    حرم های مطهر معصومین (ع)، از صدر اسلام تاکنون، مورد استقبال مسلمانان بوده است. در فقه امامیه، اقامه نماز در اطراف ضریح های مطهر حضرات معصومین(ع) دارای احکام خاصی است و در برخی از حالات، حکم آن، هم از جهت وضعی (صحت یا بطلان) و هم از جهت تکلیفی (حرمت یا جواز) مورد اختلاف فقها قرار گرفته است. علت این اختلاف فتوا، اختلاف برداشت فقها از روایات است، که با دقت در مضمون مهمترین این روایات (صحیح حمیری)، مشخص می شود که اقامه نماز، پشت به قبور معصومین (ع)، فی الجمله حرام است، ولی باطل نیست و نماز در طرفین قبور ایشان، نه از جهت تکلیفی و نه از جهت وضعی، اشکالی ندارد و حرمت و بطلان نماز رو به قبور معصومین (ع) نیز قابل اثبات نیست؛ هر چند بهتر است با توجه به روایات، نمازگزار رو به قبر نایستد، بلکه در سمت راست یا چپ آن قرار گیرد تا توهم غلو و پرستش قبر پیش نیاید. به هر حال اقامه نماز در بالای سر، افضل است.

    همزمان با حکومت صفویه(حک:907_1148ق.)در ایران، در حرمین شریفین، اشراف (سادات حسنی و حسینی) از سده های پیش امارت داشتند. روابط صفویه با این دو کانون معنوی و امارت اشراف حاکم بر آنها، هم به دلایل مذهبی و هم استقلال نسبی اشراف و نیز به دلیل مساله حج، اجتناب ناپذیر بود. به رغم وجود زمینه ها برای توسعه مناسبات از جمله همسویی مذهبی برخی از خاندان اشراف با صفویه و نیز تلاش صفویان برای توسعه مناسبات، روابط میان آنان چندان گسترده نبود که می توان آن را متاثر از تحولات سیاسی نظامی، تنش و رقابت میان عثمانی و صفویان و سیادت عثمانی بر حرمین دانست. در این جستار مناسبات صفویه با اشراف حاکم بر حجاز و عوامل تاثیر گذار در این عرصه مورد بررسی قرار می گیرد. فرضیه تحقیق حاضر این است که وابستگی اقتصادی اشراف حجاز به دولت عثمانی و قدرتمندی این دولت در مقایسه با صفویه که می توانست به حفظ موجودیت سیاسی و تداوم امارت اشراف بینجامد، سیاست آنان را همسو با عثمانی ساخته بود. هدف این تحقیق که به صورت کتابخانه ای انجام شده، شناسایی عوامل موثر بر روابط سیاسی صفویان با اشراف حاکم بر حجاز و سیر مناسبات آنان با یکدیگر است. ازدیدگاه این مقاله مهمترین عامل خارجی موثر بر روابط آنان، عثمانی بود که ادعای خلافت نیز داشت و مهمترین عامل داخلی برای اشراف، تامین نیازمندی های مادی و بهره مندی از حمایت های دولتهای قدرتمند بود.

    شبهه در لغت در معانی مختلفی مانند شباهت و همانندی، و پیچیدگی و ابهام به کار رفته است؛ اما کاربرد اصطلاحی آن در فقه و کلام، متفاوت است. شبهه در علم فقه به معنای شک به کار می ‏رود؛ در حالی که در علم کلام، استدلالی اعتقادی است که با اختلاط یا ایجاد مشابهت میان حق و باطل یا صحیح و غلط، تشخیص حق را دشوار می‏ کند و خواسته یا ناخواسته، باورهای اعتقادی یک مذهب را به چالش می‏ کشد. همچنین شبهه ویژگی‏ هایی دارد؛ از قبیل استفاده از نظام استدلالی به ظاهر بسیط و ساده، پایان نیافتن با پاسخ منطقی، بهره برداری از شذوذات و نوادر، استناد به رفتار عوام، تاثیرگذاری بیشتر بر توده ها، رشد در محیط های غیر پاسخ گو و قدرت گسترش و رشد سریع. این ویژگی ها سبب شده است که شبهه، از نگاه متکلمین، بسیار خطرناک باشد، تا آنجا که برخی پاسخ‏ گویی به شبهه را یکی از اهداف علم کلام دانسته ‏اند.

