    عنوان «دارا شدن ناعادلانه»، دراصل، بازتاب موادی از حقوق فرانسه در مواردی پراکنده از قانون مدنی جمهوری اسلامی ایران است. به همین دلیل، عده ای ممنوعیت این نهاد را به مبانی حقوق فرانسه مستند می سازند. این درحالی است که برخی دیگر تلاش کرده اند این نهاد را تعبیری دیگر از «اکل مال به باطل» دانسته و مبنای رد آن را دلیل منع اکل مال به باطل در شریعت مطهر اسلام بدانند. پذیرش ممنوعیت دارا شدن ناعادلانه و یکسان انگاری آن با قانون منع اکل مال به باطل در قانون مدنی و حقوق ایران، به مطالعه تطبیقی این دو پدیده و مقایسه آنها با یکدیگر نیازمند است. برایند این مطالعه تطبیقی آن است که نهاد اکل مال به باطل در شریعت اسلام با نهاد دارا شدن ناعادلانه در دیگر نظام های حقوقی مطابقت کامل ندارد و تفاوت هایی میان آنها دیده می شود؛ براین اساس، از ممنوعیت دارا شدن ناعادلانه و بلاجهت، با عنوان خاص آن، در چهارچوب شریعت اسلام نمی توان دفاع کرد.

    مهم ترین منبع قانونگذاری در حکومت اسلامی احکام اسلام است. ازسوی دیگر، یکی از مهم ترین اهداف حکومت در قانونگذاری اقامه عدالت در جامعه است. در این مقاله چهار نقش برای عدالت در قانونگذاری ترسیم شده است: نخست اینکه، آیا رعایت عدالت ماهوی در قانونگذاری لازم است و آیا عدالت درکنار احکام اسلام، دغدغه ای مستقل از دغدغه اجرای احکام برای قانونگذار ایجاد می کند؟ دوم اینکه، عدالت چه نقشی در تعیین فتوای معیار در قانونگذاری دارد؟ سوم اینکه، عدالت چه نقشی در قانونی کردن حکم شرعی دارد، بدین معنا که اگر قانونی کردن حکم شرعی، در شرایط زمانه، ظالمانه می نمود، چه باید کرد؟ و چهارم اینکه، عدالت در تزاحم با دیگر مقاصد شریعت و دیگر اهداف حکومت چه جایگاهی دارد؟
    روش این مقاله تحلیلی و با فرض مبنای ولایت مطلقه فقیه است. فقه سنی و مباحث حقوقی در این مقاله نقش پررنگی ندارند. این بحث یکی از مباحث فقه قانونگذاری است.

    با فرض دلالت ابتدایی ادله (به سان مقتضی) بر ثبوت قاعده عدالت، یکی از پرسش برانگیز ترین مباحثی که وجود مانع دربرابر این مقتضی را بررسی می کند، کاربرد قاعده به لحاظ بودن یا نبودن نص است. جریان قاعده عدالت، در موارد غیرمنصوص، به جنبه اثبات گری این قاعده برای استنباط احکام بستگی دارد. بررسی ادله این قاعده، عدم حجیت اثبات گری آن را نشان می دهد. اما هستند فقی هانی که مستند به عدالت، احکامی را استنباط و اثبات کرده اند. در موارد منصوص، جایی که عدالت در مقام اثبات و تشخیص مرجع آن در قاعده عدالت، با اصل حکم منصوص درافتد، حمل بر تخطئه در تشخیص می شود. اما جایی که با اطلاق یا عموم حکم منصوص درافتد، نفی این گونه اطلاق یا عموم کاری است که در مقام استنباط احکام، از ادله قاعده عدالت بر می آید.

