The Study of the Scope of Multiple Employment Prohibition Rule

Abstract:
The prohibition of governmental or public multiple employment rule has been emphasized in the principle 141 of Islamic Republic of Iran's Constitution and other Acts. Guardian Council's interpretations of that Principle has been always in favor of its empowerment, strengthening, and expansion of that Principle's dominance. However, during the years some members of the Guardian Council have taken other positions. This situation led the 7th parliament members to attempt to unravel the doubts on the Principle 141. Nevertheless, the Guardian Council rejecting its own judgment and interpretation of the rule, and calling the parliament approved as doubtful, interrupted the Parliament efforts and referred the above-mentioned to the State Exigency Council.The longstanding trend and treatment approach of the Guardian Council with questioning and Parliament's approval elucidate that the Council knows itself an exception from the implementation of rule, and that the Constitution and other relative Acts can not tolerate such exceptions. In fact, the multiple employment of Guardian Council members is contrary to the Constitution and ordinary Acts.
