    قدرت سیاسی به معنای توان تاثیرگذاری در حوزه اجتماعی، از مباحث محوری سیاست است. براساس نظام قدرت در قرآن کریم، خداوند قادر مطلق است و او بنا بر حکمت، افرادی را از قدرت انجام کار یا تاثیرگذاری بر دیگران برخوردار می گرداند. جبهه ایمان از قدرت اقناعی، نرم، نظامی و امدادهای غیبی برخوردار می باشد و کاربرد قدرت توسط آن برای حاکمیت دین در جامعه مشروع می باشد. کفار نیز از قدرت سخت از جمله نظامی، اقتصادی، تهدید، ایجاد تفرقه، تطمیع، و قدرت نرم نظیر تحقیر، تهمت زدن، جوسازی، شایعه پراکنی، سازشکاری، برای تسلط بر جبهه ایمان برخوردار م یباشند. چرایی و چگونگی حاکمیت کفار بر برخی از جوامع اسلامی، علی رغم فزونی منابع قدرت جبهه ایمان، مسئل های قابل تامل و تحقیق است. در این مقاله با مقایسه قدرت نرم و سخت جبهه ایمان و کفر، چرایی و چگونگی تسلط کفار بر جامعه مسلمانان را با استمداد از آیات قرآنی توصیف و تحلیل می کنیم.

    علامه طباطبایی، قدر مسلم محیی و مجدد حکمت در دوران معاصر بویژه در شهر، حوزه علمی و مکتب شیعی قم و معلم و مروج حکمت میباشد. ایشان از برجستگان حکمت اجتماعی اسلامی نیز بوده و بلکه برجسته ترین چهرگان شالودهساز و شاخص آن میباشد؛ چنانکه میتوان از ایشان به عنوان حکیم محض و نظری و حکیم اجتماعی و معرفت شناسی یاد نمود. فرضیه: نگاه، نظریه و نظام حکمت متعالی محض علامه طباطبایی ظرفیت بازتولید سیاسی و تاسیس نگاه، نظریه و نظام حکمت مدنی و سیاسی متعالی را داراست. به عبارت دیگر، نگاه، نظریه و نظام حکمت مدنی و سیاسی متعالی از نگاه، نظریه و نظام حکمت متعالی محض علامه طباطبایی قابل استنتاج، تولید و تاسیس است. این چنین تولید و بازتولید حکمت مدنی، اجتماعی و سیاسی امکان، نیاز و ضرورتی در خور توجه میباشد. این فرایند با روش استنباطی و استدلالی با تحلیل متن و محتوایی به شیوه دلالت مطابقت، یا تضمنی و گاه استلزامی صورت میپذیرد.

    این مقاله با مبنا قراردادن کارویژه های آموزش عالی، در صدد تبیین کارآمدی قدرت نرم آموزش عالی در جهت تحقق اهداف انقلاب اسلامی برآمده است. در این راستا دو پرسش اساسی مطرح می شود: آموزش عالی ایران از نظر قدرت نرم در چه وضعیتی است؟ کارکردهای آموزش عالی در دست یابی به اهداف انقلاب اسلامی چیست؟ برای تبیین مسئله و پاسخ به این دو سوال، به الگوی نظری کارکردگرایی دست یازید هایم. براین اساس، ضمن احصای کارویژه های آموزش عالی و کارآمدی قدرت نرم، به مهم ترین نقش های قدرت نرم آموزش عالی در تحقق اهداف انقلاب اسلامی اشاره و تبیین شده است؛ نظیر: ایجاد اقتدار ملی، تقویت مشروعیت، افزایش جذابیت انقلاب اسلامی، صعود رتبه ایران در تولید علم، افزایش اعتبار بین المللی ایران و ایجاد روحیه استقلال و خودکفایی.

    مقاله حاضر در صدد پاسخ به این پرسش است که اگر فهم و درکی که امام خمینی از انقلاب اسلامی ارائه می دهند را یک هنجار تلقی کنیم، چه نسبتی میان این هنجار و سیاست گذاری عمومی پس از انقلاب وجود دارد؟ در پاسخ، با استفاده از روش تحلیل محتوای کیفی و با رویکرد تفسیرگرایی، به صورت بندی تحلیل امام خمینی پرداخته و با بازخوانی برخی خط مشی های عمومی برای حل مشکلات اجتماعی پس انقلاب اسلامی، روشن می شود که امام در تبیین پیروزی انقلاب «انسان انقلابی» و تاثیرش در خلق هویت جدید به نام «اسلام انقلابی» اسلامی بر عنصر انقلاب» تاکید دارند. از منظر ایشان، این دو عنصر که ماهیتی فرهنگی دارند، زمین هساز شده و در تداوم انقلاب اسلامی نیز اهمیت محوری دارند. بر «انقلاب اسلامی» و «انسانی این اساس خط مشی های پس از پیروزی انقلاب اسلامی نه در چارچوب دولت ملت که در زمینه امت امامت طرح می شوند.

