Abstract:

Imami jurists agree that the hadd punishment for adultery and adultery is stoning. However, there is a difference of opinion among some jurists between adultery and adultery between young and non-young people. Some jurists based on the generals, which is the Sunnah and verse 9 of Surah Noor, believe in the proof of the limit of the volume and the limit of stoning without any distinction between the adultery of the young and the old, but others with detail, in the adultery of the young man, only the limit Stoning and in the adultery of an old person, they believe in proving the limit of stoning and the limit of cover. Examination of the evidence indicates the weakness of the first statement. Nevertheless, in Article 993 of the Islamic Penal Code, in order to comply with the fatwa of Imam Khomeini (ra), the limit of adultery has been considered as stoning. In the present article, while exploring the jurisprudential documents of the issue, the basic weakness of the law and its incomplete adaptation of the fatwa of the Imam (ra) has been explored.
