Abstract:
Background and Aim

Today, due to the advancement of technology and in order to comply with the two principles of speed and convenience, in domestic and international contracts, many terms and conditions of the contract and economic transactions are not mentioned in the text of the contract. The purpose of this research is to prove the validity of the collusion condition and the guarantee of its implementation.

Methodology

The method used in this research is descriptive-analytical.

Findings

The findings of a study that examined the views of one of the most prominent Imami jurists; Imam Khomeini (rah), and after explaining the concept of the condition and its relationship with the contract

Conclusion

The main reasons for the invalidity of the collusion condition documented in the narrations are consensus and the difficulty of proving it. citation narrations based on the invalidity of the collusion condition are contrary to the principles and rules of jurisprudence and assuming the authenticity of the document and the meaning should be narrowly interpreted and should not be extended to all contracts as a general rule.