    جایگاه و ساختارحکومت متکی و متاثر از نحوه فهم آن از سوی حکومتگران است و حکومتگران بر اساس درک خود از حکومت، ساختارها و مناسبات آن را شکل داده و سازماندهی می کنند. حکومت تملیکیه یا ارباب وار و حکومت ولایتیه یا سرپرست وار، دو تلقی از حکومت را در دل خود حمل می کنند که اولی با رابطه عبد و مولا و دومی با رابطه امانت و امانتدار همریختی و تشابه دارد و هر یک از این دو، ساختارها و رفتارهای متناسب با خود را تولید می کنند و در خدمت اهداف قشر خاصی قرار م یگیرند. این مقاله در صدد تحلیل استعاره شناختی نظریه حکومت به مثابه وقف می باشد و در این راستا پس از تبیین مفاهیمی نظیر وقف، امانت و حکمرانی و مشابهت های دو مقوله حکومت و وقف، به شناسایی وقف و اهداف آن پرداخته و سعی شده است تلقی امانی از حکومت به صورت تحلیلی واکاوی شده و دستاوردهای ناشی از این تحلیل استعاری معرفی گردد.

    جایگاه حکومت بر اساس فقه شیعه در دو دوره مورد بحث قرار میگیرد: نخست، زمان حضور معصوم، که در این دوره حق حاکمیت برای معصوم(ع) ثابت است؛ دوم، زمان غیبت معصوم، که در این دوره درباره حق حاکمیت میان فقی هان شیعه اختلاف نظر است. در دوران غیبت برای فقی هان شئونی وجود دارد که عبارت است از: شان افتا و مرجعیت میان فقی هان «افتا و قضا» دینی، شان قضاوت و شان ولایت. در مورد ثبوت دو شان اختلافی نیست؛ اما در مورد ولایت داشتن فقی هان اختلا فنظر وجود دارد؛ در فرض ثبوت ولایت برای ایشان، در مورد قلمرو ولایت و حیطه نفوذ ایشان اختلا فنظر وجود دارد. در این مقاله با رجوع به متون فقهی شیعیان و بیان اقوال متقدمان و نیز متاخران از فقی هان شیعه، به تبیین شئون فقی هان در دوران غیبت معصوم، و سپس واکاوی قلمرو ولایت و حیطه نفوذ ایشان بر اساس آموزه های فقه شیعه م یپردازیم. در پایان، قلمرو نفوذ ایشان را در سه مرحله بررسی م یکنیم: 1. موارد قطعی داخل در قلمرو نفوذ فقی هان؛ 2. موارد قطعی خارج از محدوده نفوذ ایشان؛ 3. موارد اختلافی که محل نزاع میان فقی هان است.

    آزادی از مفاهیم مهمی است که در بسیاری از آموز ه های دینی و غیردینی مطرح شده و هر مکتب با توجه به دیدگاه خود، تعریف خاصی از آزادی بیان کرده است. در فقه اسلامی با توجه به تاکید قرآن بر آزاد بودن انسان، مفهوم آزادی در قالب اصول فقهی درآمده است. هدف این مقاله بررسی مبانی فقهی اسلام در زمینه آزاد ی های سیاسی واجتماعی است و با مطالعه آرای فقهی، دیدگاه های مختلف در زمینه آزادی بررسی شده است. از آنجا که آزادی رابطه تنگانگی با حقوق انسانی و حق حاکمیت دارد، لازم است این مفاهیم نیز تبیین گردد. امعان نظر در منابع مختلف، مبین آن است که مبانی نظری آزادی و حقوق انسانی در فقه اسلامی به خوبی بیان شده است و با تکیه براصولی مانند برائت، اباحه و اختیار تبیین گردیده است؛ اما با توجه به گستردگی مفهوم آزادی که در غرب مطرح شده، دوره تاز های از مجادلات فقهی و دینی در زمینه آزادی و حقوق انسانی مطرح شده است؛ مانند اینکه دایره حاکمیت دولت تاچه حدی است؟ و حقوق متقابل شهروندان و حاکمیت چیست؟

