From the Cultural Norm to Regulation, Political Trend's Dispute on the Norm Bases and the Position of Law during Constitutionalism

The first constitution was officially signed by the king of Qajar; however, the cultural and political tensions lingered due to the disagreement on the norm within the cultural and political trends among people and particularly elites. The law is not exclusively in favor of officially approved writings in assembly and legal books but it is of biological aspects which manifests itself in the norms and values of community and it is going to be legislated in regard with them. This research is to demonstrate the profound gap between the unexecuted law and the one with the meaning of norms which improved the intellectual life in time of constitutionalism or didn’t. It has been selected fourteen works referring to the time of constitutionalism as well as various political trends that have been investigated on the basis of the conceptual framework composed of theories on the sociology of law and political sociology through the content analysis. The findings illustrate the domination of a kind of anomic and irregular status on the value and norm bases of establishment or no establishment of constitution at that time and in these conditions, the failure of community in regard with the establishment of law will be predictable
