The Typology of Employment of Notary Public Registrar and Assistant Registrar in the Legal Structure of Islamic Republic of Iran

Abstract:

Using descriptive-review methods, and by focusing on the law of notary public's offices, registrars, and assistant registrars association (1975) and the by-law of notary public's offices, registrars, and assistants registrars association (passed by the head of the judiciary, 2020), the present research examines the types of employment of registrars and assistant registrars in their service period. The findings showed that Iranian legislator considered different orders for the employment of registrars and their assisstants in ordinary days, temporary being in charge, and permanent being in charge. It also seems that the approval of the abovementioned by-law, though an important and necessary step in the unification of the regulations and standing orders related to the profession of notary public registry and assistance registry in Iran legal system, it hasn’t been sufficient and it is in the need of a serious measure by the legislation institution of the country.
