    با بروز درگیری های داخلی میان حکومت ها و مخالفانشان و با بالاگرفتن این درگیری ها و رسیدن آنها به مرز مخاصمه مسلحانه غیربین المللی، شاهد واکنش سایر دولت ها و نیز سازمان های بین المللی به آنچه در این شرایط می گذرد، هستیم. واکنش هایی که گاه موجب قدرت گرفتن و چیرگی یکی از طرفین بر دیگری شده و گاه تنها به شعله ورترشدن آتش مخاصمه کمک کرده است. اما آنچه علاوه بر این گونه موضع گیری های سازمان های بین المللی و نتایج حاصل از آن اهمیت دارد، احراز صلاحیت سازمان های بین المللی برای عملکردشان است که تا چندی پیش می توانست به عنوان دخالت در یکی از مهم ترین و حساسیت برانگیزترین مسایل داخلی دولت ها- که از جمله مهم ترین اعضای جامعه بین المللی اند- تلقی شود. در این مقاله با مطالعه اجمالی اصول احراز صلاحیت سازمان های بین المللی و نیز با موردکاوی عملکرد دو سازمان بین المللی مهم؛ یعنی اتحادیه عرب و سازمان همکاری اسلامی در مورد درگیری های سال های اخیر در لیبی و سوریه سعی خواهیم کرد تا حد ممکن ابهامات موجود در این خصوص را برطرف کنیم.

    در تاریخ سازمان ملل، قانونی بودن قطعنامه های شورای امنیت در موارد متعددی به چالش کشانده شده است. این چالش ها عمدتا توسط دولت هایی که تحت تاثیر تصمیمات شورای امنیت بوده اند، صورت گرفته است. با توجه به اینکه دولت ها نمایندگان اجرای قطعنامه های شورای امنیت هستند، دیدگاه و ارزیابی خود را در نحوه اجرای تصمیمات شورای امنیت دخالت می دهند. دادگاه های داخلی و حتی منطقه ای نیز در مواردی اقدام به بررسی اقدامات صورت گرفته از سوی دولت ها در اجرای قطعنامه ها کرده اند. این موضوع اگرچه نتوانسته است نظارت قضایی مستقیم بر قطعنامه ها را ایجاد کند در نحوه اجرای آنها بسیار موثر بوده است. مسئله ارزیابی دولت ها می تواند نگرانی هایی را در مورد کاهش کارایی شورای امنیت در موارد حفظ صلح و امنیت بین المللی ایجاد کند.

    یکی از فعالیت های شورای حقوق بشر که با تاسیس آن از سال 2006 میلادی گسترش یافته است، استفاده از کارشناسان حقوق بشر برای بررسی، واکاوی و نظارت بر وضعیت حقوق بشر دولت هاست. رویه های ویژه، نام کلی سازوکارهایی است که کمیسیون پیشین حقوق بشر، آن را تدوین و شورا انجام آنها را تقبل کرده تا بر وضعیت حقوق بشر در کشورها یا سرزمین های معین (ماموریت های کشوری) یا پدیده های مهم نقض حقوق بشر در جهان (ماموریت های موضوعی) نظارت کند و درباره آنها توصیه، راهنمایی و گزارش علنی ارایه دهد. بحث اصلی این است که شورای حقوق بشر با برداشتن گام های موثر در سازوکار رویه های ویژه در راستای نظم مدون حقوق بشری، از تجارب گرانسنگی در نظارت بر حقوق بشر بهره مند است. این نظارت ها بیشتر بر دولت هایی اعمال می شود که مایل یا قادر به انجام تکالیف خود در قبال شهروندان نیستند. این گزارشگران با توجه به مهارت های فنی و تجربی خود در تنظیم و ارایه گزارش ها و با اعمال فشار بر دولت ها در حوزه های تقنینی، قضایی و اجرایی کشورها، اثرگذاری مطلوبی بر افزایش احترام به حقوق بشر داشته اند؛ اگرچه پاره ای نیز بدون توجه به ارزش ها و هنجارهای سنتی جوامع- اعم از قانونی و عرفی- مباحث نظری گسترده و گاه جنجال آفرین به راه انداخته اند. با برطرف شدن عیوب کمیسیون پیشین حقوق بشر و همچنین، روزامدی نهادها و سازوکارهای آن، بسیاری از جوامع مدنی، صاحبنظران و کارشناسان، سازوکار رویه های ویژه را ستوده و این ابزار را معیاری جهانشمول و غیرقابل نقض معرفی کرده و بر اهمیت آن اهتمام داشته اند؛ با این همه، پاره ای از دولت ها اشعار داشته اند که این سازوکار، هیچ گونه تقدم ذاتی نسبت به ارزش ها و هنجارهای دولت ها ندارد. در مقاله پیش رو، نویسندگان مقاله ضمن تبیین دستاورد های این سازوکار، عملکرد شورای حقوق بشر را در زمینه ایجاد مقام گزارشگری بررسی خواهند کرد.

