    خرید و فروش خون به عنوان یکی از راه های متداول تهیه خون و فرآورده های خونی همواره مخالفین و موافقین خود را داشته است. خصوصیات و ویژگی های منحصر به فرد این عضو از بدن در مقایسه با سایر اعضا، توجه به اهداکننده به عنوان یک منبع تجدیدپذیر و دائمی تهیه خون، سهولت انتقال، تاثیرات به سزای پزشکی و کاربرد ویژه این عنصر حیاتی و فرآورده های آن در زمینه های دارویی، زمینه کالا انگاری، خرید و فروش و سوء استفاده از آن را فراهم نموده و صرف نظر از مخاطرات ناشی از توزیع خون آلوده، باعث به خطرافتادن ارزش های اخلاقی و انسانی از قبیل نوع دوستی گردیده و انسان را در ردیف اشیا و اموال قرار داده است. این امر، موجب دخالت سازمان های بین المللی از طریق صدور بیانیه، اعلامیه، توصیه نامه و تصویب قطع نامه و به تبع آن، تحول نظام های حقوقی در جهت حفظ کرامت و شان والای انسانی گردید. بررسی این موارد نشان می دهد که خرید و فروش خون، باید بدون کالا انگاری، همراه با رعایت جانب ضرورت برای نجات جان انسان و با نظارت کامل دولت ها و قانونگذاری کامل و بدون ابهام در این زمینه، صورت پذیرد.

    این تحقیق به نمایش تاثیر ریسک مسوولیت تولیدکنندگان دارو بر قیمت دارو در سه نظام حقوقی ایران، انگلستان و آمریکا می پردازد.
    با بررسی نوع و مبنای مسوولیت برای تولیدکنندگان دارو در این سه نظام حقوقی به این نتیجه رسیدیم که در حقوق آمریکا، پذیرش مبنای محض و خصوصی بودن شرکت های دارویی و بالابودن تعداد شکایت زیان دیدگان دارو و وجود هیات منصفه در دعاوی، نشان از ریسک بالای مسوولیت دارد که همین امر افزایش بی حد و حصر قیمت دارو را در پی داشته است. در حالی که در انگلستان به علت پذیرش مسوولیت محض به شکل محدود، دولتی بودن شرکت های دارویی و عدم وجود شرایط خاص بر دادرسی این نوع دعاوی، ریسک مسوولیت تولیدکنندگان دارو پایین و در نتیجه افزایش قیمت دارو محدود می باشد. در حقوق ایران علت افزایش بی رویه قیمت دارو از باب بالابودن ریسک مسوولیت نمی باشد، چراکه ریسک مسوولیت تولیدکنندگان دارو در ایران بسیار پایین است، بلکه این نرخ بالا علت های دیگری دارد.

    قرارداد درمان از عقودی است که برای هر یک از طرفین آن، یعنی بیمار و پزشک (یا مرکز درمانی) تعهدات متقابلی را در پی دارد؛ تعیین دقیق حدود و ثغور این تعهدات در اجرای بهتر عقد درمان و به ویژه تضمین حقوق بیمار نقش به سزایی دارد. امری که قانونگذار ایران کم تر به آن پرداخته و صرفا در بعضی قوانین و آیین نامه ها به طور پراکنده برخی از تعهدات پزشک را بیان کرده است. حال آنکه این موضوع مورد توجه قانونگذاران تعدادی از کشورهای اروپایی از جمله هلند و آلمان قرار گرفته و بخشی از قانون مدنی خود را به مقررات خاص عقد درمان اختصاص داده اند. در سند طرح چارچوب مشترک مرجع نیز که طرح قانون مدنی آینده اروپا محسوب می شود، مقررات عقد درمان در بخش مربوط به عقود معین گنجانده شده است. در این مقاله به بررسی تعهدات متقابل طرفین عقد درمان در سند مذکور و حقوق برخی کشورهای اروپایی و همچنین حقوق ایران پرداخته شده است.

