Pattern of Separation of Powers in the Islamic Republic of Iran's Constitutional Law

Abstract:
in western scholars opinion, centralization of power in authority of a person or a group will bring corruption; therefore there have been attempts to eradicate this centralization of power, and established the principle of the separation powers. But this basis – that corruption of centralization of power in a person - is not accepted in Islam. in Islamic ideology the authority of power in an infallible of presence of Imam Mahdi) and also the authority of power of equitable Faqih (at the absence of Imam Mahdi) will not result in corruption. Therefore, separation of powers is not a mean to distribute power, but it is a mean to facilitatation and specialization of affairs. The Legal - Political system of Iran also based on this basis, accounts the three branches of government under supervision of Velayat-e- Faqih which are doing some sovereignty activity under surveillance of Supreme Leader. These three branches of government have effects on each other which are pointed in various principles of the constitution which also shows relative separation of powers in Iran's Constitutional Law. Accordingly, the Iranian legal system offers a new pattern in this field, while accepting the nature of this principle, it offers a new basis.
