    چنانچه پزشک دارویی را برای بیمار تجویز نماید، ولی اطلاعات راجع به چگونگی استفاده از دارو و خطرات ناشی از آن را به بیمار ارائه ندهد، بلاشک بیمار قادر به استفاده از دارو یا در صورت استفاده خودسرانه، قادر به اخذ نتیجه مطلوب نخواهد بود. بنابراین تجویز دارو بدون ارائه اطلاعات راجع به مصرف آن، امری بی فایده و در مواردی نیز خطرناک است، ولی آیا چنین واقعیتی می تواند دلیلی برای الزام پزشک به ارائه اطلاعات دارویی باشد و یا باید گفت وظیفه اطلاع رسانی بر عهده پزشک نیست، بلکه تولیدکنندگان و یا فروشندگان دارو باید اطلاعات راجع به یک دارو را به همراه آن عرضه کنند. برخلاف نظر اخیر قاعده واسطه آگاه اطلاع رسانی به بیمار را در حیطه وظایف پزشک به عنوان تنها واسطه متخصصی که دارای اطلاعات کافی در خصوص وضعیت بیمار و نیز صدمات حاصل از دارو است، می داند. در حقوق ایران قانونگذار وظیفه اطلاع رسانی را بر عهده پزشک نیز قرار داده است، اما تنها در موارد قابل طرح در این مقاله پزشک به عنوان واسطه آگاه مسوول جبران خسارت ناشی از عدم ارائه اطلاعات دارویی است.

    مشارکت در تولید دارو در صنعت داروسازی پروژه ای است که به موجب آن یک محصول دارویی با مشارکت دو یا چند شخص حقوقی با آورده های مشخص تولید می گردد. در این مشارکت معمولا یک طرف دارای دانش فنی و فرمولاسیون دارو و طرف دیگر شخص یا شرکت صاحب سرمایه، امکانات و فضای تولیدی است. موفقیت در چنین پروژه هایی مستلزم انعقاد قرارداد حقوقی تحت عنوان قرارداد مشارکت در تولید دارو است. این قرارداد به طور عام مشمول قانون مدنی و قواعد عمومی قراردادها و به طور خاص تابع قوانین دارویی و بخشنامه ها و مصوبات وزارت بهداشت و سازمان غذا و دارو از جمله بخشنامه «ضابطه تولید قراردادی» و آیین نامه ثبت دارو می باشد. در این قرارداد، باید مفاهیم دارویی و پزشکی با مبانی و قواعد حقوقی کاملا هماهنگ و تلفیق گردند تا قرارداد ضمن جامع و کامل بودن، بتواند اختلافات را پیشگیری و امنیت حقوقی طرفین را تامین و اهداف پروژه را محقق نماید. مواردی نظیر جنبه های مالکیت فکری و نوآوری، حدود مسوولیت مدنی در برابر مصرف کنندگان، تضمین یا عدم تضمین حصول نتیجه از جمله مباحث مهمی است که باید در متن قرارداد پیش بینی گردد. به علاوه، تنظیم این قرارداد مطابق با ضوابط سازمان غذا و دارو جهت تایید و اخذ موافقت اصولی و پروانه ساخت دارو نیز لازم است. بنابراین ضرورت بررسی حقوقی چنین توافقاتی از دیدگاه نگارش قراردادی مشخص و واضح است. این مقاله تلاش می کند تا با اتخاذ رویکردی کاربردی در ارتباط با شیوه تنظیم قرارداد، به تحلیل و بررسی جنبه های حقوقی قرارداد مشارکت در تولید دارو بپردازد.

