Abstract:
Twenty five years has elapsed since Imam Musa Sadr, the leader of the Shiite community in Lebanon, has disappeared after a short trip he made to Libya. Throughout this period, Imam Sadrs fate has remained unknown and no major step has been taken to pursue this matter properly.In this article, possible judicial ways to follow up Imam Sadr's case which constitutes enforced disappearance, and as such has been classified as a crime against humanity in the General Assembly "Declaration on the Protection of All Persons from Enforced Disappearance", have been analysed. These include: Referring the case to the U.N. Human Rights Commission, the International Court of Justice, The International Criminal Court, or the national courts of certain countries in which some international crimes may, on the basis of their laws, be prosecuted irrespective of the nationality of the offender or the place where the crime was committed. The existing problems for choosing each of these ways have been discussed in this article.
