Scrutinizing the Necessity of Enunciating the Concept of «Derivative Responsibility» In Light of ILC Works

Regulating the framework of the law of international responsibility, the International Law Commission (hereinafter ILC) has enunciated two bases to bearing responsibility in its outcomes: Independent Responsibility (concerning the responsibility of wrongdoer state or international organization) and derivative responsibility (concerning the responsibility of states or international organizations in connection with act of another state or international organization). Enunciating these two, which has not been explained enough in Farsi, the said conception is not clear, enough, on some issues; Throwing light on these points, the present paper has explained the related conception, studies its emerging via ILC documents and then scrutinizes the causes in question. Finally It has found and observed that derivative responsibility supplements independent one and there has been four factors, i.e. cooperation, moralization, accountability and identifying international organizations as active subjects in international community, play the most vital roles in its emerging and of course, increasing situations in the scope of international derivative responsibility. Incrementing these, necessitates the existence of the conception in question which is the manifestation of justice.
