Marital Rape in Iran and England from Social and Legal Point of View

Family plays an essential role in the survival of society and has always been known as one of the most important social institutions, thus, governments adopt various actions to protect the honor of family. One of these actions is criminalization of behaviors that threaten the family. Violence against women in family, drawn attention as an example of these behaviors and violation of the most fundamental women's rights. Despite all efforts and attentions to violence against women, especially in national and international aspects, every day women around the world are the target of various forms of violence. Having sexual intercourse with wife and other instances of sex without consent against wife is not considered as sexual violence in Iran’s Law and Iranian Legislator doesn’t consider such acts as a crime in the field of temporary and permanent marriage. And there is a gap about this. While it should be notice about this subject that having sexual intercourse with wife and other instances of sex without consent against wife have been predicted and criminalized in England’s Law, and if sexual intercourse done without satisfaction of wife considered as rape. In this paper, investigate marital rape in two areas of law and Socio in Iran and United Kingdom.