    زمینه و هدف
    بر اساس اصل «آزادی قراردادها» و عموم ادله ای مانند «تجاره عن تراض»، حاکمیت اراده و تراضی طرفین مهم ترین عامل مشروعیت عقود و قراردادها دانسته شده است، در حالی که امروزه قراردادهای درمان در مراکز خصوصی با دخالت دولت در روابط مالی بین پزشک و بیمار محدود شده است و پزشکان ملزم به رعایت آن می گردند.
    روش
    روش مقاله حاضر توصیفی تحلیلی است و شیوه گردآوری اطلاعات، کتابخانه ای می باشد.
    یافته ها
    طبق احکام اولیه، حکومت نمی تواند قیمت خاصی را برای ویزیت کادر درمانی در مراکز خصوصی تعیین نموده و پزشکان را به رعایت آن ملزم نماید، بلکه پزشک می تواند با توافق با بیمار، با توجه به مهارت، تجربه و حساسیت عمل خود و همچنین با نظر به عرف و شرایط اقتصادی جامعه برای ارائه خدمات خود حق الزحمه تعیین نمایند و دلیل فقهی بر حرمت اخذ این مبلغ وجود ندارد. برخی نیز اگرچه لازم الاجرابودن کلیه احکام حکومتی را بر اساس شریعت پذیرفته اند، اما از آنجا که خطاب شرعی از ناحیه خداوند را متوجه مصادیق و جزئیات احکام حکومتی نمی دانند، شرعیت داشتن مصادیق و موضوعات احکام را نمی پذیرند.
    بحث و نتیجه گیری
    حفظ نظام جامعه اسلامی واجب است و تعیین تعرفه پزشکان توسط دولت لازمه حفظ نظام معاش مردم در مساله بهداشت و درمان است، زیرا در غیر این صورت هر پزشکی می تواند مبلغ زیادی را از بیماران مطالبه کند و ممکن است گروه کثیری از مردم از این خدمات محروم بمانند. از طرفی وقتی شرعی بودن حکم وجوب اطاعت احکام حکومتی را به صورت کلی پذیرفتیم، نمی توانیم بگوییم این حکم در مورد اجزا صدق نمی کند، زیرا کلی، وجودی جدای از اجزای خود ندارد. بنابراین اخذ زیرمیزی علاوه بر این که عملی مجرمانه است، حرمت شرعی نیز دارد و پزشک هم مرتکب گناه شده و هم ملزم به استرداد مالی است که از بیمار اخذ کرده است.

    یکی از موافقت نامه های اصلی تحت شمول سازمان تجارت جهانی، موافقت نامه اقدامات بهداشتی و بهداشت گیاهی (Sanitary and Phytosanitary Measures) است که اختصارا (SPS) نامیده می شود. این موافقت نامه برای اعضای سازمان تجارت جهانی چارچوبی از قواعد را به منظور اتخاذ و استفاده از اقدامات بهداشتی و بهداشت گیاهی فراهم می آورد. هدف اقدامات دسته اول باید حفاظت از سلامت انسان و حیوان باشد و دسته دوم چنانچه از نامش برمی آید بر حفاظت از حیات و سلامت گیاهان متمرکز می باشد، با این حال هدف نهایی هر دو اقدام حفظ سلامت بشری و محیط زیست است. از نمونه های شناخته شده این اقدامات می توان به استانداردهای تغذیه، شیوه های صدور مجوز، ضوابط مربوط به حمل و نقل و یا قرنطینه اشاره کرد.
    کشورهای عضو موافقت نامه SPS می توانند از طریق اعمال اقدامات بهداشتی و بهداشت گیاهی مشروع، مانع از ورود کالاهای مضر و تهدیدکننده سلامت و حیات شهروندانشان به داخل قلمروشان شوند. از آنجایی که هدف سازمان تجارت جهانی آزادسازی تجارت است، اعمال هر گونه محدودیت تجاری با شرایط و ضوابطی همراه است که نادیده گرفتن آن ها موجب مسوولیت بین المللی دولت عضو خواهد شد.
    در همین راستا موافقت نامه SPS و ضمائم آن نیز شرایط توسل به اقدامات بهداشتی و بهداشت گیاهی را در قالب اصلی ترین تعهدات دول عضو بیان کرده اند که شامل ضرورت، داشتن توجیه علمی و ارزیابی خطر می شود. این سه شرط ملاک های تعیین کننده در احراز مشروعیت اقدامات بهداشتی دولت های عضو محسوب می شوند.
    در پژوهش حاضر ضمن بررسی دقیق این شروط، تلاش گردیده تا رویه قضایی مرتبط با اعمال آن ها از منظر حفاظت از سلامت مورد نقد و ارزیابی قرار گیرد.