    انسان به حکم فطرت و طبیعت خود اجتماعی است؛ یعنی نوع انسان برای نیل به کمال لایق خود که استعداد رسیدن به آن را دارد، گرایش اجتماعی دارد و زمینه روح جمعی را فراهم می کند. با وجود پذیرش ضرورت زندگی در اجتماع و تن دادن به هنجارهای اجتماعی و پیروی از الزامات حقوقی، تمایل درونی انسان به آزادی و رهایی از قید و بندها و برخورداری از مواهب بیشتر زندگی، چیزی است که در اصل با محدودی تها و الزاماتی که دولت ها تحمیل و وضع می کنند سازگاری ندارد. بنابراین ترسیم مرز میان حقوق و آزادی افراد و قدرت دولت و به عبارت دیگر، تبیین حقوق و تکالیف مردم در مقابل دولت از دیر زمان، دغدغه اساسی اندیشمندان عرصه سیاست و حقوق بوده است. مقاله حاضر در این راستا به بررسی تطبیقی حقوق متقابل ملت و دولت از دیدگاه اسلام و لیبرالیسم می پردازد. یافته های مقاله نشان می دهد که در مکتب لیبرالیسم حقوق ملت و دولت برمبنای حقوق طبیعی تبیین گردیده که نتیجه آن تقدم آزادی فردی بر جامعه است، اما در مکتب اسلام مبنای حقوق، انطباق با اراده الهی است که در نتیجه نوعی توازن میان آزادی فردی و حقوق جامعه و دولت برقرار می گردد.

    Political power, in the meaning of effectiveness power in social arena, is one of the basic topics in the Politics. According to the structure of power in the holy Quran, God is the only powerful and based on Hikma, he enables individuals to do things or affect others. The front of belief is equipped with the power of belief; persuasion, soft and military power and mystic helps, and application of power via them by the religious masters is lawful. The infidels are, also, provided with hard power such as military power, economic pressure, threat, creating dispersion, and corruption, and soft power like humiliation, accusation, pretension and gossiping to gain control over the front of belief. In this article, by comparing the hard and soft powers of the fronts of infidelity and belief, the balance of power between the two fronts and the main condition of overcoming of the front of belief on front of infidelity is analyzed with assistance of Quranic verses and the viewpoints of the interpreters.

    It is obvious that Allameh Tabataba’i has been the reviver and renewer of Hikmah, especially in the city, scientific realm and Shia school of Qom, and teacher and promoter of Hikmah. He has been, also, one of the most noblemen of social Islamic Hikmah and possibly, the most prominent figure in basing it and a standard, to the extent that he can be called the pure and theoretical and social and epistemic Hakim (the owner of Hikmah). Hypothesis: viewpoint, theory and supreme pure organization of Hikmah of Allameh Tabataba’i has the capacity of political reproduction, and establishment of the look, theory and structure of the supreme civil and political Hikmah. In other words, viewpoint, theory and structure of the supreme pure Hikmah can be inferenced, produced and established from Allameh’s viewpoint, theory and structure of supreme pure Hikmah. Such a production and reproduction of civil, social and political Hikmah is the noticeable possibility, want and necessity. This procedure is performed with inferential and consequential methodology and with text and content analysis in form of conformity, guarantee and sometimes entailment implication.

    With putting specific affairs in higher education as its base, this paper has aimed at explaining the efficiency of the soft power of higher education in order to achieve the goals of the Islamic revolution. Hereby, two basic questions are raised: what is the place of higher education soft power in Iran? What are the functions of higher education in achieving the goals of Islamic revolution? To explain the situation and answer these two questions, we have implemented the theoretical pattern of “functionalism”. On this basis, in addition to enumerating the specific affairs in higher education and the efficiency of soft power, the most important functions of the higher education soft power in achieving the goals of the Islamic revolution have been mentioned and explained. They include: creating national power, strengthening the legitimacy, enhancing the attractiveness of the Islamic revolution, rise of the rank of Iran in science production, increase of Iran’s national credibility and creation of the sense of independence and self-sufficiency.

