Discrimination in Qiṣāṣ in Iranian Statuary Jurisprudence and Law

Abstract:
In Islamic jurisprudence, some preconditions have been taken into consideration for restoring the rights of the victim and the accused in crimes related to homicide and organ defect. The question is whether there is the possibility of discrimination in qiṣāṣ (retaliated punishment) for body organs; that is to say, can the victim or the claimant execute part of qiṣāṣ and forgive or compromise another part in regard to the criminal? There are three legal views concerning this issue: 1. Discrimination in qiṣāṣ is quite accepted; 2. Discrimination in qiṣāṣ is accepted only for men; 3. According to the view on detail in cutting off four fingers of a woman by a man, the
woman can cut of two fingers of the man as qiṣāṣ and does not pass on something as blood money (dīya) to the man. But she cannot cut off three fingers of the man and forgive one finger. In this research, the first and the second viewpoints are critiqued and the view on detail is accepted
