A reflection on Iran's criminal policy in support of the right to health; Cavid-19 Infectious Disease Case Study
A brief look at Iran's legislative documents in the field of health shows that; Despite the fundamental right to health, the theoretical and practical requirements for the protection of the right to health do not have the necessary publicity and in terms of challenges such as; How to establish the causal relationship, deterrence or non-deterrence of the response system and the quality of government and civil society role-playing, the structure of the criminal policy adopted in the face of Covid-19 infectious disease, crisis and the necessary effectiveness to prevent legitimate health attacks and inhibit new species and mutations No coronavirus findings found. Therefore, in this article with the aim; Understanding the nature of this support in Iran's criminal policy and analytically-descriptive, an attempt has been made to study this issue under the following three topics: criminal policies, preventive policies; Based on government-civil society intervention and representing the shortcomings and harms of each of these two policies. The results of the study indicate that the solution to the crisis, the formulation of a purposeful, legitimate and illegitimate criminal policy of the comprehensive authoritarian model of criminal policy with simultaneous and balanced criminal and non-criminal measures and finally the adoption of a participatory criminal policy (based The balanced power of the people and government institutions is to uphold the right to health.