    This paper tries to answer this question: if we set the understanding of Imam Khomeini from the Islamic revolution as the norm, what would be the relation between such a norm and the public policy making after the Islamic revolution? In response, by using qualitative content analysis and with interpretative view, we aimed at forming the interpretation of Imam Khomeini and by reviewing some of the public trends to solve the social problems after the Islamic revolution, it is clarified that in explaining the victory of the Islamic revolution, he emphasizes on the element of “Revolutionary Islam” and its influence in creation of a new identity called “Revolutionary Mankind”. From his point of view, these two elements which have cultural nature provided the grounds for “Humanitarian Revolution” and “Islamic Revolution” and have crucial importance in the continuance of the Islamic revolution. According to that, the main trends after the victory of the Islamic revolution are not proposed in the “nation-states” paradigm but in shape of “Ommah-Imamat” framework.

    The position and structure of the government is dependent on and influenced by understanding of it by the governors and based on their understanding of the “government”, they constitute and organize its structures and relations. There exist two understandings of the “governance”: the possessive feudal governance and the Velayatieh (leadership) governance. The first one is similar to the relation between the slave and his master and the second one; the truster and the trusted. Each one of these two produces structures and behaviors consistent with their nature and become at the service of special groups of people. This paper attempts to analyze the cognitive metaphor of the “governance as Vaghf (dedication) theory” and hereby, after explanation of concepts like dedication, trust, governance and the similarities of the two notions of “dedication” and “governance”, identifies the concept of dedication and its goals and it was tried to analytically investigate the “trusts” understanding of government and introduce the resultant achievements from this metaphorical analysis.

    According to the fiqh of Shia, the place of governance is discussed in two periods: first, at the time of the presence of Ma’soum (sinless imam) in which the right of governing is fixed for him, and then, in the period of the absence of Ma’soum during which there is disagreement on the governance of him among Shia leaders. During the time of absence, there are “positions” for the Shia leaders which are: the position of Ifta (issuing “Fatva” (Islamic verdict)) and Islamic reference, the position of Ghaza (judgment) and the position of Velayat (leadership). There is no disagreement on the consistency of the two criteria of Ifta and Ghaza of Shia leaders but there is disagreement about the criterion of Velayat. Supposing that their Velayat is proved, there is disagreement on their scope of Velayat and their penetration range. In this paper, with referring to Fiqhoriented texts of the Shia and expressing the first and last Shia leaders, we explain the position of Shia leaders (Faqihs) at the time of the absence of Ma’soum and then investigate the scope of Velayat and penetration range of Faqihs on basis of the lessons from Shia fiqh. In the final part, we analyze the penetration scope of them in three steps: 1. definite cases within the penetration scope of them, 2. definite cases out of their penetration scope, and 3. Cases over which there is disagreement among them.

    Freedom is one of the notions that has been defined differently by various schools according to their special viewpoint. In the Islamic fiqh (jurisprudence), based on the emphasis of Quran on freedom of mankind, the concept of freedom has been shaped in form of fiqh principles. The aim of this article is analysis of the Islamic fiqh bases about political and social freedoms and with studying fiqh viewpoints, different opinions about freedom have been analyzed. Due to the fact that freedom is strictly related to human rights and the sovereignty right, these concepts should, also, be explained. Referring to the opinions raised in different resources has made it clear that the theoretical bases of freedom and humane rights in the Islamic fiqh have been explained with reference to principles such as exemption, legitimizing irregular affairs (Ebahe) and the will, but with regard to the diversity of definitions of “freedom” expressed in the west, a new age of jurisprudent and religious discussions about freedom and human rights has been started; like: how much is the scope of the sovereignty of the government? and what are the mutual rights of the citizens and the government?

    Human is, by nature, social; which means that in order to achieve its deserved advancement which he has the skills to reach to, the mankind has social tendency and provides the grounds for collective essence. In spite of accepting the necessity of living in the society and surrendering to social norms and following legal musts, the internal tendency of human to freedom and being free from the obstacles and limitations and enjoying more advantages from life is fundamentally against the limitations and barriers imposed and issued by the governments. Therefore, drawing the distinction line between the rights and freedom of individuals and the power of the government, in other words, clarification of the rights and duties of people against the government, has been one of the main concerns of the thinkers in Law and Politics from the old time. Following that way, this paper comparatively analyzes the mutual rights of people and the government from the viewpoints of Islam and Liberalism. The findings of the paper show that in Liberalism, the rights of people and government have been explained based on the natural rights whose meaning is the priority of human freedom to society, but in the Islamic school, the basis of rights is its adaptability with the divine will which, consequently, sets a balance between individual freedoms and rights of people and the government.
