The Juridical Analysis of the Prayer Place Near Graves of the Masoumeen (A.S.)

Abstract:
The holy graves of the Ma’soumeen from the beginning of islam till now has been a place where many Muslims especially Shias come to visit. In the beliefs of the Imamia denomination, the iqama of prayer around the shrine of the Masoumeen has a specific ruling and in some situations, its ruling, also from the vaz’ee ruling point of view and also from the obligatory ruling point of view is a conflicting subject between the jurisprudents. The reason for conflict of verdict is the conflict of jurisprudents understanding from the traditions; which exactly the most important topic of the traditions (Sahih Himyari) makes it clear that the iqama of prayer, back towards the graves is haraam (forbidden) but isn’t void. And prayer by the two sides of their graves neither from the vaz’ee nor from the obligatory point of view doesn’t matter. And the haraam or void point of prayer towards the graves also isn’t proved; but also referring back to the traditions, the one praying shouldn’t stand towards the grave but stand right or left of the grave so he/she doesn’t situate themselves in doing something useless and not to seem like they are worshiping the grave. But at the end the iqama of prayer above the grave is better.