    در سال های اخیر طب سنتی و مکمل از سوی جامعه با اقبال زیادی مواجه بوده است، اما متناسب با این گسترش شاهد حمایت قانونی و بسط و تکامل حقوقی در این حوزه نبوده ایم. درگذشته چند بار شاهد ممنوعیت طبابت در حوزه طب سنتی بوده ایم. برخی ازشاخه های طب مکمل نیز با مشکلات مشابهی رو به رو بوده است. در دهه اخیر پس از انتشار راهبرد توسعه طب سنتی توسط سازمان بهداشت جهانی (WHO) در ایران نیز فضا برای ادامه فعالیت طب سنتی مساعد گردید. این فراز و فرودهای بسیار، ضرورت طرح بحث های بنیادین حقوقی را در این زمینه مضاعف می کند. هدف مقاله حاضر تبیین جایگاه حقوقی طب سنتی و مکمل و اصلی ترین چالش های حقوقی است که در نظم کنونی ایران در این زمینه به منصه ظهور رسیده است. روش این مطالعه اسنادی و متکی به تحلیل حقوقی است. این مطالعه چهار چالش عمده را بازشناسی کرده است که عبارتند از: چالش مخالفت یا موافقت با نظم عمومی و اخلاق حسنه، چالش تفسیر دوگانه از حق بر سلامتی، کدگذاری نشدن همه دانش های بومی طب سنتی و مکمل و در نهایت ضعف هویت صنفی. توجه ویژه به رفع چالش های چهارگانه، کم و بیش مورد توجه سایر نویسندگان نیز بوده است. دو چالش نخست جنبه فکری و نظری و چالش سوم و چهارم جنبه عملی دارند. کمکی که این شاخه های طب به تامین دسترسی به خدمات پزشکی و توسعه حق انتخاب مردم می کنند باید مورد توجه قرار گیرد. موضوع گسترش دسترسی به خدمات پزشکی و تنوع دسترسی با ایده حق بر سلامتی سازگارتر است، زیرا گسترش شاخه هایی چون طب سنتی و مکمل خود به خود موجب توسعه دسترسی به خدمات پزشکی و تنوع بیشتر آن ها می شود، پس از آن، مساله کیفیت خدمات مطرح می شود. در زمینه تضمین کیفیت، مشارکت بیشتر متخصصان طب سنتی و مکمل در ترکیب هیات های نظارتی و بهره گیری از الگوی تلفیقی نظارت می تواند به کاهش مشکلات موجودکمک کند.

    یکی از نکات اساسی در بحث از استفاده آزمایشی به عنوان یکی از استثنائات حمایت از اختراعات، تعیین موضوع آن است. از جمله معیارهای رایج در این راستا تفکیک هدف تجاری از غیر تجاری در انجام آزمایش است که در ادبیات حقوق ایران نیز تاکنون مورد بررسی قرار گرفته است. با این حال، معیاری دیگر برای تعیین این موضوع، تفکیک آزمایش «بر» روی اختراع از آزمایش «با» استفاده از آن است.
    به طور سنتی، موضوع استثنا، آزمایش «بر» روی خود اختراع است و تقریبا در تمام نظام های حقوقی، این امر پذیرفته شده است، اما با رشد سریع برخی از حوزه های علمی به ویژه زیست فناوری، نوآوری هایی ظهور یافته اند که از یکسو، اختراع محسوب می شوند و از سوی دیگر، خود به عنوان ابزاری برای انجام سایر تحقیقات به کار می روند. در اینجا این سوال مطرح می شود که آیا آزمایش «با» استفاده از یک «ابزار تحقیقاتی» اختراعی نیز می تواند موضوع استثنای استفاده آزمایشی قرار گیرد یا خیر.
    در این تحقیق، نظام های حقوقی ایالات متحده و آلمان به طور تطبیقی با حقوق ایران مقایسه شده است. نتایج به دست آمده نشان می دهد، اگرچه برخی صاحب نظران معتقدند دست کم باید به دانشگاه ها و موسسات تحقیقاتی غیر انتفاعی، اجازه استفاده از این گونه اختراعات را بدون دریافت مجوز داد و آن ها را از شمول عنوان نقض، خارج کرد، اما ظاهرا رویه قضایی نظام های مزبور، گسترش قلمرو موضوعی استثنا به این دسته از اختراعات را نپذیرفته و در عوض به دنبال راه کارهای دیگری برای پاسخ به این دغدغه نوظهور بوده است.

