Identification of the Nuclear Liability Model in the Canadian Legal System

Canada, as one of the leading countries in the field of nuclear technology, has set a nuclear liability regime about half a century ago. In this regard, and although Canada did not accept any of the 1960 Paris Convention and the 1963 Vienna Convention on Nuclear liability, for the first time and in 1970, nuclear liability act was enacted. The process entered a new phase in 2015, with the adoption of another regulation on nuclear responsibility that led to the abolition of the previous law; Due to the Canadian authorities, in addition to upgrading the shortcomings and deficiencies of the previous law, have aligned it with the provisions on nuclear liability under the provisions of the 1997 Supplementary Compensation for Nuclear Damages Convention, which it has recently approved. However, although the Canadian nuclear liability model has been influenced by the teachings of the Convention, the measurement strategies, including coordinate the risk degree of nuclear facilities with amount of liability, the expansion of the scope of damages, and the rest, has led to a higher degree of nuclear liability in Canada compared to international nuclear liability regime. Hence, recognizing the various dimensions of the nuclear liability system in Canada is important.
