Compliance with the principle of good faith and liability of physician in Shiite jurisprudence
The principle of good faith is made and developed in civil law (Roman Germanic) and then entered in legal literature in our country. Good faith in in civil law system has two independent concepts: The first concept of Good faith is False and supportable belief. The second concept is honesty in fact in the conclusion, execution and interpretation of the contract. As a result of these two concepts, there are two aspects of good faith, protection and required aspects of principle of good faith. Verify compliance with the principle of good faith and Shiite jurisprudence and make a principle of good faith in Shiite jurisprudence requires a response to several questions. (This study only answers to one question). The question is whether we have an instance which is in conflict with the principle of good faith in the Shiite jurisprudence? Some lawyers believe that liability of physician is the examples in Shiite jurisprudence which is not comply with the principle of good faith. In this paper, the principle of good faith and liability of physician explained and proved that liability of physician in Shiite jurisprudence is not contrary to the principle of good faith.
