The Review of the Rule " al-Hawa Tabeun lil Ardh" 1 in Proving the Allowed Development Possibility of the Rites of Hajj

Abstract:
Although the development of places for rites of hajj, for reasons of daily increase of the pilgrims is a obligatory command and inevitable that the Saudi Arabian government look serious towards; however we should pay attention that hajj as an obligatory act with certain boundaries and is recorded and with out legal permission and legit legal excuses, cannot develop in a way that leads to doing the rituals in some other places. Research shows that in the reasoning of the jurisprudents of the Sunni school of thought in explaining the reasons for extensions apparently doesnt exist justified expectable reasons, reasons from Sahihus Sanad and Dilalah (content) for this matter. Because they have a ground basis ruling also known as “al-Hawa Tabeun lil Ardh wa al-Qarar” that according to a research has expanded. This rule wasn’t more than just a saying .and this doesn’t have a strong base in the legal .
