Norms of reference in the views of the Guardian Council
The Constitution of the Islamic Republic of Iran has set the two highest reference norms of Sharia and the Constitution as the criteria for monitoring laws and regulations, which Sharia supervision is applied according to the fourth principle by the jurists of the Guardian Council. and other governing laws and regulations are used, that is, the Shariah supervision of the jurists of the Guardian Council is applied to the laws, but in this matter, in terms of the constitution, only supervision should be limited. With the opinion on the principles of the constitution, we find the interpretation opinions of the Guardian Council and the relevant laws and regulations Shariah and constitutional supervision of the Guardian Council regarding regulations, in addition to the fourth principle, the eighty-fifth principle applies to some regulations. However, most of the regulations are without a mechanism in terms of supervision to check the non-contradiction with Sharia and the Constitution. Regarding the monitoring of regulations in terms of contradictions with Sharia and the Constitution, we should refer to ordinary laws in addition to the 138th and 170th principles.
