An Islamic Jurisprudential and Legal Survey of Disputes of Married Couple in House Furniture

Abstract:
One of the most important discussion in financial relations between the husband and woman is the ownership of them on house furniture. In the course of common life the married couple possess the property situated in their house and this common possession which results from their residence in single house. The determination of owner and fixing the ownership of property in this situation is faced with problem. On one side, regarding the movable things and the house furniture, having the document of purchase and keeping them is unreasonable taking into consideration the moral compromise. The problem is raised when the married couple are in the state of dispute. Different views have been expressed regarding the issue of married couple dispute on house furniture by the Islamic jurists and legal scholars. It is seemed the roots of these differences in the views are to be searched in entered news and different understanding of possession rule and local usage. This research is seeking to review the different views and their reasons and to examine the statute in order to find a proper solution proportional to the issue
