    یکی از این حقوق زوجین، حق تمکین است و یکی از مصادیق تمکین این است که زن از منزل بدون اذن شوهر خارج نشود. همه ی فقهای اسلامی معتقدند که خروج از منزل شوهر بدون اذن او «نشوز» محسوب می شود. درباره ی محدوده ی استیذان زوجه در فقه امامیه چند قول بیان شده است: گروهی از فقها، استیذان از زوج را به طور مطلق واجب می دانند؛ گروه دوم، استیذان را مقید به قید منافات نداشتن با حق زوج در استمتاع تام از زوجه می دانند. مذاهب اهل سنت نیز دو دسته تقسیم شده اند. از تطبیق نظرهای فقهای شیعه و اهل سنت دریافتیم که بیشتر فقهای امامیه و در میان مذاهب اهل سنت بیشتر فقهای مذاهب شافعی، مالکی و حنبلی، قائل به استیذان مطلق بوده و معتقدند، زوجه فقط در موارد ضرورت می تواند بدون اذن شوهر از منزل خارج شود. در مقابل، برخی فقهای شیعه و از میان مذاهب اهل سنت، مذهب حنفیه قائل به استیذان مقید هستندو استیذان را در مواقعی که با حق استمتاع منافات داشته باشد، واجب می دانند؛ البته غالب مردان در فحوا، به خروج های متداول روزانه راضی می باشند. بعد از مقایسه ی استدلال های بیان شده از سوی طرفین، به این نتیجه رسیدیم که قول احتیاج به استیذان مطلق، قوی تر بوده و دلایل آن تمام تر است.

    اگر تعدادی افراد در اموالی شریک باشند، منتها یک یا چند نفر از آنها از این اموال مشارکتی سرقت نمایند، بین فقها در حکم این سرقت اختلاف نظر است. نگارندگان پس از بررسی تفصیلی اقوال و ادله فقها در این زمینه در نهایت به این نتیجه می رسند که اگرچه تفصیل موجود در روایت صحیحه عبدالله بن سنان با توسعه حکم در آن به سرقت از اموال مشارکتی، مقتضی آن است که اگر شریک علم به عدم جواز تصرف در اموال شراکتی را بدون اذن شریکان دیگر داشته باشد و با این حال اموال شرکای دیگر را بردارد به طوری که اموال ربوده شده مازاد بر سهم وی نیز به مقدار حد نصاب قطع(یک چهارم دینار بنابر قول صحیح) برسد، حد قطع بر وی اجرا می شود و در غیر این صورت شریک سارق مستحق اجرای حد قطع نیست، منتها با تامل در این روایت روشن می شود که این تفصیل با توجه به وجود ملکیت اموال به نحو اشاعه در اموال مشارکتی، مشروط به لحاظ کردن ملکیت به نحو اشاعه و در هر جزیی از اموال، می باشد. و بر فرض وجود شک در اینکه آیا این ملکیت به نحو اشاعه و در هر جزئی از اموال که قبل از سرقت مورد لحاظ قرار گرفته شده بود، آیا بعد سرقت نیز مورد لحاظ قرار می گیرد یا نه؟ مقتضای اصل استصحاب آن است که این ملکیت به نحو اشاعه و در هر جزیی از اموال حتی بعد سرقت شرکاء از یکدیگر نیز در حکم سرقت مورد لحاظ قرار گیرد.

