Abstract:

Damaging to military property is one of the crimes that in military criminal law of different countries across the globe, caused lawmakers to think carefully about it. The protection of military property and necessity of carefulness in using of them is very important so far military laws of most countries criminalizes not only intentionally destruction and causing the loss of military property, but also recklessly or negligently causing to damage and moreover have considered it punishable. The main purpose of this article is analyze the offense of damaging to military property and its features in military law of Iran, and at the end with comparative method discusses the above-mentioned offense and its punishment in USA, Britain and France. Results of this comparison reveal that despite some differences on the type and amount of applicable punishments, all four countries in this study have a same opinion as to criminalize the mentioned act and necessity of punishing the perpetrators.
