Climate Change, Human Rights and the need to Establish the International Court of the Environmet

Abstract:
Climate changes in the last decades were the main concerns among the international community and some measures done in this regard. Ratification of UNFCCC in May 9, 1992, Kyoto Protocol in 1997 and 2014 Paris agreement were the most important of such measures. The main purpose of this paper is to investigate the disasters as a result of climate change and the need to establish an international environmental court. The question is raised; Given the fact that many conventions and environmental treaties do not have binding authority, the extent to which the IEC can be useful and effective in the event of a dispute between the parties to the Convention and to prevent further environmental degradation. The presumption of the paper is that the establishment of this special court, such as the ICJ, can help to settle disputes in the field of the environment in a peaceful manner. This study was conducted in a library-based way, as well as through the examination of international environmental law documents, including UNEP documents. Finally, it has come to the conclusion that the establishment of the International Court for the Environment can play an effective role in protecting the environment in the future.