    بحث از حجیت امارات ظنیه (به معنی صحت و قابلیت استناد به آنها) بطور عام و حجیت خبر واحد بطور خاص از دیرباز در کهن ترین متون اصولی ما مورد توجه قرار گرفته و به مرور و کم کم دامنه ی آن گسترش یافته و مواردی نظیر حجیت ظواهر، شهرت فتوایی، قول لغوی، اجماع منقول و قیاس را نیز در بر گرفته است. در بررسی این قضیه لامحاله به تحلیل دیدگاه مخالفان تعبد به ظنون (ضمن بررسی دلایل آنها در منع از حجیت ظنون و عدم امکان تعبد به آنها با طرح محذورات ناشی از این تعبد) و موافقان حجیت آن بطور مطلق و یا بنا بر تفصیل (که دلایل و محذورات مطرح شده را توهمی دانسته و به رد محذورات مطرح شده یا مقدر ناشی از تعبد به ظنون پرداخته اند) توجه می شود. در این مقاله نیز ضمن پرداختن به سابقه تاریخی و تطور مباحث مربوطه که منجر به توسعه دیدگاه های علی الخصوص موافقان و در نتیجه طبقه بندی آنها گردیده و به بررسی دسته بندی های موجود از محذورات ذکر شده ناشی از تعبد به امارات ظنیه یعنی اجتماع حکمین اعم از متماثلین یا متضادین و رد آنها پرداخته شده است. بدیهی است با روشن شدن این مباحث و اختیار دیدگاه تفصیلی، نقش اساسی و مقدماتی در مباحث دیگر نظیرحجیت اماراتی مانند ظواهر و خبر واحد ثقه و همچنین رد حجیت برخی دیگر از امارات نظیر قیاس خواهد داشت.

    علم متعاقدین به مقدار و کیفیت عوضین، شرط صحت بیع است. یعنی عوض- اعم از مبیع و ثمن- باید از نظر مقدار، جنس و اوصاف تاثیرگذار در قیمت معلوم باشند و مجهول بودن عوض در هریک از ابعاد یاد شده موجب عدم انعقاد بیع می شود. ادله ای که برای آن ذکر شده عبارتند از؛ حدیث نفی غرر، روایات، اجماع که در اجماع مناقشه کبروی شده است، یعنی هر چند وجود اجماع در این مساله مسلم است، اما مدرک حکم حدیث نبوی مشهور بین فریقین است. بنابراین اجماع تعبدی نداریم. لذا شرط صحت معامله آن است که طرفین معامله نسبت به معامله ای که واقع می سازند، آگاهی کامل داشته باشند؛ زیرا در صورت جهل به مورد معامله، آن معامله غرری است و چنین معامله ای مورد نهی شارع مقدس است، چنانکه در حدیث آمده است: «نهی رسول الله صلی الله علیه و آله و سلم... عن بیع الغرر».

    قرارداد استصناع عبارت است از سفارش ساخت یک شیء معین که ناشی از توافق بین صانع یا سازنده و مستصنع یا سفارش دهنده می باشد. در خصوص ماهیت قرارداد استصناع میان فقها و حقوق دانان اختلاف نظر وجود دارد. نظرات مطرح شده در خصوص ماهیت آن عبارتند از: بیع، بیع سلف، اجاره، جعاله، قولنامه، قرارداد خصوصی مطابق ماده 10 قانون مدنی و عقد مستقل. با وجود نظرات مختلف می توان بر آن اعتقاد بود که قرارداد استصناع یک عقد مستقل است و از آن جایی که مبیع در زمان انعقاد قرارداد وجود خارجی ندارد و بعد از مدتی در آینده به وجود خواهد آمد، نوعی عقد معلق است که آثار آن نیز از زمان تحقق معلق علیه- ساخته شدن مبیع - می باشد. مقاله حاضر دیدگاه اخیر را می پذیرد.

    یکی از مباحثی که در بخش مکاسب محرمه ی فقه شیعه، محل اختلاف شدید آراء فقی هان شیعه می باشد، مساله ی اخذ اجرت بر واجبات است اینکه، آنچه امروز، در ادبیات فقه شیعه، قاعده ی اخذ اجرت بر واجبات، خوانده می شود، دارای چه پیشینه ی تاریخی است؛ چگونه در گذر زمان ولادت یافت، رشد نمود و به قاعده ای فربه بدل گردید؛ کدام دانشیان فقه شیعه، در این روند، سهیم بودند و تاثیر نهادند و با توجه به جایگاه ویژه-ی صاحب عروه، در حوزه ی نقادی و ارائه آراء ویژه فقهی، وی، در نقد دیدگاه مشهور و رواج دیدگاهی نو، چه نقشی دارد، عمده مطالبی هستند که مقاله حاضر با نگاهی تاریخی، در قالب پژوهش شخص محور، تبیین آنها را در اهتمام خویش دارد، تا از این رهگذر، به بخشی از تاریخ فقه شیعه در حوزه ی قاعده ی اخذ اجرت بر واجبات، آگاهی یابد.