    سازمان های امدادی بشردوست در جریان انجام فعالیت های بشردوستانه خود در شرایط مخاطره بار مخاصمات مسلحانه، با چالش های بسیاری مواجه هستند. برخی از این چالش ها به کلیت قواعد حقوق بشردوستانه باز می گردد که تنظیم نحوه فعالیت امدادگران خود جزئی از این قواعد است، اما بخش دیگر از این چالش ها، ناشی از فضای جدید حاکم بر فعالیت سازمان های امدادی بشردوست می باشد که سیمای مخاصمات مسلحانه کنونی را کاملا دگرگون کرده است. گسترش کمی این نهادهای بشردوست نیز خود چالش هایی را به وجود آورده است که از جمله آن ها می توان به دشواری برقراری هماهنگی در فعالیت امدادی، دوباره کاری ها و هدررفت منابع و ایجاد اختلال در فعالیت های بشردوستانه، اشاره نمود. این چالش ها به طور کلی از یکسو با در نظرداشتن ویژگی مخاصمات، به موقعیتی باز می گردد که عملیات بشردوستانه در آن صورت می گیرد و از سوی دیگر به تنوع در سنخ بندی انواع سازمان های امدادی ارتباط می یابد. چالش هایی که آن ها در جریان کمک رسانی به بیماران و مجروحان مواجه هستند، شامل تعرض و حمله به گروه های امدادی، عدم امکان برقراری هماهنگی در عملکرد گروه های امدادی مختلف در شرایط بروز بحران های انسانی، عدم امکان امدادرسانی موثر به منطقه بحران زده است که نهایتا سازمان های بشردوست را در دستیابی به هدف اصلی خود، یعنی برطرف کردن نیازهای مردم ساکن در منطقه بحران زده با دشواری مواجه کرده است.

    بحث جرم زدایی از مصرف مواد مخدر آرام و یا نرم که متعاقب طبقه بندی مواد مخدر به دو گروه آرام و سخت مطرح شده است، دارای سابقه علمی و عملی بسیاری در دو کشور هلند و ایالات متحده آمریکا است. مواد مخدر آرام به آن دسته از مواد مخدر گفته می شود که از حیث اعتیادآوری بسیار ضعیف بوده و دارای آثار درمانی بالایی هستند. جرم زدایی از مصرف مواد مخدر آرام، مستظهر به دلایل و توجی هات حقوقی و بهداشتی است. از بعد حقوقی گفته شده که مساله مواد مخدر اولا و بالذات مساله ای مربوط به حوزه بهداشت و درمان است و مداخله حقوق کیفری در این حوزه تنها باید به عنوان آخرین حربه قلمداد گردد. به علاوه از دیدگاه کیفرشناختی، مجازات مصرف کنندگان مواد مخدر آرام، بی جهت، بی اثر، بدون نفع و فاقد ضرورت است. احترام به حریم خصوصی افراد و باورهای مذهبی ایشان از یکسو و اجتناب از برچسب زدن به مصرف کنندگان این مواد از جمله توجی هات حقوق بشری در موافقت با جرم زدایی است. از بعد بهداشتی نیز موافقان با تکیه بر کثرت تحقیقات علمی و گزارشات رسمی منتشرشده بر این باورند که نه تنها مصرف برخی از انواع مواد مخدر آرام مانند حشیش موجب بروز بیماری نیست، بلکه نقش موثری در درمان امراض صعب العلاجی همچون ام.اس، ایدز، هپاتیت، دردهای مزمن و... دارد.

    If the doctor prescribes the medicine for the patient without presentation of information about the way and the danger of use it, certainly the patient cannot use the medicine or cannot achieve to the perfect consequence. In fact, the prescription of the medicine without presenting the information about the way of using is ineffective and in some situation is dangerous. In any event, can this reality be the reason of the obligation for the doctor? Or it must be say that the duty of presentation of information is not on the doctor but the producer and the seller of the medicine must present these information. Unlike this approach, according to the Learned Intermediary Rule, the duty of presenting this information is on doctor as an only expert intermediate that has sufficient information about the situation of the patient. In Iranian law, the legislator has held the duty of the presenting the information on the doctor but only in some position the doctor as a learned intermediate, is liable for compensation due to failure to presenting the information.

