Abstract:
Humanitarian rules are a landmark achievement of International Law in the nineteenth and twentieth century. Some rules are fundamental rules such as protection of civilians and persons Hors de combat (Wounded and sick، Persons deprived of their liberty)، Protection of the dead against despoliation، prohibition of Starvation as a Method of Warfare and prohibition of reprisal. Some of these rules and principles have been recognized by Imam Ali at 1400 years ago. It is interesting that these rules recently adopted by states. It is necessary to say also that the application of some rules in non-international wars until 1949 including protection of civilians and Wounded and sick، prisoners of war are not certain. Imam Ali respected Fundamental Rules of International Humanitarian Law in «sefain» and «khavarej ‘ that are described as non-international wars in contemporary international law.