    از جمله چالش هایی که در روزگار معاصر رخ نموده و اذهان بسیاری از متشرعان را به خود مشغول داشته است، میزان ارج و احترام شرع مقدس نسبت به مخالفان مذهبی است. علت بروز چنین تاملاتی، وجود فتاوایی خلاف قاعده است که بعضا مستظهر به موافقت مشهور فقها می باشند. یکی از این فتاوای بحث برانگیز که در کثیری از کتب فقهی امامی دیده می شود، فتوا به جواز غیبت نسبت به مخالفان مذهبی است. مشهور فقی هان با تفسیری خاص از پاره ای آیات کتاب مجید و با تمسک به دیگر ادله فقهی، مناط در حرمت غیبت را «ایمان» دانسته و منصرف از کلمه مومن را شیعه اثنی عشری دانسته اند؛ بدین ترتیب مطابق مختار ایشان، غیبت غیرشیعیان از عمومات ادله حرمت غیبت خارج شده و مجاز شمرده می شود. نگارنده با بازخوانی ادله قول مشهور چنین نتیجه می گیرد که مستندات ارائه شده وافی به مقصود و کافی برای اثبات مدعای ایشان نیست. نویسنده معتقد است قائل شدن به اشتراط ایمان در تحقق حرمت غیبت، فاقد وجاهت شرعی است. این نظریه اگرچه مخالف برداشت مشهور فقی هان امامی است؛ لیکن برخی از متاخران را با خود همراه نموده است. ضمن اینکه نظریه مزبور برخلاف قول رقیب با اطلاقات ادله باب سازگار بوده و قواعد اولیه باب غیبت نیز آن را اقتضا می نماید.

    After the contract of marriage, some rights and duties are imposed to the spouses. One of these rights is the right of subservience. One of the aspect of this right which is agreed upon by all Muslim jurists is that the wife is not allowed to get out of home without the husband's permission and if happened her act is considered "Nushuz" or disobedience and the wife who has done it is called Nashizah or disobedient and as a result of which she will be deprived form two of her rights: alimony and Qasm. About the scope of wife's duty to ask for the husband's permission, there are several views in Imamiyah Jurisprudence: a group of these jurists believes in the absolute necessity of getting such permission while another group limits this duty to the situation when her leaving contradicts husband's right of having an absolute sexual pleasure from his wife. Sunni jurists have similar views. The comparison of views expressed by both Shiite and Sunni jurists indicates that most Imamiyeh Jurists and most jurists belonging to the Shafei, Maleki and Hanbali jurisprudential schools believe in the absolute necessity of getting permission and believe that the wife is allowed to get out of home without her husband's permission only in emergency cases. In contrast, some of the Shiite jurists believe in the limited necessity of having such permission and say it is necessary only in cases when her leaving causes the husband to get deprived from accessing her for sexual purpose.

    There is a disagreement among jurists about the Islamic verdict on those who are attained to a part-proprietorship, but one or more committed to steal those properties from the others. After reviewing the testimony and evidence received from jurists, the authors arrive at the conclusion that although the narrative developed by Abdullah bin Sanan implies that if one of the partners indulged to steal others properties by knowing that there is no permissibility for him to seize property without permission of the other partners, he would be subjected to HAAD punishment and that is when the stolen properties reach a quorum namely the one-fourth of a dinar which is required to make him worthy of hand amputation (according to correct quote) and if otherwise, he will not be subjected to hand amputation, it depends on whether or not the type of ownership has been specified in each part of property; according to cooperative properties policies. It also should be specified if there is a doubt whether the type of ownership, after the larceny is in compatible with that of before the larceny in each part of property. The Principle of Istishab (Presumption of Continuity) says that at the time of passing the verdict, it is necessary to consider the type of ownership even after the larceny.

