Jurisprudential and Legal Studies of Adequate Payment During Marital Life and Its Applicability

Paying adequate payment / wage fair during marital life is a legal establishment related to divorce law which has been amended for the first time to accord women's right at the time of divorce. Under special conditions the husband is obliged to pay his wife. The present study is an attempt to bring to focus the theological principle and legal status of wage fare during marital life and its legal status. It also elaborates the amount of wage fare, how to pay, when to pay, and when to demand. Moreover the applicability of paragraph B of section 6 of single article regarding the modification of divorce law in attaining the above mentioned financial rights is also analyzed. In the end the legal procedure of courts in dealing with the legal establishment is also reviewed. The present article indicates that due to the following problems still great legal challenges and ambiguities remain. 1. Women's voluntary management of house affairs. 2. The conflict of article 366 of civil code with clause 6 of single article approved by expediency council in 1372 regarding modification of divorce law. 3. Diversity of rules and lack of precedent as well as lack of mechanism for determining the amount of reasonable wage. 4. Incompatibility of waging fare set by the court with value of wife's house chores. 5. Long legal procedures and many other cases. These problems has led to the hardships for women in attaining their financial rights.