    قاعده احسان و آثاری که بر موضوع و مجرای این قاعده ممکن است از لحاظ تکلیفی و وضعی تحمیل گردد، از اهمیت فراوانی برخوردار است تا جایی که بر اساس دیدگاه مشهور میان فقها و حقوقدانان، قاعده احسان مستقلا یکی از عوامل سقوط ضمان شمرده می شود. بر اساس این دیدگاه، برای به جریان افتادن قاعده احسان و سقوط ضمان، لزوما بایستی احسان قصدی و فعلی موجود باشد. بر مبنای این نظر و در مورد پزشک نیز اگر او را از مصادیق محسن فرض کنیم، هرچند که در این مورد اختلاف وجود دارد، وی فاقد مسوولیت خواهد بود. در قانون مجازات اسلامی مصوب 1392 برخلاف قانون پیشین، صریحا به این قاعده اشاره شده است و این در حالی است که در مواد دیگر و بنا بر نظرات فقهی، مبنای مسوولیت، احراز رابطه استناد است، فلذا این شبهه ایجاد می شود که بالاخره، قاعده احسان مسقط مسوولیت پزشک است یا موجب عدم احراز رابطه استناد؟ این مقاله در پاسخ به این سوال، با تفکیک مسوولیت پزشک به دو حالت وضعی و تکلیفی، قلمرو جریان قاعده احسان را در این دو حوزه مشخص و قصد خیرخواهانه پزشک را تنها رافع مسوولیت تکلیفی او دانسته و وجود احسان در فعل را باعث سقوط ضمان وی می داند، ضمن این که با نقد نظر موجود مبنی بر استقلال قاعده احسان در سقوط ضمان، تاثیرگذاری قاعده احسان را مستلزم عدم وجود رابطه استناد دانسته و در واقع به احراز استناد در توجه مسوولیت به محسن، موضوعیت می دهد و احسان را در ارتباط با استناد و در طریقیت احراز آن موثر می داند.

    تشخیص و تایید مرگ مغزی به موجب ماده 2 آیین نامه اجرایی قانون پیوند اعضا بر عهده تیمی متشکل از متخصص نورولوژی، جراح مغز و اعصاب، داخلی و بیهوشی می باشد. به موجب ماده 1 قانون مسوولیت مدنی اعلام کنندگان مرگ مغزی در صورتی که در تشخیص، خسارتی وارد کنند، باید جبران نمایند. قانون مجازات اسلامی سال 1375 در ماده 319، پزشک را به طور مطلق ضامن می دانست، اما قانون مجازات اسلامی 1392 در بیان مسوولیت مدنی پزشکان در ماده 495 از نظریه فرض تقصیر پیروی کرده است، لذا پزشک در مقام دفاع می تواند به عدم تقصیر، اثبات تقصیر ثالث و انتساب به علت خارجی استناد نماید. از طرفی اثر حقوقی رضایت به موجب مفاد مواد 158 و 495 و496 قانون مجازات اسلامی 1392 در صورتی که عوامل تشخیص مرگ مغزی رعایت موازین فنی و علمی و نظامات دولتی را در تشخیص مرگ مغزی بنمایند، مسوولیتی ندارند، اما چنانچه با وجود رضایت، موازین فنی و علمی و نظامات دولتی را رعایت ننمایند، مسوول خواهند بود و باید خسارت وارده را جبران نمایند.

    در جایی که مجنی علیه با استفاده از امکانات پزشکی عضو قطع شده را به بدن خود پیوند زند و از نظر قانونی و شرعی این حق را برای وی به رسمیت بشناسیم، این سوال مطرح است که آیا حق قصاص وی ساقط می گردد یا خیر؟
    در پاسخ به سوال یادشده، هرچند دیدگاه های متعددی مطرح است، به نظر می رسد با وقوع جنایت حق قصاص برای مجنی علیه ایجاد می شود و استفاده یا عدم استفاده وی از پیوند عضو، تاثیری در این حق ندارد و استناد به مماثلت در بقای اثر جنایت تا زمان قصاص یا مقایسه ترمیم عضو به ترمیم دندان و سقوط حق قصاص، قابل قبول نیست.

