The study of “E'erad” (abandonment of property) focusing on Nithar A'ras (the gifts of weddings) from perspective of Imamiah jurisprudence

Abstract:
One of the important jurisprudential and legal issues is "E'erad" that is one of the unilateral contracts (Igha') and means abandonment of a property. The Islamic jurists in the old texts have put forward amongst the issues relating "E'erad" the problem of the wedding gifts (Nithar A'ras) and seen it as an example of the legal action of "E'erad". "Nithar A'ras" are the sweets and other gifts scattered in happiness ceremonies. But the recent jurists mostly have counted them as a kind of revocable appropriation. The present paper after discussing different ideas about the nature of "E'erad" and the abandoned property have studied the issue of "Nithar A'ras" and answered the question that what is the nature of "Nithar A'ras"? In response, it has concluded that "Nithar A'ras" that can include money or gold coins is a donation or gift that entails binding appropriation not a revocable one, and the donor loses the right to revoke. The dissention also has a result that follows the preferred idea and there are arguments supporting it which form the paper.
