The Legitimacy of States Evaluation in implementation of Sanction United Nations Resolutions with Emphasis on European Union Performance

In United Nations history, in many cases, the Legality of Security Council Resolutions, has been challenged. These challenges dominantly has been accomplished by states that affected by Security Councils decisions. With notice that states are representative for implementation of Security Council Resolutions, they have intervened their theory and determination in methods of Security Council Decisions implementation. Although this cases couldn’t provide direct review on Resolutions but imported in the way of implementation. Evaluations by states are probable and propose some concerns about decrease Security Council effectiveness in international peace and security maintenance. The increase of sanctions Security Council resolutions and the question of violation some fundamental human rights by resolutions, some individuals and legal person claimed an action in competent courts of European Union. The Courts in their opinions have examined the legality of measures following the resolutions that has resulted to evaluation of Resolutions. Although these results hadn’t resulted invalidity of a Resolution but can lead to the fragmentation of the international law.