    قرارداد انجماد جنین و گامت، قراردادی است که بین متقاضیان انجماد جنین و گامت از یک سو و مراکز ارائه دهنده خدمت انجماد از سوی دیگر جهت انجماد جنین و گامت متقاضیان و نگهداری از آنها منعقد می گردد. این مقاله درصدد بررسی شرایط صحت، تعهدات طرفین، ضمانت اجرای نقض آن ها و صور انحلال قرارداد انجماد جنین و گامت می باشد. روش تحقیق در قسمتی از نوشتار مروری و در قسمتی تحلیلی توصیفی بوده است. با توجه به مقاله حاضر، رعایت شرایط اساسی صحت معاملات به ویژه درباره مورد معامله و مشروعیت جهت قرارداد مزبور، مسائل جدیدی را ایجاد می کند. به علاوه این قرارداد به دلیل نامعین و جدیدبودن، مسائل تازه ای را در باب تعهدات طرفین، ضمانت اجرای آن ها و صور انحلال قرارداد انجماد به وجود می آورد. قرارداد انجماد، قرادادی معتبر می باشد. مراکز انجماد ملزم به دادن اطلاعات پزشکی، انتقال جنین در زمان تقاضا، نگهداری از جنین و گامت های منجمد هستند. متقاضیان نیز متعهد به تعیین تکلیف جنین و گامت منجمد در زمان پایان قرارداد و پرداخت اجرت قراداد می باشند. طرفین در صورت نقض تعهدات خویش مسوول شناخته می شوند. این قرارداد ممکن است به صورت قهری و ارادی که هر یک دارای صور مختلف می باشند، منحل گردد.

    Buying and selling blood as a common way to provide blood and blood products always have pros and cons. The unique feature of blood with compare to other organs of the body, attention to the blood donors as a permanent and renewable source, ease of transfusion, contributed medical and special applications of this vital element and its products in the fields of pharmaceutical, have led to goods assumption field as well as misuses, and, regardless of the risks of distributing contaminated blood, would jeopardize the moral and human values such as altruism and, put humans as a property. This ends in the intervention of international organizations through making statement, declaration, recommendations and resolutions and consequently, the development of legal systems in order to maintain the dignity and supreme dignity of humans. This study shows that buying and selling blood must be without commodity conception, with respect to being necessary to human life and to monitor the state and the full legislation in this area can be applied.

    This study shows the effect of risk of pharmaceutical manufacturer's responsibility on the prices of medicines in the legal system in Iran, England and United State of America.
    By examining the type and responsibility of pharmaceutical manufacturers in these three legal systems, we concluded that in the legal system of the United State of America, acceptance of strict liability, private pharmaceutical companies, high number of complaints and jury attendance for claims show a high risk of liability which leads to high increase in pharmaceutical prices. In the UK due to limited responsibility, non-private pharmaceutical companies, lake of special circumstances in judge in this type of claims, liability risk for manufacturers is low. In sum, it causes low prices of medicines. However, in Iran' skyrocketing medicine is not for the reason of liability risk because liability risk is very low.

    A treatment contract involves joint obligations for the contracting parties which are normally a patient, a physician or a health center. A precise and detailed determination of the scope of these obligations plays a crucial part in the performance of the contract and specially in securing patients’ rights. This is what the Iranian legislator has failed to address or better to say that only in some separated regulations there have been a set out of rules in regards to some obligations of physicians. On the other hand, the laws of some countries such as the Netherlands and Germany have devoted specific parts of their civil code to deal with treatment contracts. The Draft Common Frame of Reference (henceforth: the DCFR), which amounts to a draft of European prospective Civil Code, has also allocated specific provisions regarding treatment contracts in section addressing "specific contract". This study examines parties’ joint obligations in a treatment contract from the perspective of the DCFR, some European countries, and Iranian law.

