The Analysis of the Order of the Mina Rituals in Imamia Jurisprudence

Abstract:
The order between the three actions of “Rami Jamarah 'Aqaba”, "sacrifice", and "shortening or shaving of the hair in the land of Mina", is a matter of differ ence amongst Imamia jurisprudents, which with attention to the consequences of the requirements in this age, for instance the causing of crowdedness, etc., analyzing the reasoning of each opinion and deciphering the correct opinion, seems to be obligatory. Although in the case of obligatory ruling between rami and sacrifice, amongst the jurisprudents two opinions of obligatory order and opposite of that is mentioned. But ancient scholars compared to the contem porary ones know the order not to be vazee obligatory, that this difference is a difference of primitive significance but with attention to the reasoning that obligates order for obligatory ruling and the reasoning for the nonexistent obligation takes precedence over the vazee ruling so now this difference is over ridden. Just like the majority of the jurisprudents, the vazee ruling is known as the opposite in the stipulation of order between the sacrifice and shaving and in the case of the obligatory ruling of it, three opinions of obligation, no obligation
and the detail between the preparation of the sacrifice and not doing it. With attention to the reasoning of the first opinion, with respect to the obligatory ruling, the reasoning of the second opinion with respect to the vazee ruling and the reasoning for the third opinion, overrides the reasoning of the first opinion resulting in preparation of the sacrifice would be in the ruling of doing sacrifice. Therefore the first ruling is the order between each three of the actions, obli gation and the lack of stipulation. Moreover in the case of the resulting of the second case for instance sinning, etc., the secondary ruling of obligation also is the non-following of order that by leaning towards that to a certain point can .resolve the issue of over crowdedness .