    The discussion regarding the requirement of guessed indications in general and the requirement of news specifically has been dealt with in our oldest principal texts, and its domain has gradually developed and incorporated issues including appearances, jurisprudence fame, lexical promises, spoken harmony, and analogy. In investigating this issue, the analysis of the viewpoints of the opponents of following of guesses (through investigating their reasons for forbidding the requirement of guesses and the inability to follow them along with discussing the abandonments due to this following) and the absolute proponents of this requirement (those who assume these reasons and abandonment as being illusion and resort to rejecting these requirements) are all taken into consideration. Dealing with the historical background and the variety of discussions leading to the development of viewpoints, in particular, in the proponents and accordingly to their categorization, the present study sheds light on the existing categories of abandonments due to following the guessed requirements, i.e., the arbitrators’ harmony including both the opponents’ and followers’ viewpoints and their rejection. It is obvious that clarifying these issues and the authority of the expansion approach can pave the way for raising discussions in other fields such as appearance, unified news and also for rejecting requirements for other indications such as analogy.

    The knowledge of the parties to the transaction (sale) about the quality and quantity of both the object of sale (and the thing which is taken in return for the object sold and the defined price is taken to be the conditions, among others, for the validity or legality of the transaction. In other words, both the object of sale and the price thereof has to be known for both parties and well defined and specified in detail in terms of their quantity (weight, volume, number, …) and quality as well as other involved descriptions of quality and quantity which may have effects on the value of the two exchanged items of commodity. The evidence for the conditions laid down for the valid transaction are as follows: a prophetic hadith that rejects the chance of gain or loss in a transaction, known as hadith-e nafyi gharar, traditions and consensus; the latter, of course, has been subject to controversies. That is, though it is certain that there exits consensus of opinion to the matter in question, the ruling issued on the basis of the prophetic hadith is known to and agreed upon by both the Sunni and Shiite scholars. Hence there would be no consensus on faith in this regard. Therefore, according to Islam, any transaction is considered as valid or legitimate provided that both parties are fully aware of the transaction being carried out, and in case they are ignorant of the object of transaction, i.e., of what they are going to sell or buy, the transaction of this kind is hazardous, and thus invalid and prohibited by the Islamic Law. In the prophetic hadith we read: “the Messenger of Allah [Prophet Muhammad], may peace be upon him, prohibited a transaction that is hazardous.”

    Istensna contract is a recommendation for the particular object that results in agreement between the producer and the client. There are differences in nature of this contract among jurists and lawyers. Despite the different opinions, it can be believed that Istesna is an independent contract and because object of sale does not exist in time of conclusion of contract and exists after some time in the future, there will be a conditional contract. The present article analyses recent viewpoint about Istesna.

    Among the challenges of our modern time which have occupied the many religious people's mind, the amount of veneration and respect of the holy Canon of Islam to religious opponents is important. The cause of appearance of such questions is issuance of some rare Fatwas in this domain which are sometimes invigorated by the support of majority of the jurisprudents. One of these challenging Fatwas which can be seen in many jurisprudential books is the one that permits backbiting religious opponents. Majority of jurisprudents has considered "being a believer" as the criterion of prohibition of backbiting. The writer has concluded that the presented proofs for the mentioned Fatwa are not sufficient for proving the claim. The writer believes it is not canonically valid to consider "being a believer" as a provision in the victim for prohibition of backbiting. This point of view is against the view of the majority though, but some of recent scholars have approved it. Furthermore, this viewpoint is compatible with the wide contextual meaning of the main proofs of this jurisprudential domain and the primary maxims of the prohibition of the backbiting.