    در فقه اسلامی همه احکام خانواده مجموعه ای به هم پیوسته و منسجم را می سازند و تک تک آنها یکدیگر را تکمیل، تایید و تبیین می کنند. ازاین رو، روشن است که درباره یک حکم و جایگاه آن در حقوق خانواده، بدون درنظر گرفتن ارتباطش با دیگر احکام این منظومه، نمی توان قضاوت نمود. بحث از عدالت در حقوق خانواده نیز از این قاعده مستثنی نیست. با نگاهی به این احکام و ملاحظه تفاوت های حقوقی میان حقوق زوجین، این پرسش مطرح می شود که مبنای تشریع این احکام چیست که بتواند با عدالت تشریعی و درنتیجه، عادلانه بودن حقوق در خانواده همسویی داشته باشد؟
    به نظر می رسد با عنایت به نظام مندی احکام خانواده در فقه اسلامی، یکی از اموری که می تواند مبنای عدالت در حقوق خانواده ازمنظر فقه اسلامی باشد، تناسب میان احکام خانواده و هماهنگی آن با فطرت و طبیعت است.
    برای اثبات این فرضیه و پاسخ به پرسش اصلی مقاله، ضمن تحلیل مفاهیم بنیادین، به رابطه و تناسب شریعت با فطرت و طبیعت اشاره شده و با ذکر مصادیق، عادلانه بودن احکام خانواده و نسبت آن با تفاوت های حقوقی میان حقوق زوجین بحث و بررسی شده است.

    بنابر برخی دیدگاه ها، عدالت به مثابه قاعده فقهی می تواند در اجتهاد فقهی و استنباط احکام شرعی نقش داشته باشد. اما باید گفت ادله قرآنی در مقام بیان جعل حکم نیست و فراتر از حکمت احکام نخواهد بود. جای این ادله فقط در ملاکات احکام است. روشن است که با حکمت احکام نمی توان دست به استنباط زد. حکمت فقط علت جعل است و آنچه علت حکم و قید موضوع در مرحله جعل است، می تواند تاثیری در استنباط داشته باشد. برخی فقی هان معاصر به منظور انکار قاعده مندی عدالت اشکالاتی بیان کرده اند که بدان ها پاسخ گفته شده است. در بررسی چالش حکمت انگاری عدالت باید گفت دیدگاهی وجود دارد که به نقش یابی حکمت در فرایند استنباط پرداخته است. در این دیدگاه، حکمت و علت در تعمیم بخشی تفاوتی با یکدیگر ندارند و تنها فرق میان آن دو این است که حکمت، برخلاف علت، مخصص نیست. همچنین عدالت حتی به عنوان ملاک می تواند در فعلیت احکام غیرتعبدی دخالت داشته باشد. البته، اطلاق قاعده فقهی بر تاثیر ملاک بر گستره احکام غیرتعبدی متداول نیست. برای گذر از دوگانه علت/ حکمت، عدالت می تواند هدف شریعت باشد. دراین صورت، با نقد متنی، روح روایات باید با عدالتی که در قرآن آمده، توافق داشته باشد.

    یکی از مسائلی که از آغاز موردتوجه اسلام بوده، تنظیم اصول و قواعد ارتباطات انسانی است. روابط میان ملل مسلمان و غیرمسلمان بخشی از این حوزه گسترده است. این روابط براساس دلایل عقلی و نقلی برمدار اصولی چون «قسط» و «نفی سلطه کافر بر مسلمان» استوار است. دراین میان، برخی فقی هان تلقی اثباتی از اصل «نفی سبیل» درکنار بعد سلبی آن را با عنایت به برخی از مستندات نقلی آن همچون روایت «الإسلام یعلوا ولایعلی علیه» موردتوجه قرار داده اند. ایشان بر این باور شده اند که تنظیم روابط بین المللی مسلمانان با اقوام و ملل غیرمسلمان باید به گونه ای رقم زده شود که همواره به برتری حقوقی مسلمان بر کافر بینجامد. به نظر می رسد چنین خوانشی از قاعده نفی سبیل با اصل قسط (یکی از پایه ای ترین اصول روابط بین الملل اسلامی) در تضاد است. این مقاله بررسی ابعاد این موضوع را برعهده گرفته و با اتخاذ رویکردی انتقادی دربرابر خوانش فقهی مذکور، تفسیری نو از قاعده نفی سبیل ارائه کرده که همسو با عدالت بین المللی است.