    Ehsan Rule and the effects on it in terms of compensatory and non-compensatory liabilities are of great importance; to the extent that it independently and initially revokes the liability based on a famous view among jurists and Jurisprudents. Based on the mentioned-view, in order to trigger Ehsan Rule and termination of liability, intentional and actual benefaction should necessarily exist. Despite the existing disputes, if we consider the physician as an example of Mohsen (benefactor) he or she will not be counted as liable. This rule is explicitly mentioned in Islamic Penal Code 1392, unlike the previous law. In previous articles and juridical rulings, causality relationship is a basis for liability; therefore there is doubt whether Ehsan Rule finally revokes medical liability or doesnt obtain causality relationship.
    This paper, in response to this question, separates medical liability to compensatory and non-compensatory liabilities. It determines the scope of this rule in these two areas and considers the good intention of a physician as the only factor of invalidity for his or her mandatory liabilities and deems Ehsan in his or her act as the cause of liability termination. Meanwhile by criticizing this view-independence of Ehsan Rule in liability termination-It is believed that the effectiveness of Ehsan Rule requires lack of causality relationship and supposes it effectiveness in relation to causality.

    In accordance with Article 2 of the Executive Bylaw of Organ Transplantation Law, diagnosis and confirmation of brain death shall be made by a neurologist, an internist, and an anesthesiologist. On the basis of the civil liability, those individuals who declare brain death; should indemnify the damages if they impose as a result of their diagnosis in this process. Islamic criminal law 1375 (1996) in article 319 was absolutely adjudged doctors accountable; however, Islamic criminal law 1392 (2014) in Article 495 has followed the theory of fault in doctors civil liability. Therefore, the doctor can defense not fault, proved third person fault and invoke assignment to external causes. Based on Articles 158, 495 and 496 of criminal law in 2014, when was obtained consent; if they meet technical and scientific criteria in brain death diagnosis in the government system in brain death diagnosis does not accept responsibility; but in spite of consent, if they do not comply technical and scientific standards and government regulations, they will be held accountable.

    Where a victim with the use of medical treatments reattaches the cut-off organ to his/her body, supposing that we recognize his or her rights in terms of legal and legitimate rights in the mentioned-matter, this raises a critical question that is whether his/her right of retribution still remains?
    In response to this question, despite of the current, divergent views, it seems that by the occurrence of felony, the right of retribution for the victim is established and the use or non-use of organ reattachment has no effects on this right. Furthermore, this article concludes arguing that the effect of felony should remain to time of retribution and comparing the organ reattachment to tooth restoration, which causes deterioration of retribution rights, is not acceptable.

    Embryos and gamete cryopreservation contract is a contract between the embryos cryopreservation applicant and cryopreservation centers to freeze and preserve their embryos and gamete. This article aims to review constitutional conditions of validity, parties` obligation, sanction and dissolution methods of embryos and gamete cryopreservation contract. Research method has been revision in some parts and analytic- descriptive in other parts. Observing the constitutional conditions of validity of transaction especially about the case of transaction and legitimacy of the contracting parties` motivation bring up new issues. This contract also brings up new issues in parties obligation, their sanction and methods of the contract dissolution due to being new and indefinite. In Conclusion, The cryopreservation contract is a valid contract. Cryopreservation centers are obliged to provide medical information, to transfer the embryos in application time, to preserve the embryos and gamete cryopreservation; applicants are also obliged to take care of the cryopreservation embryos and gamete at the end of the contract duration. Both parties are responsible for violation their commitments. This contract maybe canceled voluntarily and forcibly based on different aspects.