    سازمان ملل متحد، موثرترین سازمان بین دولتی است که بیشترین نقش را در روابط میان دولت ها ایفا کرده است و بدین سبب، اعتبار قابل توجهی در میان تابعان اصلی حقوق بین الملل (دولت ها) دارد. شورای امنیت به عنوان رکن سیاسی و دیوان بین المللی دادگستری به عنوان رکن قضایی این سازمان، نقش موثری در کسب این اعتبار داشته اند؛ تا جایی که می توان ادعا کرد اغلب آورده های سازمان ملل متحد برای حقوق بین الملل، به واسطه فعالیت های این دو رکن است. درعین حال، به علت سکوت منشور، ارتباط میان این دو رکن در زمینه های مختلف همواره مورد بحث بوده است. این مقاله سعی دارد تا با تشریح ارتباط میان این دو رکن از طریق بررسی مسایلی همچون امکان طرح هم زمان یک موضوع در دیوان و شورا؛ امکان پرداختن دیوان به مسایل سیاسی و امکان پرداختن شورا به موضوعات حقوقی؛ امکان ایجاد صلاحیت برای دیوان از سوی شورا و امکان نظارت قضایی دیوان بر شورا؛ به این چالش اصلی پاسخ دهد که آیا در رابطه میان این دو رکن، برتری و رجحانی قابل تصور است یا خیر؟

    خردورزی جامعه ملل به دلیل عدم تعیین رهبر برای نظام جهانی و اعطای امتیازی درخور به قدرت های آن روز ، با شکست مواجه شده و فاجعه دوباره جنگ را به همراه داشت. این نقایص در ساختار سازمان ملل با خردورزی وتو ، رفع و جهان تازه دارای رهبر شد. اما گذشت زمان، ظهور قدرت های جدید ، ضعف قدرت های گذشته و رسیدن اغلب کشورها به بلوغ زندگی جمعی، باعث رفع نیاز جهان به داشتن رهبر شده و جامعه بین المللی را که هنوز ساختار قدیمی خویش را حفظ کرده، در آستانه نابخردی دیگری قرار داده است که لزوما با گفتگو حل شدنی نیست. از این رو، ضروری است تا برای جلوگیری از فاجعه جنگی دیگر ، همه قدرت های بین المللی به سهم خود (این سهم از شاخص های مادی و معنوی متعدد هر دولت نشیت می گیرد و در طول حضور در مرکز تصمیم گیری و تعداد رای و قدرت رای هر دولت موثر خواهد بود)، در اداره جامعه بین المللی در شورای امنیت سهیم شده و همه کشورها در بازی اداره جهان سرگرم شوند.