    Collaboration in drug delivery is a project by which a pharmecutical product is delivered through the cooperation of two or more legal persons. In this cooperation, a party contributes to the project with know-how and formula of a medicine and the other party provides site, necessary fund and equepments. Success in such a project requires a legal agreement entitled collaboration contracts in drug delivery. The contract is governed generally by Civil Code and general principles of contracts, and specifically by pharmecutical regulations provided by the ministry of health and food and drug administration. These regulations include the rules and contractual delivery and the regulations drug registration. In this contract, medicial and phamacutical terms sould be harmonized with legal principles and rules so that not only is the contract comprehensive but also it would be able to prevent disputes and bring about legal security for parties and help to fulfill the goals of projects. Issues such as intellectual property aspects, civil responsibility to the customers and gauantee of the results, or otherwise, are the critical subjects that sould be foreseen in such contracts. In addition, the contracts should be written in full accordance with regulations of ffod and drug administration sinceit is necessary to obtain marketing permission and liesence of drug delivery. These points highlights the importance of such contracts. This article tries to examine and analyze legal aspects of the collaboration contracts in drug delivery in practice.

    Background And Aim
    Based on the principle of "Freedom of Contracts" and many arguments such as Tijara-An-Traz which translates as "Trade based on Mutual Consent", autonomy and mutual consent of the parties is considered the most important factor for legitimacy of contracts and deals. Today, however, treatment contracts in the private sector are limited with government’s intervention regarding the financial relationships between doctors and patients and physicians are required to follow governmental rules.
    Method
    This study uses a descriptive analytical methodology and data were collected from libraries.
    Findings: According to preliminary rulings, the government cannot set a certain price for the business of health staff in private centers and cannot force doctors to abide by it and the physician can, through an agreement with the patient, set a price for his medical services based on his skill, experience, gravity of the operation, common sense, and economic conditions of the society and there is no judicial reasoning on the prohibition to receive such money. Some others have accepted the legally binding nature of the governmental laws based on religious rulings but they do not believe it also concerns such examples and details of governmental laws and do not regard this issue as a religious ruling.
    Conclusion
    it is incumbent upon everybody to protect Islamic society and setting tariffs for medical services by the government is one of the ways to protect people’s rights regarding healthcare; otherwise, every physician can charge staggeringly extra money from the patients and many people may be deprived from these medical services. On the other hand, when the accept the legally binding nature of governmental rules and regulations, we cannot exclude these cases from such laws because every whole identity cannot be separated from its parts, therefore, not only is receiving kickbacks the criminal act, it is also religiously prohibited and the physician has committed a sin and must return the money received from the patient.

    The "Agreement on the Application of Sanitary and Phytosanitary Measures" is one of the main agreement under the auspices of the World Trade Organization (WTO) which is called SPS. This agreement includes the rules on application of sanitary and phytosanitary measures. The purpose of the first measure is protection of human health and life of animal. The aim of the second is on the protection of the health of the plant. Nevertheless, the ultimate goal is to protect human health and environment. Well-known examples of the measures can be noted as nutrition standards, licensing procedures transportation rules, and quarantine.
    Contracting States of the SPS can legitimately take the sanitary and phytosanitary measures to prevent the importation of hazardous materials, which are considered as a threat to health and life of their citizens, into their territory.
    Since the purpose of the WTO is to liberalize trade, the imposition of any trade restriction shall be in accordance with related terms and requirements which ignoring them may lead to the responsibility of the State. SPS and its supplements regulate the terms and conditions of resorting to these measures under the main obligation of the contracting States. These terms and conditions are necessity, scientific justification and risk assessment. These requirements are decisive criteria for finding the legitimacy of contracting State’s action.
    This article will examine and analyze these three requirements along with the related case law from the perspective of health protection.

