Religious Fundamentals of Prohibition of Intentional Assault and Battery of Accused

Whereas the police organization in any country has important duties for applying public order and security and accordingly extensive powers are assigned to the staffs of this organization for performance of assigned duties، therefore one of crimes that commitment thereof by police force is supposed is intentional assault and battery to the accused with the justification of crime detection. Despite of generality of this crime occurrence in all police organizations and non-exclusion of police force in this matter، considering the governance of Islamic regime and raising IR Iran’s Police Force as the mean of applying Islamic regime governance as well as religious and legal prohibition of such actions، it is necessary to identify the improper factors and adopt preventive policies and strategies and avoid occurrence of this criminal and unlawful action in the police force organization. The present study aims to describe the religious fundamentals of prohibition of assault and battery of accused. This study is an applied research based on objective and required data was collected from academic references using documentary method، and analyzed based on analytical descriptive procedure. Summary of results of this study indicates that religious fundamentals of general sentence on intentional assault and battery of accused and convicted people by police force officers are fixed based on jurisprudential judges and decrees، verses of Holy Koran as well as various narrations. However، in special cases such as enjoining good and forbidding evil، legitimate defense، enforcement of sentence of law or order of legal orderer and in compliance with the reasons for legalization or justified factors of crime، permission for intentional assault and battery of accused and convicted people has been issued.