    دیوان بین المللی کیفری متعاقب تلاش صدساله جامعه جهانی متاثر از شدت وقایع قرن بیستم در نقض حقوق بنیادین بشر در سال 1998طی نشست رم به منظور مجازات ناقضان حقوق کیفری بین الملل و تحقق اصل منع بی کیفری تشکیل شد؛ اصل و هدفی که باوجود حق جامعه بین المللی بر همزیستی مسالمت آمیز، به موجب عدم موفقیت دیوان بین المللی کیفری در برابر جنایات داعش با چالشی جدی مواجه شده است. صاحبنظران، موانع محاکمه و مجازات مرتکبان جنایات بین المللی در چارچوب اساسنامه دیوان بین المللی کیفری را اغلب در دو دسته موانع نظری و موانع ناشی از نقایص اساسنامه مطرح کرده اند، اما جامعه بین المللی در قرن بیستم، قرن سازمان های بین المللی با پیشرفت های قابل توجهی در زمینه تنسیق روابط اجتماعی از طریق تصویب کنوانسیون های متعدد به منظور تحقق عدالت کیفری مواجه بوده که کنوانسیون مبارزه با فساد (مریدا 2003) در این زمره است اما این نظام از بعد تکوین نهادهای ضامن روابط اجتماعی بین المللی کماکان در مراحل توسعه قرار دارد. نتایج تحقیق مبین آن است که فساد سیاسی به مفهوم رفتار منحرف شده مقامات از ضوابط و وظایف رسمی خود به دلیل ملاحظات خاص به عنوان یکی دیگر از موانع امحای بی کیفری است. هرچند مصونیت سران و اعضای داعش از تعقیب و مجازات به ضعف ساختاری دیوان بین المللی کیفری منتسب می شود، البته ترمیم شکنندگی این ساختار پیش از ابتلا آن به سرانجام جامعه ملل، ضروری به نظر می رسد.

    اثرگذاری انسان بر محیط پیرامونی خود به حدی رسیده که ماهیت و اهمیت جهانی یافته و بقای نسل انسان و سلامت او به وجود محیط زیست سالم و پاک منوط شده است. ماموریت بنیادین سازمان ملل، حفظ نسل های آینده از مخاصمه و هدف اصلی یونسکو نیز یاری رسانی به منظور حفظ صلح و امنیت به واسطه توسعه همکاری میان ملل و با مدد از آموزش و پژوهش علم و فرهنگ عنوان شده است. طی سده اخیر، مخاصمات فراگیر و متعدد بین المللی و غیربین المللی، حیاتی ترین عنصر خارجی برای دوام حیات نوع بشر در معرض تجاوزات بی شمار را هدف قرار داده و بشریت را مشغول خود کرده است. از نخستین روزهای شکل گیری تمدن انسانی، مدیریت آب چالش اصلی بشر بوده و آب به عنوان نخستین منبع حیاتی، جوامع انسانی و اقتصاد را دچار محدودیت کرده است. در قرن 21 نحوه مدیریت و حفاظت از منابع آب (رودخانه ها، تاسیسات و آب های زیرزمینی) به هنگام بروز مخاصمات، همت همگانی را می طلبد تا جایی که مجمع عمومی در جولای 2010، حقی نوین به میثاق حقوق بشر با عنوان «حق همگانی دسترسی به آب سالم» اضافه نمود و دهه 2005 تا 2015 را دهه آب و شعار «آب گنج هزاره سوم» اعلام کرده است. هدف از این مقاله، بررسی این موضوع است که آیا حقوق بشردوستانه حاوی اصول و قواعدی هست که ناظر بر نحوه حمایت و حفاظت از آب در همه انواع آن از قبیل رودخانه ها، تاسیسات آبی، منابع زیرزمین و غیر است و چگونگی مواجهه نیروهای نظامی با این ماده حیات بخش است؟

    With the upsurge of conflicts between governments and oppositions and these conflicts escalating and reaching the border of non-international armed conflicts, we are witnessing the reaction of other governments and international organizations to what is happening in these situations. Reactions that sometimes have lead to dominance of one party over another and sometimes have only flared up the flames of conflicts. However, what is important in addition to (above all of) these kinds of stances and the results of such stances, is the competence of these international organizations for their performance, which until recently could be considered as interference in one of the most sensitive and important internal affairs of governments- who are the most important members of the international community. In this paper, by studying on the competence of international organizations and case studying of two important international organizations which are the Arab League and Organization of Islamic Cooperation, during recent years’ conflicts in Libya and Syria, we will try to resolve as much ambiguities as possible in this regard.

    In UNs history, the Legality of Security Council Resolutions, in many cases, is challenged. Generally these challenges take by states that affected Security Councils decisions. With notice that states are the representative for implementation of SCR's, they intervene their determination and interpretation in the way that implement SC decisions. In some cases domestic and regional courts evaluate the state's action in implementation SCRs. Although these cases couldn’t provide direct review on Resolutions but affected in the way of implementation. Evaluation by states is probable and arises some concerns about decrease effectiveness of SC in maintenance of international peace and security.