    هرچند فضیلت پیاده روی برای زیارت قبر امام علی (ع) و امام حسین (ع) در برخی نصوص روایی منعکس گردیده و فقهای مذهب جعفری با تکیه بر آن به استحباب پیاده روی برای زیارت آن دو امام همام (ع) حکم کرده اند، ولی استحباب آن برای زیارت سایر قبور معصومان (ع) و امامزادگان (ع) و اماکن مقدس از منظر فقه چندان هویدا نیست؛ زیرا تحقیقی موسع و یکپارچه در این باره صورت نگرفته است. از این رو پرسش از حکم تکلیفی پیاده روی برای زیارت قبور مطهر اولیای الهی (ع) و اماکن مقدس، نیازمند پاسخی درخور است. توجه به برخی وجوه و مبانی در شناسایی فضیلت پیاده روی برای زیارت، نشان از بدعت نبودن آن و استحباب و فضیلت پیاده روی برای زیارت تمام قبور مطهر و اماکن مقدس است. این تحقیق با هدف شناخت حدود و ثغور ادله و تبیین حکم پیاده روی برای زیارت قبور اولیای الهی (ع) و اماکن مقدس انجام شده و نیل به این مقصد در سایه تحلیل گزاره های فقه اسلامی با گرد آوری داده های کتابخانه ای میسر است که نتیجه آن، حکم به فضیلت و استحباب پیاده روی برای زیارت قبور حضرات معصومین (ع) و فرزندان ایشان (ع) و اماکن مقدس است.

    ابن تیمیه و به تبع او وهابیان، ادعا کرده اند که به اجماع عالمان مسلمان، از واژه «بیوت» در آیه شریفه «رفع بیوت»، فقط مساجد اراده شده است و هم ردیف دانستن فضیلت عبادت در بیوت و مراقد مطهر پیامبر اکرم(ص) و اهل بیت(ع) با مساجد، بدعت و شرک است. در حالی که اولا، ادعای اجماع، خلاف واقع است، ثانیا، بنابر تحقیق، مراد اصلی از بیوت در آیه یاد شده، بیوت و مراقد مطهر پیامبران (ع)، به ویژه بیوت و مراقد مطهر پیامبر اکرم (ص) و اهل بیت(ع) است و شمول آیه بر مساجد و بیوت مومنان که واجد ویژگی های یاد شده در آیه می باشند، از طریق تنقیح مناط است؛ زیرا در کتب لغت معنای بیت غیر از معنای مسجد است و در آیات قرآن نیز این تفاوت معنایی مشهود می باشد. وجود احادیث مستفیض که صریحا آیه شریفه را به بیوت یاد شده تفسیر کرده اند، دلیل مهم دیگر است. آیه 73 سوره هود و 33 سوره احزاب نیز قرینه است.

    تبیین موضوع شناسی ادنی الحل و امکان سنجی حکم تکلیفی احرام از آن، مسئله ای است که کمتر بدان پرداخته شده است. احرام، نخستین منسک در حج و عمره بوده که دارای ابعاد مختلفی است که تعیین فقهی مکان های احرام، از مهم ترین آن است. در مجامع روایی اهل بیت (ع) و اهل سنت به روشنی بر احرام، در مکان های پنج گانه ویژه، تصریح شده است. افزون بر این موارد، به استناد صحیح عمر بن یزید، صحیح جمیل بن دراج و دیگر روایات، از ادنی الحل نیز در چند صورت می توان برای حج و عمره احرام بست. این مرز فرضی مکه مکرمه، که از دیرباز در 45 کوه محیط بر مکه علامت گذاری شده، یکی از مواقیت است که در برخی موارد خاص یا اضطراری، می توان از آنجا احرام بست. مشهور فقی هان امامیه، حداقل در چهار مورد، حکم به صحت جواز احرام از ادنی الحل نموده اند: عمره گزاران ساکنان مکه، عمره گزاران زائر و مجاور مکه، کسانی که از میقات های اصلی یا هم راستای آنها عبور نکرده اند و کسانی که به سبب وجود مانع، فراموشی یا جهل، از میقات ها گذشته و امکان بازگشت ندارند.

    The holy graves of the Ma’soumeen from the beginning of islam till now has been a place where many Muslims especially Shias come to visit. In the beliefs of the Imamia denomination, the iqama of prayer around the shrine of the Masoumeen has a specific ruling and in some situations, its ruling, also from the vaz’ee ruling point of view and also from the obligatory ruling point of view is a conflicting subject between the jurisprudents. The reason for conflict of verdict is the conflict of jurisprudents understanding from the traditions; which exactly the most important topic of the traditions (Sahih Himyari) makes it clear that the iqama of prayer, back towards the graves is haraam (forbidden) but isn’t void. And prayer by the two sides of their graves neither from the vaz’ee nor from the obligatory point of view doesn’t matter. And the haraam or void point of prayer towards the graves also isn’t proved; but also referring back to the traditions, the one praying shouldn’t stand towards the grave but stand right or left of the grave so he/she doesn’t situate themselves in doing something useless and not to seem like they are worshiping the grave. But at the end the iqama of prayer above the grave is better.

