The Comparative the Giving gift to judges in jurisprudence of the five sub-sects

Abstract:
some of the current jurisconsults of Shia have considered an absolute authentication for it.believe that the narrations stating the forbiddance of giving gifts are weak and cannot be cited; thus, giving gifts to judges is considered solely as giving a gift. On the contrary, most Maliki jurisconsults believe it to be ultimately forbidden, so that corruption is avoided. Some other such as Abu-Hanifeh his apprentices believed it to be abominated, in their perspective, preventions stated in provisions express abomination, not forbiddance. On the side of such opinions, most leading Shiite jurisconsults, nearly all of the Shafi’i and Hanbali jurisconsults, some of Hanifa and some of Maliki’s jurisconsults have considered conditions and they believe that giving gifts to judges in different conditions have various verdicts. It seems that this opinion is superior, and the measure of conditions include the intention of the gift giver and the intention of the judge, the existence of former relationship between the judge and the gift giver, the existence of the gift giver’s case with the judge, the existence of former history of giving gifts to the judge by the gift giver, and the amount of the gift paid to the judge before and after judgeshiptenure.