    افعال خداوند متعال با توجه به اطلاق وصف عدل در حوزه تکوین، تشریع و جزا برمبنای عدل است. ازاین رو همه احکام شرعی متصف به وصف مقدر عدل است. برخی اندیشمندان معتقدند فقیه در استنباط حکم شرعی می تواند با شاقول عدل و ظلم، و تشخیص مصادیق آن به وجوب و حرمت فتوا دهد. از این موضوع به قاعده عدالت یا نفی ظلم تعبیر می شود. در فقه پیشینه چندانی از این قاعده با این عنوان نداریم و قاعده بودن آن را معاصران مطرح کرده اند. در این مقاله درباره چهار قاعده لاضرر، عدل و انصاف، قرعه و غرور پژوهش شده و اثبات شده که این قواعد مصداقی از قاعده عدالت اند. در قاعده لاضرر میان مصداق ضرر محرم و عنوان ظلم هم پوشانی وجود دارد و در تشخیص مصادیق ضرر محرم باید از انطباق عنوان ظلم بهره جست. قاعده عدل و انصاف همان قاعده عدالت در شبهات موضوعیه حق و مال است. قاعده قرعه از مصادیق قاعده عدالت است که کاربرد آن تحقق عدل و استیفای حق به صاحبان آن است. ادله اثبات کننده قاعده غرور همان ادله ای است که در قاعده عدالت نیز استفاده می شود.

    Some experts hold that basically, "Unjust Enrichment" is transmitted from French Law into Iranian Civil Law; where, some other believes that it is another interpretation for the Islāmic principle: Unlawful Seizure of Property (Akl Al-māl Bil-Bātil). To equate "Unjust Enrichment" with "Unlawful Seizure of Property" in the Iranian Civil Law requests for a comparative study of these two statements. This study does not confirm a complete concord between "Unlawful Seizure of Property" in Islāmic law and "Unjust Enrichment" in other legal systems; rather we can witness some differences between the two. Therefore, we cannot acknowledge the impermissibility of "Unjust Enrichment" and "Causeless Enrichment" under the framework of Islāmic law.

    The most important source for legislation in Islāmic government is the rulings of Islām. And, one of the most important legislation goals of Islāmic state is the establishment of social justice. This essay inquires about four roles of Justice in legislation. Firstly, is it necessary to observe inherent justice in legislation? And, dose Justice, beside and alongside the concern for enforcement of Islāmic rulings, engenders another concern for legislator? Secondly, what is the role of Justice in locating a criterion for Fatwā in legislating? Thirdly, what is the role of Justice in legalizing Islāmic canon law? What if legalizing a specific ruling portrays to be unjust? Fourthly, what if Justice conflicts with other goals of state or Objectives of Shariʿah? This essay uses an analytical method based on "Absolute Jurist's Authority" theory. Sunnī Fiqh and Juridical issues do not have a notable role in this essay. This essay falls under the Fiqh of legislation.

    The primary indication of arguments justifies the Principle of Justice. Application of the Principle of Justice, regarding the existence or absence of the designated ruling, is one of the most challenging subjects which studies the existence of impediment against this justification. The implementation of the Principle of Justice regarding undesignated cases depends on the competency of this principle in deducting the rulings. Studying the evidences of this principle asserts it's inadequacy for deducting the rulings. Nevertheless, there are jurists who deduct some rulings based on this principle. Regarding the specified and designated cases, where there is a conflict between justice—as a referent in the Principle of Justice—and a specified ruling, the authority of justice in deducting the ruling is proscribed. Although, where the conflict is between Justice and the generality or the absoluteness of a designated ruling, this principle is adequate to negate the generality and absoluteness of that ruling.

