Minor's Transactions in View of Islamic Jurisprudence

aws relating to minors’ transactions emanate from contract laws. On the other hand, the issue has recently been taken up in discussions on laws in light of the common law. In consideration of this, it is necessary to examine the issue of the minor’s transactions, their validity in view of the common law along with other factors relevant to it; amendments are needed on some civil law articles regarding partly physical maturity and growth and partly the age of the former – notwithstanding the role of the two in the minor’s financial authority. This is because there exists discordance in the viewpoints based on Islamic jurisprudence and the common law - not to mention the ensuing consequences of their own. Considering, in addition, the phenomenon of street children’s transactions, the importance of applying the jurisprudential laws seems more tangible making it incumbent upon us to submit practical results. The paper aims at presenting an extensive study of the issue by examining the various jurisprudential theories and viewpoints as well as the origin of the related laws. Having carried out such a study, it is obvious that considering physical growth as a factor in the minor’s transactions, irrespective of its being simultaneous with physical maturity or not, requires further study.