    One of the activities of the Human Rights Council has spread by its establishment in 2006, is the use of human rights experts to investigate, analyze and monitor the human rights situation in states. Special procedures, name of mechanisms that former Commission on Human Rights, it has developed and council afford them to the human rights situation in specific countries or territories (Country Mission) or important phenomena of human rights violations worldwide (Mission thematic) monitor. The main argument is that Human Rights Council to take significant steps in the mechanism of "special procedures" in the order of codified human rights, benefit precious experiences in human rights monitoring. With the removal of defects former Commission on Human Rights and also, Updated institutions and its mechanisms, many experts praised the mechanism of special procedures and this tool have been introduced as universal standard and non-infringement and the importance of its efforts; in this present article, we explain the achievements of this mechanism, the Human Rights Council in establishing reporting post will be discussed.

    Undoubtedly, United Nations is the most effective international organization that has played the most important role in relations between states and thus has acquired considerable prestige among the main subjects of international law (States). Security Council as the political body and International Court of Justice as the judicial body of the organization, have had an important role in achieving this prestige. However, the relationship between the two organs has been always discussed in various fields because of the silence of the UN Charter. By considering of subjects such the possibility of simultaneously raising an issue in the Court and Security Council, the possibility of handling of political issues in the Court and handling of legal issues in Security Council, the possibility of creation of jurisdiction for the Court by Security Council, and the possibility of judicial supervision of the Court on the Council, this article endeavored to response to the main challenge which are there precedence interrelation those?

    Wisdom of League of Nations has failed because of inability to set a leadership for world order and award appropriate monetary to that day’s powers and bring again the disaster of war. These shortcomings with wisdom resolved with implementation of Veto in the UN system, and the World found a new approach. But over time, the emergence of new powers followed by weakness of old ones and reaching most countries to the maturity of the collective life, resolves the global need for a leadership and the international community which still retains its old structure, dropped in another type of silliness which necessarily do not resolved by discussion. It is necessary to avoid another disastrous war, contribute all the international powers to the bureau of the international community in the Security Council and gave all of them clear shared responsibility to run the game of the world.     Following the centuries-old efforts of the international community, strongly influenced by the events of the twentieth century in violation of fundamental human rights, in 1998, during a meeting in Rome to punish violators of international criminal law principle of non-impunity International Criminal Court was formed. The failure of the International Criminal Court for crimes of Daesh, despite the international community's principle and the goal of a peaceful coexistence, has been seriously challenged. Experts have raised that barriers to prosecute and punish perpetrators of international crimes, in accordance with the Statute of the International Criminal Court, are often classified in two groups of theoretical obstacles and obstacles caused by defects in the Articles of Association. But the international community in the twentieth century, century of international organizations, faced with significant improvements in the formulation of social relations through the adoption of numerous conventions in order to achieve criminal justice. The Convention against Corruption (Merida 2003) is in this category. But after developing the system of social relations guarantor of international institutions is still in the development stages. The results showed that another obstacle is eradicating impunity as special is political corruption in terms of deviant behavior by officials and their official duties. However, immunity from prosecution and punishment of leaders and members of Daesh, is attributed to the structural weakness of International Criminal Court. The fragility of the restoration of the structure before finally getting it to the League of Nations appears necessary.

    Human’s impacts on his perimeter environment are reached to a level that has gotten global essence and importance. The human beings existence and his health are depending on safe and pure environment. Fundamental mission of United Nation's Organization is to save future generations from scourge of war and UNESCO main goal is to assist in order to save peace and security through expansion of cooperation between nations by taking assistance from culture, science and education. During recent century, numerous international and non-international conflicts is targeting the most vital external element of mankind survival by many aggressions and made man engagment to itself. From the beginning of human civilization, water management is the main challenge of mankind and water as the first source of life, has limited human and economical communities. In 21 Century, managing and saving water sources (rivers, installations and subterranean waters) need common ambition in hostility time. Therefore in July 2010, General Assembly added a new right to human rights covenant called “public right of accessibility to clean water” and it announced decade of 2005 to 2015 as water decade with the motto of “Water, Third Millennium Treasure”. The aim of the article is to review the subject that human rights are consist of principles and rules that are observing on the method of supporting and saving water in all of its forms like rivers, water installations and underground sources and how military forces face to this resuscitative material.