    Islāmic Family law is a coherent and conjunct set of rulings. Every single ruling of this set completes, supports, and explains other rulings. Therefore, it is inaccurate to judge about a verdict and its position in the Family Law regardless of its relation to the other rulings of this collection. Talking about Justice is not an exception to this precept. Legal discrepancies between spouse's rights lead us to ask for jurisprudential foundation of the pertained rulings so that we could affirm the accordance of these verdicts with the legislative Justice. Family Law in Islām is methodical. Accordingly, from Islāmic point of view, congruity of family laws, nature, and primal genesis can be considered as the basis of Justice regarding Family Law. To prove this theory, while giving an answer to the main question of the essay, along with analyzing the main concepts, we will pursue and ponder upon the congruity of Shariʿah, nature, and primal genesis. Moreover, righteousness of the Islāmic Family Law and its impact on the discrepancies between spouse's rights is studied.

    According to some viewpoints, Justice qua jurisprudential principle qualifies for playing its role in deducting Islāmic rulings. Nevertheless, Qur’ānic arguments do not undertakeordaining the Islāmic laws; rather, the maximum we can expect fromthis scripture is the philosophy of a ruling. Certainly, merely knowing these philosophies does not suffice for deduction of Islāmic decrees. Philosophy is just a cause for ordaining the law, not the law itself. The one that is reliable for deducting the law is the cause and the condition of a subject. Contemporary scholars pose several objectionsagainst Justice to be as a principle. Fortunately, these objections are answered adequately. Regarding the problem of Justice as Philosophy of rulings, it is worthy to mention that there is a viewpoint which has sought the role of philosophy of Islāmic laws in the process of deduction. This outlook holds that there is no difference between cause and philosophy regarding generalization. Rather, the only difference is that philosophy, in contrast to the cause, does not particularize. Furthermore, Justice, even as a criterion, qualifies for actualization of non-devotional prescripts. Yet, it is not prevalent to attribute "Principle" to the impact of criterion on the scope of non-devotional prescripts. Intending to bypass the dichotomy of Cause-Philosophy, Justice can be put as the goal of Shariʿah. In this case, while criticizing the text, traditions (Ḥadīths) ought to be in compliance with the spirit of the Qur’ānic justice.

    Conducting the principles of human relations is one of the subjects which has been highly noted from the first days of the advent of Islām. Obviously, Muslims—Non-Muslim's relations is part of this broad area. These relations supported by rational and narrative reasoning are based upon principles like "Justice" and "No-Domination for Unbelievers Over Believers (No Way Principle)." Some scholars, with regard to certain narrative arguments e.g. Islām's Supremacy have noted the positive side of this principle alongside the negative side. These scholars hold that codifying Islāmic international relations should be established in a manner that supremacy of Muslims preserves. It seems that this interpretation of the Principle of "No way" challenges the Principle of Justice as the most basic foundation of the Islāmic international relations. This essay, by criticizing the current juridical interpretation, and aligned with the concept of International Justice, presents a new interpretation of the "No Way Principle".

    With respect to this fact that Justice is unconditional, Divine acts are Justice-Based in all aspects of Creation, Legislation, and Retribution. Thus, all Islāmic rulings are characterized by tacit attribute of Justice. Some scholars hold that it is valid if a jurist issues his Fatwā due to Just and Un-Just attribute of each case. This is construed as "Principle of Justice" or "No Unjust Principle". There is no trace of this rule in the previous works; it is something dominated as a principle in the contemporary works. Here we study four principles of No Harm, Justice and Equity, Drawing Lots, and Fraud. It is concluded that these principles are all, referents and instances of the Principle of Justice. Regarding the principle of No Harm, the instance of illegitimate Harm overlaps the instance of Unjust. And instances of illegitimate Harm are recognized if the term Unjust is applicable there. Justice and Equity Principle is the Principle of Justice itself, concerning subjective doubts on Right and Property. The Principle of "Casting lots" is one instance of the Principle of Justice which applies in order to preserve Justice when the reality regarding the individual's rights is obscured. The evidences in substantiation of the Principle of Fraud are the same evidences for the principle of Justice.