    In recent years, traditional and complementary medicine has received a great interest from the public; however, the provided legal support to this field and the legal evolution and progress have not been aligned with its increasing popularity. We have experienced a ban on the practice of traditional medicine several times. Some branches of complementary medicine have also faced similar problems. In the last decade, due to the development and launch of WHO traditional medicine strategy, there has been a more positive environment for continuing the practice of traditional medicine in Iran. All these fluctuations intensify the necessity of raising fundamental legal issues in this area. This article aims to explain the main legal issues and challenges raised to the current order prevailing in Iran. The research method is documentary study based on legal analysis. The findings of this study have recognized four major challenges: rejection or acceptance of public order and Good morals, dual interpretation of the right to health, lack of coding for all aspects of indigenous knowledge of traditional and complementary medicine, and finally, the weakness of trade ::union::s identity.
    Special attention to addressing the four challenges, has been considered by almost other authors. The first two challenges are intellectual and theoretical, and the third and fourth ones are practical. The contribution of this branch of medicine to providing people access to medical services and right to health has to be considered. The issue of expanding accessibility and diversity of medical services is more consistent with the idea of right to health, because expanding some branches such as traditional and complementary medicine will automatically lead to more access to medical services and fosters their diversity. Then, the question of service quality arises. Concerning quality assurance, better participation of traditional medicine experts in monitoring boards and taking advantage of integrated supervision model may help to mitigate the existing problems.

    One of the basic matters in discussing the experimental use as an exception to patent rights is defining the subject of it. A criterion used in this regard is making a distinction between experiments done with a commercial purpose and the ones done with a non-commercial one. This approach has already been discussed in Iranian legal literature. Another approach, however, is differentiating between experimenting "on" an invention and experiments done "with" the help of a patented invention.
    Traditionally, it is accepted in most legal systems that the subject of the exception is experimenting "on" the subject-matter of the invention. However, with the fast growth of some fields of science such as biotechnology, there are innovations developed which could be patented as an invention on one hand, and used as a tool for carrying other researches out on the other hand. With this new development, the possibility of extending the exception to include experimentations done "with" the use of such research tools has been put into question.
    In the current research, the German and U.S. legal systems are comparatively studied with the Iranian one. The results show that although some patent scholars believe that at least universities and non-profit organizations should be exempted from infringement liability in this regard, the case law of these systems shows no acceptance of extending the exception to such experimentation but rather is in search for other solutions.

    Humanitarian Aid Agencies are dealing with various number of challenges in the course of their humanitarian operation in dangerous situation of armed conflict. Partly, these challenges are related to the problem of enforceability of International Humanitarian law, for instances regulating of aid workers operations belongs to this category. But the other challenges referred to the new emerging context of current armed conflicts which dictates whole new rule of conducts for Humanitarian aid operations. Also, numerical increasing of these humanitarian entities have created some other challenges like desperate need to harmonize their operations to avoid wasting limited resources, counter-productive measures, and frustration in the process of accomplishing their duties. All of these challenges generally, in one hand, are related to situation of armed conflict and other exigencies and in the other hand to the typology of different humanitarian aid organizations. These are the main factors which lead to inefficacy in the process of aiding stricken population. Enumerating the challenges which would be faced in the course of humanitarian operations including, numerous attacks on aid workers group, unwillingness to harmonize conducts of all these different entities helping population in crisis and inability to provide effective aid which eventually may led to the failure of humanitarian aid organizations to achieve their final targeted aim to meet the urgent needs of people in crisis or at least make it so formidable.

    Classification of drugs into two categories named soft and hard has a long history in Netherlands and United States of America. Soft drugs are believed to be non-addictive and less damaging to the health than hard drugs. According to this belief, decriminalization of soft drugs has much of pros. Their arguments for decriminalization may be gathered in two areas: law and health. The pros believe: From legal view of point, the soft dug problem belongs to health care area and using criminal sanction should be as the last resort. Imposing criminal sanctions to soft drug users is undue, ineffective, without interest and unnecessary. Respecting citizen privacy and religious beliefs in addition to respecting to their opinions and to refrain labeling them as addicted criminals are other arguments for decriminalization. In safety and health area according to plenty of scientific studies and reports, the pros, believe not only soft drug cause illness but also has important role in reliving pains and curing diseases like M.S, Hepatitis, AIDS, etc.
