Investigating the Impact of Decriminalization on Family Health with Emphasis on Judicial Economy Approach

Since the beginning of the 20th century, with the industrialization of countries and the increasing spread of lawsuits and crimes, the alarm was sounded for traditional justice. Most prominent lawyers today agree that public participation in litigation is necessary. Therefore, many governments have tried to create new methods in their legal system using scientific studies. The use of "decriminalization", "impunity" and "legal prosecution" movements are among these methods. In the extra-judicial movement, which is very important, the goal is that these tasks are the responsibility of other organizations instead of resorting to the official criminal justice system and using expert judges to resolve cases and deal with violations and crimes. Civil, social and popular councils should be formed. In our country, Iran, the establishment of dispute resolution councils using the principles of Islam and jurisprudence and in accordance with the above developments is actually a manifestation of the policy of de-judicialization of the current judicial system. , population increase, financial and cultural poverty, government tenure problems in handling many people's disputes due to ignorance or lack of knowledge of laws and regulations, lack of specialized manpower. and related financial resources has shown the importance of prison population density, mistreatment of prisoners and not reforming them in prisons. It is possible to prevent their continuation or deviation to a more suitable direction. This view is seen in the emergence of a new form of criminal policy called de-judgment, which provides a good opportunity for growth and development with the emergence of criminological theories of social reaction in North America. Judicial adjudication diverts the case from justice by distributing criminal cases to other government systems and civil society. In other words, decriminalization aims to limit the intervention of the criminal system and the criminal law and recommends avoiding the criminal law. In the article, by stating the cases of decriminalization, we express the economic effects of these cases.
