The Proportion of the Principle of Justice to the Other Principles

Abstract:
With respect to this fact that Justice is unconditional, Divine acts are Justice-Based in all aspects of Creation, Legislation, and Retribution. Thus, all Islāmic rulings are characterized by tacit attribute of Justice. Some scholars hold that it is valid if a jurist issues his Fatwā due to Just and Un-Just attribute of each case. This is construed as "Principle of Justice" or "No Unjust Principle". There is no trace of this rule in the previous works; it is something dominated as a principle in the contemporary works. Here we study four principles of No Harm, Justice and Equity, Drawing Lots, and Fraud. It is concluded that these principles are all, referents and instances of the Principle of Justice. Regarding the principle of No Harm, the instance of illegitimate Harm overlaps the instance of Unjust. And instances of illegitimate Harm are recognized if the term Unjust is applicable there. Justice and Equity Principle is the Principle of Justice itself, concerning subjective doubts on Right and Property. The Principle of "Casting lots" is one instance of the Principle of Justice which applies in order to preserve Justice when the reality regarding the individual's rights is obscured. The evidences in substantiation of the Principle of Fraud are the same evidences for the principle of Justice.
