Abstract:
Differences in the opinions of jurisprudents regarding "Velayat-e faqih and its limits" have been among the major jurisprudential conflicts in the recent century. But the cause of these differences must be sought after the controversy and controversy in the jurists' argumentative treatises. Meanwhile, classical interpretive approaches and theories in the West appear to have a new capacity for explaining and explaining the causes of the emergence of these differences from a new point of view. This article seeks to clarify the differences between the late Naieni and Imam Khomeini in the category of Velayat-e faqih, in light of the achievements of the "remarkable interpretation" theory, the late thinker of classical hermeneutics Eric Hirsch. In the present study, after considering the two-jurisprudent's assumptions by analyzing the quality of their texts, ultimately, the main reason for the difference in opinion is the difference in their perception of the "inner genre" of the referring traditions as a key concept in Hirsch's theory.
