engaging in dialogue with them. This paves the way to achieve political freedom.

    Among the Political and Religious figures Ayatollah Dr. Beheshti played the most significant role in drafting the Constitution of the Islamic Republic, since he played a pivotal role in both different phases of drafting the Constitution especially in the Council of Islamic Revolution and in setting up the Assembly of Experts, management of the commissions, informal and formal meetings of this assembly. Drafting various articles related to protecting the nation's rights and devoting one chapter of the Constitution to it are among Martyr Behesti's initiatives. In this paper, with pointing to Shahid Beheshti's intellectual foundations, his views on "the right to destiny", the right to supervise power" and "the right to self-development" and his role in the consolidation and approval of these constitutional rights will be studied.

    The Syrian Islamic scholar Muhammad Rashid Rida is known as an Islamic reformer among the contemporary thinkers of the Muslim world. By appealing to the Quranic verses of the Shura, he proposes a council government to adapt the Islamic caliphate to democracy and to remove the caliph from tyranny. Hi follows an elitist approach while talking on Shura. Facing with obstacles to establish Islamic Caliphate, Rashid Reza tends towards theorizing of Islamic government. The importance of this research is that it both seeks to examine Rashid Reza's views on Shura from various aspects and its adaptation also to democracy and study its political consequences. However, the main questions is that "what place does Shura have in Islamic government in Muhammad Rashid Rida's thoughts and what are its political implications?" In this the Stuart Hughe's Interactive Method is used. In this method there is a significant role between the requirements and the social contexts in the formation of thought and when a thought is generated, it changes the society and consequently creates a new order in it.

    On the one hand, the Islamic Revolution in Iran and on the other hand, the assumption of power by Anwar Sadat in 1971, the two state's foreign policy undergone major transformation towards Israel. Seemingly, the two state's identity changed after the Islamic revolution in Iran and Anwar Sadat's presidency. This research seeks to scrutinize "How has the Iranian and Egyptian foreign policy been influenced by the change in their government's identity in different time periods?"
    In response, this paper based on the constructivism assumptions claims that the changes in the internal norms affecting the formation of the identity of different governments of Iran and Egypt explains the shifts in these two countrie's foreign policy towards Israel in different periods. In fact, the changes in the domestic norms shaping the identity of the Iranian governments after the Islamic Revolution and Egypt after Jamal Abdel Nasser led to a significant change in their foreign policy towards Israel. In the first section, the assumptions of constructivism in international relations will be briefly explained. The second section is devoted to the role of constructivism in the study of foreign policy. In the third and fourth sections I will examine the shifts in Iran's foreign policy after the Islamic Revolution and changes in the Egyptian foreign policy towards Israel under Jamal Abdel Nasser presidency.