    Concurrent with the Safavid Empire in Iran (907-1148 A.H), the nobles (Hasani and Husayni Sayyids) ruled Hijaz since centuries. The relationship of the Safavids with Hijaz was inevitable due to its being a location of religious and spiritual significance and the place of Haj and due to the relative independence of the nobles. Inspite of the presence of opportunities to expand these relations, like common religious perspectives of the Safavids with a section of the nobles’ family, and inspite of the Safavids’ efforts in widening their relations, their relations were not very broad which can be influenced by the political and military developments, tension and rivalry between the Ottoman and Safavid, and Ottoman sovereignty over shrines. The disputed connections between the Safavids and the nobles ruling Hijaz and the factors influencing them during this era are researched upon. It is proposed that the financial dependence of the nobles of Hijaz on the ‘Uthmani regime and the strength of this nation in comparison to that of the Safavids that could protect their political position and continue the rule of the nobles, made their politics aligned with the Ottomans. The aim of this research is to study the political relations of the Safavids with the nobles ruling Hijaz and the timeline of their connections. In the view of this paper, the most important external influence was the ‘Uthamni regime who also claimed caliphate and the most important internal influence for the nobles was their fulfilling of material needs receiving of assistance from powerful states.

    The word shubha is used to denote different meanings, such as similarity and identity, complexity and ambiguity: But the use of the term is different in Fiqh (jurisprudence) and science of scholastic theology. Shubha in jurisprudence is used only in the sense of doubt. While in theology, “shubha is a theological argument that makes it difficult to distinguish right and intentionally or unintentionally, challenges the religious beliefs of a religion by mixing or creating similarities between right and wrong or good and bad. Also, shubha has features, such as the use of a seemingly simple and straightforward argument system, persistence despite reaching logical response, exploitation of abnormalities and rare things, referring to the behavior of the public, being more effective on the masses, growth in non-responding environments, and power of rapid expansion and growth. These characteristics have made shubha, in the opinion of theologians, to be very dangerous; so much so that some have considered answering to shubha as one of the goals of science of scholastic theology.

    In spite of the existence of proof for the excellence of walking for the visitation of the graves of Imam ‘Ali (a) and Imam Husayn (a) in authentic books of traditions, and on its basis, shi’a jurists issuing a ruling of recommendation of this act with regard to the two Imams (a), it is not clear whether walking to the graves of other infallibles (a) and the children of Imams (a) and other holy places is also recommended. This is due to the lack of an expansive and integrated research on the subject. Therefore, the question of a jurisprudential ruling on walking towards the graves of other infallibles (a) and other places for their visitation is an issue that requires being explored until a suitable answer is retrieved. Taking into consideration sources which indicate the excellence of walking to their graves are its not being an innovation, and sources indicating the recommendation and excellence of walking to visit all the holy graves and places. The present research aims to recognise the boundaries of this argument and to elucidate the ruling on walking to the visitation of the graves of all the beloveds of God (a) as well as other holy places. The present research has been conducted by describing and analysing Islamic jurisprudence and the resources present in libraries whose result was reaching the ruling of the excellence and recommendation of walking towards the graves of the infallibles (a), their children (a) and other holy places.

    Ibn Taymiyyah, and following him, the wahabbis have claimed that in consensus with the Muslim scholars, the word "houses" in the verse "honouring the houses" implies only mosques and that placing the virtue of worship at the houses and tombs of the Prophet (a) and the Ahl al-bayt (a) at par with that of the mosques is an innovation and amounts to polytheism. However, firstly, the claim of consensus in not true, and secondly, on the basis of research, the primarily intended meaning for the word "houses" are the houses and tombs of the Prophets (a), especially those of the Prophet Muhammad (s) and the Ahl al-bayt (a), and including mosques and houses of the believers with the noted charateristics in the verse is per one of the principles of jurisprudence called tanqihe manat. This is because in dictionaries, the meaning of houses is different from that of mosques and this difference in meaning is reflected in many verses of the Quran. The existence of traditons that clearly describe the verse to mean "houses" is another strong proof. Verse 73 from chapter Hud and verse 33 from chapter Ahzab are clear indications of the same.

    Adnal Hill and feasibility of Ihram from its obligation sentence explaining the subject matter of jurisprudence that hasn’t been talked much about. Ihram is the first ritual in Hajj and ‘Umrah that contains different dimensions that explain jurisprudential locations of ihram from the most important of them. From the traditions of the Ahlul Bayt: and Ahlul Sunnah clearly specifies about ihram in the five specific locations. More so in this topic we look over to cite of Sahih ‘Umar bin Yazid and Sahih Jamil bin Darraj and other tradtions, from Adnal Hill also in a couple cases prove wearing ihram for both hajj and ‘Umrah. This city border of Mecca from the beginning with a couple signs in 45 mountains surrounding Mecca has been marked; is one of the places where in some specific situations or urgent moments we can do ihram there. Popular amongst the jurisprudents of Imamia form between “Mabahisu Fiqhil Hajj”, at least in 4 cases, the ruling is allowed for doing ihram; taken from Adnal Hill: the pilgrims of ‘Umrah in Mecca, and the pilgrims of Mecca and near Mecca, people who from the main Miqat or from similar alignment haven’t yet crossed and people who because of a barrier, forgetfulness or not knowing passed Miqat and don’t have a way to return.
