Smuggling Goods and Currencies from the Perspective of Rational Sources in Principles of Islamic Jurisprudence

Abstract:
Smuggling goods is a modern phenomenon in trading which means “to neglect custom rules in import and export of goods and currencies”. Although these acts may have certain benefits for some individuals, however, they are harmful to economy, culture, politics and security of the country. Legislation of civil laws is effective in countering such problems. Nevertheless, knowing about religious roots of forbidding these acts has a significant role in deterrence. Principles of Islamic Jurisprudence and its main regulations can help in this regard and we can reach the religious verdict through applying regulations such as Qiyas, al-Masalih al-Mursalah, Istihsan and Sadd al-Dhari‘ah. This article applies an analytical descriptive methodology in order to find out the religious verdict related to smuggling goods and currencies by applying above-mentioned regulations. This article concludes that the common ground within these regulations as references of such verdict is the concept of Maslahah (public interest). Therefore, Maslahah (public interest) in the case of fighting against smuggling goods and currencies results in gaining national interests and avoiding harms or deceiving.
