Abstract:

In Iranian law, the general rule is that indirect damages cannot be compensated. However, liability law today tends to make some indirect damages exceptionally compensable. Unfortunately, our courts face ambiguity in identifying indirect loss cases, and the key question is what are the indirect loss cases and which of these can be offset by applying the foundations of Iranian jurisprudence and law. In the current practice, Iranian courts generally attribute indirect damages to non-profits. While some of the intermediary losses in customary law have a strong relationship with the harmful act and their compensation is incompatible with the rational custom of society. The present study, using library resources, while enumerating the most important examples of indirect losses in the field of coercive guarantee, has briefly assessed their feasibility. Identifying these examples is the first step in compensating for the loss of conventional losses and preventing the Typology of indirect losses in non-contractual liability
