Review supervision on child, gaps and challenges in jurisprudence and law

One of the topics in family law cause gaps and challenges for the family and strength of family is supervision of the child. Civil law knows supervision of the child just belong to the father and parental grandfather and itdeprives mother of her supervision of the child.
Basic question is current rules about supervision ofchild is lifter family needs or not? In this article, reviewing the current condition of families,considering interests of the child and also mother guardianship’ right on child is 7 years old, in these cases, ifmother be a guardianship and father be a supervision, it subject will be created double trouble and then it will not be expedient of child. Also in the case of father death, if guardianship be with mother, supervision of parental grandfather can create double trouble.
Considering cultural development of society and this fact that women have an active role in current Iranian society, and considering not attendingof women in the social growth, with all problems, in this article,the researcher offers that lawgives mother, like father, supervision; This right, like guardianship, allocate only to mother and father, Because this right allocating will be caused the family strength and expedientof the child.
